A RESOLUTION AUTHORIZING AND DIRECTING
THE DISPOSAL AID SALE OF REAL ESTATE
AND DECLARING AN EMERGENCY

WHEREAS, the City of Wichita Falls, State of Texas, has heretofore
conveyed to the United States of America fee simple title to certain
lands in Wichita County, Texas, for use in connection with Sheppard Air
Force Base, as described in Deed, dated 21 March 1952 and recorded 25
March 1952 in Volume 575, Page 257, of the Deed Records of said County;
and
WHEREAS, the United States of America had prior thereto, through
condemnation proceedings, acquired fee simple title to certain other
tracts of lard. in Wichita County, Texas, for use also in connection
with said Base, as described in Judgment on Declaration of Taking
recorded 18 March 1943 in Volume 390, Page 633, of the Deed Records
of said County, two of said tracts being contiguous to the lands as
recited in paragraph immediately above, and being designated as Tracts
Nos. SF-2 and EF-4, Sheppard Air Force Base; and
WHEREAS, the land descriptions of Tracts Nos. KF-2 and XF-4, as
filed in said condemnation proceedings, referenced a certain tract or
strip of land of 60-foot width, running in a Northerly-Southerly direction
between said two tracts, as owned by the City of Wichita Falls, the west
line of said strip of land constituting the east boundary line of Tract
No. SF-4 and the east line of said strip of land constituting the west
boundary line of Tract No. KF-2, the said strip of land being described
as follows, to wit:
A strip of land of 60-foot width, within the Richard Brown
Survey, Abstract No. 521, Wichita County, Texas, the centerline '
of said strip of land being generally described as: Beginning
at a point which is approximately 540 feet, more or less, East
and 719.5 feet, more or less, North of the Southwest corner of
said Richard Brown Survey, Abstract No. 521; thence extending
in a Northerly direction, in a straight line course midway be-
tween the East boundary line of Tract No. KF-4 and the West
boundary line of Tract No. KF-2 of Sheppard Air Force Base,
thence continuing in a Northerly direction, parallel and at a
distance of 30 feet West of the West boundary line of said
Tract No. KF-2 of said Base, a total approximate distance of
1300 feet, more or less, from the point of beginning, to a
point on the South boundary line of Kell Field, Sheppard Air
Force Base, said point being 30 feet West and 1115.0 feet
South of the Northwest corner of said. Tract No. KF-2, con-
taining 1.79 acres of land, more or less;
and
WHEREAS, the United States of America has now acquired, from the
City of Wichita Falls, Texas, and from other parties, fee simple title
to all the lands surrounding the said strip of land of 60-foot width,
as described above, for use in connection with the activities of
Sheppard Air Force Base; and
WHEREAS, the Chief of Staff of the United States Air Force has
deemed that a military necessity exists for the acquisition of said strip
of land of 60-foot width and that fee simple title thereto should be
vested in the United States; and
WHEREAS, the United States of America has requested the transfer of
title to said property to it and has offered to pay to the City of Wichita
Falls, Texas, a nominal consideration, or a consideration of the sum of
ONE and N0/100 DOLLAR ($1.00); and
WHEREAS, the Mayor and City Council of this City, having duly considered
the above determination of the Chief of Staff of the United States Air Force
and above request of the Government for transfer of title of said property,
deem it advisable, proper, and for the best interests of the City to concur
in such determination and accede to such request by selling and conveying
said property for said consideration.
NOff, THEREFORE, BE IT ORDERED AND RESOLVED by the Mayor and City Cannon
of the City of Wichita Falls, Texas, duly assembled in lawful and regular

session in said City on this day of 19 , a
quorum of said council and a majority of the members being present and
voting "Yes" or in the affirmative on a motion duly made and seconded
for such purpose, that the City convey to the United States of America
all of its right, title and interest in said land and lands hereinbefore
described, for the stun of ONE and NO/100 DOLLAR ($1.00) and for no other
monetary consideration.
IT IS HEREBY FURTHER RESOLVED AND ORDERED: That said motion be, and
is hereby adopted, and that the City of Wichita Falls, Texas, is hereby
authorized to convey by an appropriate conveyance the hereinbefore de-
scribed lands in fee to the United States of America and that the Mayor
of said City be, and is hereby authorized to make and execute all instru-
ments necessary for the consummation of said transaction and execute deed
or deeds conveying said property to the United States of America, pursuant
to both the express and implied provisions of this Resolution, and pur-
suant to law.
That by reason of the fact that the United States Government is in
urgent need of the fee simple title to said land, it is deemed necessary
that said conveyance be made without delay. Therefore, for the preser-
vation of the public health, peace and safety an emergency is hereby
declared to exist whereby this Resolution shall be in full force and
effect from and after its adoption.

This motion was duly passed and adopted by the Mayor and City Council
of the City of Wichita Falls, Texas, the day and year above written.

Council of the City of Wichita Falls, Texas, and that said Resolution is
in full force and effect at the time of this certificate, all as is
shown by the official records of said City in my custody,
