BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS AS FOLLOWS: ARTICLE I - WORDS AND PHRASES DEFINED SECTION 1. (a) Definition of words and phrases - The following words and phrases when used in this ordinance shall for the purpose of this ordinance have the meanings respectively ascribed to them in this article. (b) Whenever any words and phrases used herein are not defined in the State laws regulating the operation of vehicles, any such definition herein shall be deemed to apply to such words and phrases used herein. Subdivision I - Vehicles, Traffic, Etc. , Defined. SECTION 2. (a) Vehicle - Every device in, upon, or by which any person or property is or may be transported or drawn upon a highway, except devices moved by human power or used exclusively upon stationary rails or tracks. (b) Motor Vehicle - Every vehicle which is self propelled. (c) Commercial Vehicle - Every vehicle licensed, or lawfully used for the transportation of property. (d) Authorized Emergency Vehicles - Vehicles of the Fire Department, Police Department, Public and Private Ambulances for which permits have been issued by the State Board of Health, emergency vehicles for the City of Wichita Falls, emergency vehicles of all utility companies holding valid franchise from the City of Wichita Falls, Texas, and all wreckers that have a towing capacity of 12,000 pounds or more and are equipped with the following: 1. One yellow beacon ray. 2. Three safety flares - burnable type or glass-reflector type. 3. One Broom. 4. One Shovel. 5. A radio capable of sending and receiving on the Police frequency. 6. Safety four-wheel brake lock. 7. Heavy-duty steel chains. - 8. A heavy-duty tie rope. 9. One four-pound dry chemical fire extinguisher. 10. Minimum of $25,000. and $50,000. Public Liability Insurance. PUBLIC HOLIDAYS: Whenever the term holiday is used herein, it shall include the following dates: the 1st day of January, the 1 19th day of January, the 22nd day of February, the 2nd day of March, the 21st day of April, the 3rd -day of June, the 4th day of July, the 1st Monday in September, the 12th day of October, the 11th day of November, the 25th day of December, of each year, and all days appointed by the President of the United States or by the Governor of Texas, as days of fasting and Thanksgiving, together with May. 30th and February 12th of each year, and every day on which an election is held throughout the State of Texas, are hereby declared legal holidays. SECTION 3. (a) Bicycle - Every device propelled by human power upon which any person may ride, having two tandem wheels. (b) Met©rcy e, - Every vehicle having a saddle or seat for the use .of the rider and designed to travel on not more than three wheels in contact with the ground, but excluding :a tractor. _SECTION 4. (a) Railroad - A carrier of persons or property Upon cars, operated upon statih.nary mils. (b) Railroad train - A steam engine, electric or other motor with or without cars coupled thereto, operated upon rails SECTION 5. (a) Traffic - Pedestrians, ridden or herded animals, vehicles, motor buses, and other conveyances either singly or together while using any street for purposes of travel. SECTION 6. (a) ht of Way - The privilege of the immediate use of the roadway. SECTION 7. (a) Stop - When required means complete cessation of movement. (b) Stop, stop ink or standing - When prohibited means any stopping :or standing of a vehicle whether occupied or not, except when necessary to avoid conflict with other traffic or in compliance with the directions of a police officer or traffic-control sign or signal. (c) Park - When prohibited means the stopping or standing vehicle, whether occupied or not, otherwise than temporarily for the purpose of and while actually engaged ;in loading or unloading. SECTION 8, (a) Official time standard - Whenever certain hours are named herein they shall mean Central Standard.Time. (b) Public Holidays - Whenever the term holiday is used herein, it shall, include the following dates: the 1st day of January, the 30th day of May, the 4th of July, the 1st Monday in September, the fourth Thursday in November, and the 25th day of December. Subdivision 13 - Persons, Etc. , Defined. SECTION 9. (a) Person - Every natural person, firms, co-partnership association, or corporation. (b) Driver Every person -who drives or is in actual physical control of a vehicle. (c) Pedestrian - Any person afoot. SECTION 10 Police Officer - Every officer of the police depart- ment or any officer authorized to direct or regulate traffic or to make arrests for violations of traffic regulations. -2- Subdivision III - Streets, Etc. , Defined { SECTION 11. (a) Streets or ilhta The entire width between the boundary lines of every way publicly maintained when any part thereof is open to the use of the public for purposes of vehicular travel. (b) Private road or driveway Every way or place in private ownership and used for vehicular travel by the owner and those having express or implied permission from the owner, but not by other persons. (c) Roadway - That portion of a street or highway improved, designed, or ordinarily used for vehicular travel, exclusive of the curb or shoulder. In the event a highway includes two or more separate roadways the term "Roadway" as used herein shall refer to any such roadway separated but not to all such roadways collectively. (a) Sidewalk - That portion of a street between the curb lines, or the lateral lines of a roadway, and the adjacent property lines