Ord 2162 4/26/1965. T ORDINANCE NO. /K2.) AN ORDINANCE AMENDING CHAPTER 1 OF TITLE 12--SANITARY CODE OF THE CODIFICATION OF ORDINANCES OF THE CITY OF WICHITA FALLS, TEXAS- 1941, PROVIDING A PENALTY AND DECLAR: G" N EMERGENCY. WHEREAS, Chapter 1 of Title 12 of the 1941 Codification of " Ordinance's was adopted by the Board of Aldermen of the City of Wichita Falls, Texas, on December 28, 1919, and has not been amended since; and, WHEREAS, in the ensuing forty-five (45) years great progress has been made not only in the field of medical knowledge of disease but in the treatment and cure of many of mankindse illnesses; and, WHEREAS, it is the desire of the Board of Aldermen of the City of Wichita Falls to modernize the Sanitary Code of the City to keep pace with current medical knowledge and skill. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS, SECTION 1. That Chapter 1 of Title 12--Sanitary Code of the Codification of Ordinances of the City of Wichita Falls, Texas, 1941, be amended to read as follows: SECTION 2 . That the "Sanitary Code for Texas, " Article 4477, Vernon' s Annotated Civil Statutes, Rules 1 through 33, as amended, and all future amendments made thereto is hereby in all things adopted as the Sanitary Code of the City of Wichita Falls. SECTION 3. That whenever there is discretion placed in the local health officer or local health authority by the "Sanitary Code for Texas, " the local health officer or local health authority shall be governed by and use as a standard "Control of Communicable Diseases in Man, 10th ,Edition, 1965," and all future editions, by the American Public Health Association, Inc. , a copy of which is hereby attached and made a part of this ordinance for all purposes. SECTION 4. Any person who violates any of the provisions of this ordinance shall be guilty of a misdemeanor and, upon conviction, thereof, shall be punished by a fine of not more than $200.00. In addition thereto, such persons may be enjoined from continuing such violations. Each day upon which such a violation occurs constitutes a separate violation SECTION 5. As the present Sanitary Code of the City of Wichita Falls is out of date and inadequate, this ordinance is declared' to be an emergency measure on the ground of urgent public-need for the preser- vation of peace, health and safety of the City, and by reason thereof this ordinance shall take effect and be in full force from and after the day of its passage. And, at that time all ordinances and parts of ordinances in conflict with this ordinance are hereby repealed.
