AN ORDINANCE ABANDONING AN EASEMENT AND RIGHT-OF-WAY HERETOFORE
GRANTED BY MISSOURI-KANSAS-TEXAS RAILROAD COMPANY FOR A PUBLIC
ROAD AND STREET OVER AND ACROSS GRANTOR'S PREMISES, RIGHT-OF-WAY
AND TRACK.
WHEREAS, heretofore , on April 27, 19b2, Missouri-Kansas-
Texas Railroad Company granted to the City of Wichita Falls a
right-of-way and easement for a public road and street over and
across grantor ' s premises, right-of-way and track, such easement
being granted over a tract of land being a part of grantor' s Western
Subdivision Main Track Right-of-Way at milepost 4.70 out of the
A. R. Collins Headright, which tract is fully described in the
easement of record in Volume 859, Page 26, Wichita County Deed
Records .
WHEREAS, no road or street has been constructed over
this easement and it has been found necessary to relocate the
grade crossing, the Board of Aldermen of the City of Wichita Falls
deems it advisable and in the public interest to abandon said
easement and right-of-way.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN
OF THE CITY OF WICHITA FALLS, TEXAS:
SECTION 1. That the above-described easement granted
to the City of Wichita Falls by the Missouri-Kansas-Texas Railroad
Company be, and the same is hereby abandoned.
