ORDINANCE NO. /// AN ORDINANCE PROVIDING FOR A CUSTODIAN FOR THE MEMORIAL AUDITORIUM, GROUNDS AND BUILDING BELONGING TO THE CITY OF WICHITA FALLS, TEXAS, FIXING A SCHEDULE OF RENTS TO BE CHARGED FOR THE USE OF SUCH AUDITORIUM AND GROUNDS, AND AUTHORIZING SUCH CUSTODIAN TO RENT THE AUDITORIUM AND/OR GROUNDS AND COLLECT SUCH CHARGES AS MAY BE PROVIDED IDDED BY THIS ORDINANCE, HEREBY REPEALING ALL OTHER ORDINANCES IN CONFLICT HEREWITH. BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS: Section 1. That the City Manager of the City of Wichita Falls, Texas, is hereby designated and appointed as custodian of the Memorial Auditorium, grounds and building,, belonging to the City of Wichita Falls , Texas. Section 2 . That said custodian is hereby authorized to appoint and employ such agents, servants and. employees as in his judgment may be neces- sary to aid or assist him in carrying out his duties as such custodian. Section 3. That the custodian is hereby authorized, and it is made his special duty to advise and manage such Memorial Auditorium, building and grounds, and he is hereby given complete authority and shall be responsible for the renting cf the auditorium in said building and/or grounds surrounding the same, and collecting the rent therefor according to the following sche- dule: Class "A" Traveling Shcw, Theatrical, Industrial: Morning $175,00 Afternoon 200 .00 Evening 250.00 Afternoon and Evening 405.00 Rehearsals Morning or Afternoon 100.00 Evening 125.00 Class "B" Professional Concert, Local Organization receiving Percentage of Paid Admission, Conventions: Morning $125 .00 Afternoon 150,00 Evening 200 .00 Afternoon & Evening 315 .00 Rehearsals Morning or Afternoon 75.00 - Evening 100 .00 Class "C" Symphony Orchestra, Civic Music, Church, Fraternal, Schools (Public and Parochial only) , Charities, with local organization receiving 100% of Admission or Free Admission: Morning $100 .00 Afternoon • 125.00 Evening 150 .00 Afternoon & Evening 245.00 Rehearsals Morning or Afternoon 75 .00 Evening 100 ®00 2 *Above rates include four walls and existing facilities only. Rental Periods: Morning 8 A.M. to 12 Noon Afternoon 1 P0M. to 6 P.M. Evening 7 P.M. to Midnight Section 4. For any use not mentioned herein, the rates shall be fixed by the custodian of said Memorial Auditorium and grounds. In addition to the foregoing set rates, the City Manager shall have the right to make a reason- able charge for extra services, including police, fire, stage hands, labor, and janitor services, and is hereby authorized to contract with any lessee with. regard to such services. Section 5 . All the rental contracts for said auditorium and/or grounds shall be made through the custodian' s office and a public record thereof 'shall be kept in a book provided in a place designated by the custodian, which record shall show the name of the lessee, the date of the execution of such lease, the use for which the auditorium and/or grounds are to be used and the date or day of such use. The persons renting or leasing said auditorium shall be required to deposit with the custodian 50% of- the schedule charge at the time said property is leased, and the balance of such rental shall be paid before the auditorium is used. In the event such lease contract is cancelled by the lessee, the portion of the rental charge paid upon execution of said lease be forfeited to the City as liquidated damages. Section 6. That all funds collected by the custodian as rental on the City Auditorium and/or grounds, shall be deposited with the City Clerk who shall place the same in the General Fund of the City of Wichita Falls, Texas. Section. 7 .
