Ord 2034 8/1/1963 ORDINANCE NO. 2034. AN ORDINANCE REPEALING ORDINANCE NO. 1840 WHICH WAS AN ORDINANCE TO PROVIDE FOR PERMITS FOR MILK PRODUCERS AND OUT-OF-CITY MILK AND ICE CREAM PRODUCERS SELLING PRODUCTS WITHIN THE CITY OF WICHITA FALLS AND AMENDING ORDINANCE NO. 1667 WHICH IS AN ORDINANCE TO REGULATE THE PRODUCERS AND SELLERS OF MILK AND MILK PRODUCTS; TO PROVIDE FOR PERMITS FOR MILK PRODUCERS, MILK PRO- CESSORS, MILK HAULERS FOR HIRE, BULK MILK HAULERS, OUT-OF-CITY MILK AND ICE CREAM PROCESSORS SELLING PRO- DUCTS WITHIN THE CITY OF WICHITA FALLS, TEXAS, OUT-OF- CITY ICE CREAM, ICE CREAM MIX AND/OR FROZEN DESSERT PROCESSORS SELLING PRODUCTS WITHIN THE CITY OF WICHITA FALLS, TEXAS, OR ITS POLICE JURISDICTION; PROVIDING FEES FOR SUCH PERMITS. BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS: SECTION 1. That Ordinance No, 1840 is hereby repealed. SECTION 2. That Ordinance No. 1667 of the City of Wichita Falls is hereby amended to include the following: "9( a) All milk haulers for hire and bulk milk haulers shall be required to secure a permit from the Director of Public Health on January 1st of each year at the rate of 815.00 per year or any part thereof. Bulk milk haulers as used herein shall mean any person or persons picking up milk from producers holding Grade A permit issued by the Wichita Falls Health Unit and delivering to local milk processing plants. 9(aa) All milk producers shall be required to secure a permit from the Director of Public Health on January 1st of each year for such year or any part thereof, for which they will be charged a fee in accordance with the fol- lowing schedule, depending on the zone within which they are located, to-wit: All milk producers located within a radius of 50 miles from Wichita Falls shall pay a fee of $15.00 per year. All milk producers located beyond a 50 mile radius of Wichita Falls, but within a 75 mile radius of Wichita Falls, shall pay a fee of $25. 00 per year. All milk producers located beyond a 75 mile radius, but within a 100 mile radius of the City of Wichita Falls, shall pay a fee of 835.00 per year. Any producer beyond the 100 mile radius of the City of Wichita Falls shall pay a yearly fee of 835.00 plus $10.00 for each additional 10 miles , up to a radius of 200 miles from Wichita Falls. 9(b) All milk processing plants in Wichita County, Texas, which are regularly inspected by a milk sanitarian of the City-County Health Unit shall be required to secure a per- mit on January 1st of each year from the Director of Public V - 2 - Health for a fee of 51,800.00. Instead of paying the $1,800.00 lump sum, the processor may pay for such permit in twelve (12) equal monthly install- . ments of $155.00 each. In the event such a processing plant obtains a permit subsequent to January 1st of any year, it shall be charged the pro rata part of the annual permit fee . 9(c) All milk processing plants which are not regu- larly inspected by a milk sanitarian of the City- County Health Unit shall be required to secure a per- mit on January 1st of each year from the Director of Public Health for a fee of $250.00.. 9( d) All out-of-city ice cream, ice cream mix and/or frozen dessert processors shall be required to secure a permit on January 1st of each year from the Director of Public Health for a fee of 835.00. 9(e) All of the above permit fees shall be payable to the City Clerk of the City of Wichita Falls, Texas. 9(f) Reinspection Fees: Whenever it is necessary for a milk sanitarian of the City-County Health Unit to reinspect a dairy, the pro- ducer shall be charged a fee of $15.00, plus ten cents ( 10c) per mile for the mileage from and to the City of Wichita Falls, which shall be paid before the permit is reinstated. Whenever it is necessary for a milk sanitarian of the City-County Health Unit to reinspect a processing plant within a month, the processor shall be charged a fee of 515.00 plus , if such plant is outside the City Limits of Wichita Falls, ten cents (l0r') per mile for the mileage from and to the City of Wichita. Falls, " SECTION 3. This ordinance shall take effect and be in full force thirty (30) days after the date of its passage. However, all parties holding permits under Ordinance No. 184.0 shall continue to operate under the terms thereof until January 1, 1964..
