WHEREAS, Jess Lesley Bond and wife, Hugh Dortha Bond, are the owners
of Lot Eight (8), Block One (1) of the Beverly Hills Addition to the City
of Wichita Falls, according,to the map or plat thereof, and that the build-
ing on said lot, to -wit, the garage to the rear of said lot, extends into
the alley a distance of two and.one- half.(2 1/2 ft.), the encroachment
being an area of twenty (20) feet by two and one -half (2 1/2 ft.), extend-
ing into the alley at the rear of said lot; and
WHEREAS, the said owners have made application to and secured the
tentative approval of a loan from The National Life and Accident Insurance
Company, a corporation, subject to a waiver or lease from the City of
Wichita Falls of the area covered by said encroachment.
THEREFORE, BE IT RESOLVED BY THE CITY OF WICHITA FALLS, acting through
its Board of Aldermen, that the Mayor of said City be and is hereby authorized
to execute to Jess Lesley Bond and wife, Hugh Dortha Bond, such lease and
waiver to be subordinate to the rights of the Mortgagee -,the National Life
and Accident Insurance Company, its successors and assigns, which lease shall
extend for a period of twenty (20) years and for such longer period as such
Note and mortgage may exist and the said city to subordinate its rights in
said area to the lien, Deed of Trust and mortgage in favor of The National
Life and Accident Insurance Company, its successors and assigns.
This Resolution passed by unanimous vote of the Board of Aldermen of the
City of Wichita Falls, Texas, this, the 13th day of January, 1958.