intended for the use of pedestrians. (e) Alley - A public road other than a street or high- way being a division within a block running parallel with, and/or connecting with one or more streets. SECTION 12 (a) Laned roadway - A roadway which is divided into two or more clearly marked lanes for vehicular traffic. (b) Through hi hwa - Every highway or portion thereof on which vehicular traffic is given preferential right of way, and at the entrances to which vehicular traffic from intersecting highways or streets is required by law to yield right of way to vehicles on such through highway in obedience to either a stop sign or yield sign, when such signs are erected as provided in this ordinance. (c) Controlled-access highway - Every highway, street, or roadway in respect to which owners or occupants of abutting property or lands and other persons have no legal right of access to or from the same, except at such points only and in such manner as may be determined by the public authority having jurisdiction over such highway, streets, or roadway. SECTION 13. (a) Intersection - The area embraced within the pro- longation or connection of the lateral curb lines, or, if none, then the lateral boundary lines of the roadways of two highways which join one- another at or approximately at right angles, or the area within which vehicles travel- ing upon different highways joining at any other angle may come in conflict. (b) Where a highway includes two roadways thirty (30) feet or more apart, then every crossing of each roadway of such divided high- way by an intersecting highway shall be regarded as a separate intersection. In the event such intersecting highway also includes two roadways thirty' (30) feet or more apart, then every crossing of two roadways of such highways shall be regarded as a separate intersection. SECTION 14. (a) Crosswalk That part of a roadway at an intersection included within the connections of the lateral lines of the sidewalks on opposite sides of the highway measured from the curbs, or in the absence of curbs from the edges of the traversable roadway. -3® (b) Any portion of a roadway at an intersection or elsewhere distinctly indicated for pedestrian crossing by lines or other markings on the surface. SECTION 15.` (a) Safety zones - The area or space officially set apart within a roadway for the exclusive use of pedestrians and which is protected or is so marked or indicated by adequate signs as to be plainly visible at all times while set apart as a safety zone. (b) Curb loading zone - A space adjacent to a curb reserved for the exclusive use of vehicles during the loading or unloading of passengers, materials and/or freight. (c) Passenger curb loading zone A place adjacent to a curb reserved for the exclusive use of vehicles during the loading or unloading of passengers. SECTION 16, (a) Official traffic-control devices - All signs, signals, marking, and devices not inconsistent with this ordinance placed or erected by authority of the traffic engineer of the City of Wichita Falls for the purpose of regulating, warning, or guiding traffic. (b) Traffic-control signal - Any device, whether manually, electrically, or mechanically operated, by which traffic is alternately directed to stop and to proceed. SECTION 17. (a) Business district - The territory continuous to and including a highway when within any six hundred (600) feet along .such highway there are buildings in use for business or industrial purposes, including but not limited to hotels, banks or office building, railroad stations, and public buildings which occupy at least three hundred (300) feet of frontage on one side or three hundred (300) feet collectively on both sides of the highway. (b) Residence district - The territory continuous to and including a highway not comprising :a business district when the property on such highway for a distance of three hundred (300) feet or more is in the main improved with residence or residences and buildings in use for business. (c) Urban district - The territory continuous to and including any highway or street which is built up with structures devoted to business, industry or dwelling houses, situated at intervals of less than one hundred (100) feet for a distance of one-quarter of a mile or more. SECTION 18, (a) Central business district - All streets and portions of streets within the area described as follows: Beginning at Wichita Valley R.R. track at Thirteenth Street; thence running North with the Wichita Valley R.R. track connecting with the Fort Worth &Denver R.R. track; thence running North with the Fort Worth & Denver R.R. track to Fifth Street; thence West on Fifth Street to Austin Street, thence South on Austin Street to Thirteenth Street, thence East on Thirteenth Street to the place of beginning. -4- ARTICLE II - TRAFFIC ADMINISTRATION SECTION 19 Police administration - There is hereby established in the police department of this city a traffic division to be under the control of an officer of the police appointed by and directly responsible to the chief of police. SECTION 20 Duty of traffic division - It shall be the duty of the traffic division with such aid as may be rendered by other members of the police department to enforce the street traffic regulations of this city, and all of the State vehicle laws applicable to street traffic in this city, to make arrests for traffic violations, to investigate accidents and to cooperate with the city traffic engineer and other officers of the