BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY
OF WICHITA FALLS, TEXAS, THAT,
WHEREAS, the M. & V. Tank Company owns property consist-
ing of Blocks 3 and 4 of the Scotland Addition to the City of
Wichita Falls, and
WHEREAS, said Company desires to fence that property with
a substantial fence to surround the same to protect them against
pilfering and trespassing, as well as to protect them against any
possible litigation by reason of claims arising on a theory of an
attractive nuisance doctrine,
Permission is hereby granted to said M. & V. Tank Company,
to fence such property thereby closing Linwood Avenue between the
alley and the Fort Worth and Denver City Railway right of way,
but that such permission is granted without prejudice to the City' s
right to order said Linwood Avenue reopened in the future .
Existing utility easements are not to be affected by this
Resolution.
