Ord 2130 11/9/1964 ORDINANCE NO. "�/ �� AN ORDINANCE AMENDING ARTICLE 13, SECTION 1, OF ORDINANCE NO. 1877 TO PROVIDE FOR A PROCEDURE ALLOWING DEFERRED PAYMENTS ON WATER AND SEWER LINE EXTENSIONS; REPEALING ORDINANCE NO 1918; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS: SECTION 1. That Article 13, Section 1, of Ordinance no 1877 be amended to read as follows: "Article 13. DEFERRED CHARGES: That upon compliance with the provi- sions of this ordinance water and sewer main extensions may be made; pro- vided either the owner of the property or his agent pays to the City of Wichita Falls the entire sum as set forth in this ordinance or executes a promissory note and mechanic ' s lien in a form approved by the City Attorney agreeing to pay monthly installments, together with such interest rate as may from time to time be set by the Board of Aldermen of the City of Wichita Falls on the remaining sum due, which installments may be included on the owner ' s water bill, and further agreeing, that if any installments become delinquent that the City of Wichita Falls may enforce its liens as provided by law and/or may discontinue water and sewer services to such property until the amount in default has been paid, together with a penalty of ten per cent (10%) of such amount in default. " SECTION 2. That Ordinance No. 1918 which is in conflict herewith, is hereby expressly repealed. SECTION 3. The fact that Ordinance No. 1877 provides for deferred charges on extensions of water and sewer mains without setting out the proper procedure to establish valid obligations for payments, and the fact that the City of Wichita Falls is at the present time making these exten- sions creates an urgent public need for the preservation of the peace, health and safety of the property of the City of Wichita Falls, an emer- gency is hereby declared, and upon passage of this ordinance, it shall become effective immediately.