city in the administra- tion of the traffic laws and in developing ways and means to improve traffic conditions, and to carry out those duties especially imposed upon said division by this ordinance and the traffic ordinances of this city. SECTION 21 (a) Records of traffic violations - The police department or the traffic division thereof shall keep record of all violations of the traffic ordinances of this city or of the State vehicle laws of which any person has been charged, together with a record of the final disposition of all alleged offenses. Such record shall be so maintained as to show all types of violations and the total of each. Said record shall accumulate during at least a five-year period and from that time on the record shall be maintained complete for at least the most recent five-year period. (b) All forms for records of violations and notices of violations shall be serially numbered . (c) All records and reports shall be public records. SECTION 22 Traffic division to investigate accidents - It shall be the duty of the traffic division, assisted by other police officers of the depart- ment to investigate traffic accidents, to arrest and to assist in the prosecution of those persons charged with violations of law causing or contributing to such accidents. SECTION •23 Traffic accident studies - Whenever the accidents at any particular location become numerous, the traffic division shall cooperate with the city traffic engineer in conducting studies of such accidents and deter- mining remedial measures. SECTION 24 (a) Drivers files to be maintained The police department of the traffic division thereof shall maintain a suitable record of all traffic accidents, arrests, convictions, and complaints reported for each driver, which shall be filed_ alphabetically under the name of the driver concerned. (b) Said division shall study the cases of all the drivers charged with frequent or serious violations of the traffic laws or involved in frequent traffic accidents or any serious accident, and shall attempt to discover the reasons therefore, and shall take whatever steps are lawful and reasonable to prevent the same or to have the licenses of such persons suspended or revoked. -5- (c) Such records shall accumulate during at_ least a 5-year period and from that time on such records shall be maintained complete for at least the most recent 5-year period. SECTION ;25 Traffic division to submit annual traffic-safety report - The traffic division shall annually prepare a traffic report which shall be filed with the city clerk. Such report shall contain information on traffic matters in this city as follows (1) The number of traffic accidents, the number of persons killed, the number of persons injured, estimated damage to property and other pertinent traffic accident data (2) The number of traffic accidents investigated and other pertinent data on the safety activities of the police (3) The plane and recommendations of the division for future traffic safety activities. SECTION 26 The traffic division to designate method of identifying funeral processions - The traffic division shall,designate a type of pennant or other identifying insignia to be -displayed upon, or other method to be employed: to identify the vehicles in funeral processions with the approval of the Traffic Engineering Department. sesra7 p=e-sear,t,s,_c,v,ia,l:,,b :,p,ro d d y=. pr..tvate_. :tergrise:.,a t,1141 eXpen e..4t,o.,.....t.i e e,it_y., SECTION 27 (a) City Traffic Engineer - The office of city traffic engineer is hereby established. The city traffic engineer shall be a qualified engineer, and shall be appointed by the City Manager, and he shall exercise the powers and duties as provided in this and other ordinances of the City of Wichita Falls. (b) It shall be the general duty of the city traffic engineer to determine the installation and proper timing and maintenance of' ' traffic-control devices, to conduct engineering -analyses of traffic accidents and to devise remedial measures, to conduct engineering investigation of traffic conditions, to plan the operation of traffic on the streets and high- ways of this city, to cooperate with other city officials in the development of ways: and means to -improve traffic conditions, and to carry out the additional powers and duties imposed by ordinances of this city. SECTION 28 (a) Emergency and experimental regulations - The chief of police is hereby empowered to make regulations necessary to make effective the provisions of the traffic ordinances of this city and to make and enforce temporary or experimental regulations to cover emergencies or special condi- tions. No such temporary or experimental regulation shall remain in effect for more than 90 days. (b) The city traffic engineer may test traffic-control devices under actual conditions of traffic. SECTION 29 Traffic Commission, its mowers and duties - There is hereby established a Traffic Commission which shall hereafter -be designated as the City Traffic Commission. -6- (a) The members of such commission shall be appointed by the Mayor with the approval of the Board of Aldermen of the City of Wichita Falls, and such members shall serve without pay. (b) In appointing such commission the Mayor shall consider representative citizens who meet the following qualifications: 1. One individual who is connected with the Wichita Falls Independent School District and who resides in the City of Wichita Falls, Texas. 