Ord 2079 3/30/1964 ORDINANCE NO. 2079 AN ORDINANCE AMENDING SECTION 4 OF ORDINANCE NO. 1375 PASSED AND APPROVED ON THE 8TH DAY OF NOVEMBER, 1943 BY ADDING TO SUCH SECTION PARAGRAPH (o) . PARAGRAPH REFERS TO NOISES CAUSED BY CONDITIONING OR COOLING EQUIPMENT AND REQUIRING THAT MEASURES BE TAKEN TO PREVENT EXCESSIVE NOISE AND THAT SUCH CONDITIONING SYSTEMS BE KEPT IN PROPER OPERATING CONDITION, AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS : Section 1. That Ordinance No. 1375 passed and approved by the Board of Aldermen and Mayor of the City of Wichita Falls on the 8th day of November, 1943, be and the same is hereby amended by adding to Section 4 of said ordinance a new paragraph numbered (o) . Such paragraph shall read as follows, to-wit: " (o) . Causing, suffering or allowing any air-moving, conditioning or cooling equipment of any nature or kind to be so operated or main- tained as to cause any unusual or excessive noise which disturbs the com- fort, quiet or repose of persons in the vicinity thereof. In this connection, all available and reasonable sound-deadening and muffling devices and practices shall be employed. Such equipment shall be kept in proper operating condition. " Section 2 . The fact that warm weather which necessitates the use of air conditioning equipment can be expected shortly, and any such equipment which causes unusual or excessive noise will interfere with the health and comfort of persons in the vicinity, this ordinance is declared an emergency measure on the ground of urgent public need for the preser- vation of the peace and health of the citizens of the City, and it shall therefore take effect and be in force from and after its passage and , publication.
