WHEREAS, a Waiver from all the property owners on
the Ninth Street Side of Block No. 261, Original Townsite
of Wichita Falls, Wichita County, Texas, wherein such
property owners have agreed that they will not object to
the building lane on the Ninth Street side to extend twelve
(I2) feet from the property line, insofar as Lots Nineteen
(19), Twenty (20) and Twenty -one (21), known as 1601, 1603,
and 1605 Ninth Street, are concerned; having been presented
to the Board of Aldermen of the City of Wichita Falls; and,
WHEREAS -, Mr. Solon R. Featherston did make a request
to the Board of Adjustment and Appeals for permission to
construct a building on these lots and said Board did recom-
mend to the Board of Aldermen of the City of Wichita Falls
that a variation be allowed to permit a building to be erected
twelve (12) feet from the property line if the other property
owners In the block did not object;
NOW, THEREFORE, BE IT RESOLVED by the Board of Aldermen
of the City of Wichita Fat 1s, that a variation be allowed
in the existing boundary line for sza.Id lots at 1601, 1603 and
1605 Ninth Street,a building to be erected twelve (12) feet
from the property line.