2. One individual who is connected with either the public press, or some other publicity medium. -3. One individual who shall be a recognized member of the Wichita County Bar Association. 4. One individual who is associated with the automobile insurance and/or adjustor industry. 5. Two individuals who are connected with the Retail Merchants Association, or some industry which has to do with the shipping or transportation of goods and merchandise. 6. Five individuals who have shown interest in the traffic program of the City of Wichita Falls, Texas, who reside in the City of Wichita Falls, Texas. (c) The commission shall elect its Chairman and Vice-Chairman annually. The Traffic Engineer shall act as Secretary to the Commission but shall have no vote thereon. (d) It shall be the duty of the City Traffic Commission to pass upon the desirability of all traffic regulations for the City of Wichita Falls, and they, in turn, shall report to the Board of Aldermen of such City, the desirability of appropriating funds, expending funds, and passing municipal ordinances controlling traffic; it shall have the power to conduct hearings, to take testimony, to subpoena witnesses, to administer an oath to witnesses, and to make any and every kind and character of investigation that in their opinion would help to solve any traffic problem within the City. (e) Proposals submitted by the Traffic Engineering Division shall be subject to the consideration and approval of the City Traffic Commission before they shall be submitted to the Board of Aldermen. (f) It is further provided that the City Traffic Commission as herein constituted, may at its descretion require the attendance at any of its meetings any city employee, or official, who in the opinion of the Commission. should be available for consultation or advice. (g) Terms of the commissioners shall be for three (3) years, with the present terms thereof staggered as follows: four (4) members shall be appointed for one year terms; four (4) members for two year terms, and three (3) members for three year terms. In his first appointments, the Mayor shall appoint the members and designate the length of their terms; thereafter their terms shall be fixed at three (3) years. Any interim vacancy on the Traffic Commission shall be filled as in the case of an original appointment, but for the unexpired term. All terms shall be calendar year terms, from January 1 to December 31. -7- . .0 (h) Any member missing two consecutive regular meetings for reasons not acceptable to the Traffic Commission, shall upon recommendation of the Traffic Commission be replaced by the Mayor with the approval of the Board of Aldermen of the City of Wichita Falls. (i) Before a recommendation will be made to the Board of Aldermen, it must be approved by a majority of the Traffic Commission present, and voting; except, in no case will a recommendation be made to the Board of Aldermen unless such recommendation has received four affirmative votes by the City Traffic Commission, ARTICLE III - ENFORCEMENT AND OBEDIENCE TO TRAFFIC REGULATIONS SECTION 30 (a) Authorit, of .once and fire department officials - It shall be the duty of the officers of the police department or such officers as are assigned by the chief of police to enforce all street traffic laws of this city and all of the State vehicle laws :applicable to street traffic in this city. (b) Officers of the police department or such officers as are assigned by the chief of police are hereby authorized to direct all traffic by voice, hand, or signal in conformance with traffic laws, provided that, in the event of a fire or other emergency or to expedite traffic or to safeguard pedestrians, officers of the police department may direct traffic as conditions may require notwithstanding the provisions of the traffic laws. (c) Officers of the fire department, when at the scent of a fire, may direct or assist the police in directing traffic thereat or in the immediate vicinity. SECTION 31 Required obedience to traffic ordinance - It is a misde- meanor for any person to do any act forbidden or fail to perform any act required in this ordinance. SECTION 32 Obedience to police and fire department officials - No person shall willfully fail or refuse to comply with any lawful order or direction of a police officer or fire department official. SECTION 33 Persons propelling push carts or riding animals to obey traffic regulations - Every person propelling any push cart or riding an animal upon a roadway, and every person driving any animal-drawn vehicle shall be subject to the provisions of this ordinance applicable to the dtiver of any vehicle, except those provisions of this ordinance which by their very nature can have no application. SECTION 34 e-of coasters. roller skates and similar devices restricted - No person upon roller skates, or riding in or by means of any coaster, toy vehicle, or similar device, shall ,go upon any roadway except while crossing a street on a crosswalk and when so crossing such persons shall be granted all of the rights and shall be subject to all of the duties applicable to pedestrians. This section shall not apply upon any street while set aside as a play street as authorized by ordinance of this city, -8- , , • * ' SECTION 35 Public emyees to obey traffic regulations - The provisions of this ordinancershall apply to the driver of any vehicle owned or used in the service of the United. States Government, this State, County, or City, and it shall be unlawful for any said driver to violate