ORDINANCE ACCEPTING IMPROVEMENTS ON A PORTION OF HARDING
STREET AND PORTIONS OF SUNDRY OTHER STREETS, AVENUES AND
PUBLIC PLACES IN THE CITY OF WICHITA FALLS, TEXAS; DECLAR-
ING THE CONTRACT WITH TIMMINS AND ANDERSON FOR THE CON-
STRUCTION OF 'SAID IMPROVEMENTS FULLY COMPLETED AND PER-
FORMED; DIRECTING THE ISSUANCE, EXECUTION, AND DELIVERY
OF CERTIFICATES IN EVIDENCE OF SPECIAL ASSESSMENTS LEVIED
AFTER GIVING EFFECT TO SUNDRY CREDITS HEREIN AUTHORIZED
AND ALLOWED AGAINST SOME OF SAID ASSESSMENTS; DIRECTING
THE CITY CLERK TO ENGROSS AND ENROLL THIS ORDINANCE BY
COPYING THE CAPTION OF SAME IN THE MINUTE BOOK OF THE BOARD
OF ALDERMEN OF CITY OF WICHITA FALLS, TEXAS, AND BY FILING
THE COMPLETE ORDINANCE IN APPROPRIATE ORDINANCE RECORDS OF
SAID CITY; AND PROVIDING AN EFFECTIVE DATE;
WHEREAS, the City of Wichita Falls, Texas, has heretofore entered
into a contract with Timmins and Anderson for the making and construction of
certain street improvements on the hereinafter described portions of streets,
avenues, and public places in said City, to-wit:
THE WIDENING AND PAVING OF HARDING STREET FROM ROSEWOOD TO
THOMPSON ROAD
and
ROSEWOOD AVENUE FROM BONNER STREET TO MARCONI STREET
WHEREAS, by sundry proceedings heretofore passed by the Board of
Aldermen of the City of Wichita Falls, Texas, including Ordinance No. 2057,
a portion of the cost of said improvements was levied and assessed against
the respective properties abutting on each of the above described portions
of streets, avenues and public places and against the real and true owners
thereof; and,
WHEREAS, the Board of Aldermen of the City of Wichita Falls, Texas,
has upon review, found and determined that, in some instances, in order to
effect substantial justice and equality, it is desirable and necessary to grant
and issue certain credits against some one or more of the assessments levied
by Ordinance No. 2057, and
WHEREAS, the street improvements hereinabove mentioned have been
completed upon each of the portions of streets, avenues and public places
hereinabove described, and have been inspected and found to be in complete
accordance with the contract therefor;
NOW, THEREFORE,
BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS,
TEXAS, THAT:
The improvements on each of the portions of streets, avenues and
public places hereinabove described be, and they are hereby, accepted; and
the contract with reference thereto be, and it is hereby, found and declared
fully completed and performed.

The Mayor, be, and he is hereby, directed to issue and execute in
the name of the City, certificates in evidence of the special assessments
levied against abutting property and the owner thereof for such improvements,
and the City Clerk is directed to attest same and impress thereon the corpo-
rate seal of the City, all in accordance with the proceedings relating to
such improvements and assessments. The certificates shall be numbered, shall
describe the property against which the assessment has been levied, shall,
where known, state the name or names of the true owners of the respective
parcels of Property assessed and shall be issued in an amount equal to the
difference between the principal amount of the assessment and the amounts of
any credit issued thereon. The numbers of the certificates, with the prop-
erty descriptions to be shown on the respective certificates, together with
the names of the owners of said property, the principal amount of the assess-
ment, the respective credits, if any, which are hereby authorized, granted
and allowed against the principal amount of some one or more of the assess-
ments heretofore levied, and the principal amount for which each certificate
is to be issued after giving effect to such credit, if any, are hereby enum-
erated 'and attached.
IIIo
When each of the certificates has been duly executed as hereinabove
provided, same shall be delivered to the Tax Assessor-Collector as part pay-
ment of the contract price.
Iv
The City Clerk is hereby directed to engross and enroll this Ordi-
nance by copying the caption of same in the Minute Book of the Board of Alder-
men of the City of Wichita Falls, Texas, and by filing the complete ordinance
in the appropriate Ordinance Records of said City.
V
This Ordinance shall take effect and be in full force and effect
from and after the date of. its passage.