any of the pro- visions of this ordinance, except as otherwise permitted in this ordinance or by State statute. SECTION :36 Authorized emergency vehicles - The driver of an authorized emergency vehicle, when responding to an emergency call or when in the pursuit of an actual or suspected violator of the law or when responding to but not upon returning from a fire alarm, may exercise the privileges set forth in this section, but subject to the conditions herein stated. (a) The driver of any authorized emergency vehicle except an ambulance may: 1. Park or stand, irrespective of the provisions of this act; 2. Proceed past a red or stop signal or stop sign; 3. Exceed the prima facie speed limits, so long as he does not endanger life or property; 4. Disregard regulations governing direction of movement or turning in specified directions; 5. Police vehicles may disregard alley regulations and signal lights while in the performance of duty; (b) Driver of an ambulance may do all those acts set out in Nos. 1, 2 and 4 of Subsection (a) ; however, the driver of an ambulance may not exceed the prima facie or posted speed limits in excess of ten (10) miles per hour and may not enter or proceed through any intersection that is con- trolled by an official traffic control device other than a signal, at a speed greater than ten (10) miles per hour, (c) The exemptions herein granted to an authorized vehicle shall apply only when the driver of any said vehicle while in motion sounds audible signal by bell or siren, as may reasonably be necessary, and when the vehicle is equipped with at least one lighted lamp displaying a red light visible under normal atmospheric conditions from a distance of five hundred (500) feet to the front of such vehicle, except that an authorized emergency vehicle operated as a police vehicle need not be so equipped. (d) The foregoing provisions shall not relieve the driver of an authorized emergency vehicle from the duty to drive with due regard for the safety of all persons, nor shall such provisions protect the driver from the consequences of his reckless disregard for the safety of others. SECTION 37 (a) Operation of vehicles on approach of authorized emergency vehicles - Upon the immediate approach of an authorized emergency vehicle making use of audible and visual signals meeting the requirements of -9- • 0 the lays of this State, or of a police vehicle properly and lawfully making use of an audible signal only; the driver of every other vehicle shall yield the right of way and shall immediately drive tea_ position parallel to, and as close as possible to, the right-hand edge or curb of the roadway clear of any intersection and shall stop and remain in such position until the authori- zed emergency vehicle has passed, except when otherwise directed by a police officer, (b) This section shall not operate to relieve the driver of an authorized emergency vehicle from the duty to drive with due regard for the safety of all persons using the highway. SECTION 38 Immediate notice of accident - The driver of a vehicle involved in an accident resulting in injury to or death of any person or property damage to an apparent extent of twenty-five ($25) dollars or more, shall immediately by the quickest means of communication give notice of such accident to the police department if such accident occurs within the corporate limits of this city. SECTION 38-1 Written reports of accidents - The driver of a vehicle which is in any manner involved in an accident resulting in injury to or death of any person or total property damage to an apparent extent of twenty-five ($25) dollars or more shall, within. twenty-four (24) hours after such accident, forward a written report of such accident to the police department. The provisions of this section shall not be applicable when the accident has been investigated at the scene by a police officer while such driver was present thereat. SECTION 38-2 Whenaletoreort - Whenever the driver of a vehicle is physically incapable of giving immediate notice of an accident as required in section 38 and there was another occupant in the vehicle at the time of the accident capable-of doing so, such occupant shall give or cause to be given, the notice not given by the driver. (b) Whenever the driver is physically incapable of making a written report of an accident as required in section 38-1 and such driver is not the owner of the vehicle, then the owner of the vehicle involved in such accident shall within twenty-four (24) hours after learning of the accident make such report not made by the driver. SECTION 38-3 Written accident reports confidential - All written accident reports made by drivers, owners, or occupants of vehicles involved in accidents as required in sections 38-1 and 38-2 shall be without prejudice to the individual so reporting and shall be for the confidential use of the police department or other governmental agencies having use for the records for accident prevention purposes, except that the police department may disclose the identity of a person involved in an accident when such identity is not other- wise known or when such person denies his presence at such accident. No such report shall be used as evidence in any trial, civil or criminal, arising out of an accident except that the department shall furnish upon demand of any court, a certificate showing that a specified accident report has or has not been made to the police department solely to prove a compliance or a failure to comply with the requirements that such a report be made to the department. -10- • ARTICLE IV - TRAFFIC-CONTROL DEVICES SECTION 39 Authority to install traffic-control devices - The city traffic engineer shall place and maintain traffic-control signs, signals, and devices when and as required under the traffic ordinances of this city to make effective the provisions of said ordinances, and may place and maintain such additional traffic-control devices as he may deem necessary to regulate traffic under the traffic ordinances of this city or under State law, or to guide or warn traffic. SECTION 40 Manual and specifications for traffic-control devices - All traffic-control signs, signals, and devices shall conform to the manual and specifications approved by the State Highway Department and Department of Public Safety. All signs and signals required hereunder for particular purpose shall so far as practicable be uniform as to type and location consistent with the provisions of State law or this ordinance shall be official traffic-control devices. SECTION 41 Obedience to official traffic-control devices - The driver of any vehicle shall obey the instructions of any official traffic-control device applicable thereto placed in accordance with the traffic ordinances of this city, unless otherwise directed by a police officer, subject to the exceptions granted the driver of an authorized emergency vehicle in this ordinance. SECTION 42 When traffic devices required for enforcement purposes - No provision of this ordinance for which signs are required shall be enforced against an alleged violator if at the time and place of the alleged violation an official sign is not in proper position and sufficiently legible to be seen by an ordinarily observant person. Whenever a particular section does not state that signs are required, such section shall be effective even though no signs are erected or in place. SECTION 43 Traffic-control signal legend - Whenever :traffic is control- led by traffic-control signals exhibiting different colored lights, or colored lighted arrows, successively one at a time or in combination, only the colors Green, Red and Yellow shall be used, except for special pedestrian signals carrying a word legend, and said lights shall indicate and apply to drivers of vehicles and pedestrians as follows: (a) Green alone or "GO" (1) Vehicular traffic facing the signal, except when prohibited under section 87, may proceed straight through or turn right or left unless a sign at such place prohibits either such turn. But vehicular traffic, including vehicles turning right or left, shall yield the right of way to other vehicles and to pedestrians lawfully within the intersection or an adjacent crosswalk at the time such signal is exhibited. (2) Pedestrians facing the signal may proceed across the roadway within any marked or unmarked crosswalk. (b) Red with green arrow. (1) Vehicular traffic facing such signal may cautiously enter the intersection only to make the movement indicated by such arrow but -11- shall yield ,the right of way to pedestrians lawfully within a crosswalk or to other traffic lawfully using the intersection. (2) No pedestrian facing such signal shall enter the roadway until the green or "GO" is shown alone unless authorized to do so by a pedestrian "WALK" signal. (c) Yellow alone or "Caution" when shown following the green or "GO" signal. (1) Vehicular traffic facing the signal is thereby warned that the red or "STOP"signal will be exhibited immediately thereafter and such vehicular traffic shall not enter or be crossing the intersection when the red or "STOP" signal is exhibited. (2) Vehicular traffic that has entered intersection shall clear such intersection; all others shall stop and await a green light. (3) No pedestrian facing such signal shall enter the roadway until the green or "GO" is shown alone unless authorized to do so by a pedestrian "WALK"signal. (d) Red alone or "STOP" (1) Vehicular traffic facing the signal shall stop before entering the crosswalk on the near side of the intersection or, if none, then before entering the intersection and shall remain standing until green or "GO" signal is shown alone. (2) No pedestrian facing such signal shall enter the roadway until the green or "GO" is shown alone unless authorized by a pedestrian "WALK" signal. (e) In the event an official traffic-control signal is erected and maintained at a place other than an intersection, the provisions of this section shall be applicable except as to those provisions which by their nature can have no application. Any stop required shall be made at a sign or marking on the pavement indicating where the stop shall be made, but in the absence of any such sign or marking the stop shall be made at the signal. SECTION 44 Pedestrian control signals - Whenever special pedestrian control signals exhibiting the words "WALK" or "WAIT" or "DON'T WALK" are in place such signals shall indicate as follows: (a) Walk - Pedestrian facing such signal may proceed across the roadway in the direction of the signal and shall be given the right of way by the drivers of all vehicles. (b) Wait or Don't Walk - No pedestrian shall start to cross the roadway in the direction of such signal, but any pedestrian who has partially completed his crossing on the walk signal shall proceed to a sidewalk or safety zone while the wait signal is showing. -12- SECTION 45 (a) Flashing signals - Whenever an illuminated flashing red or yellow signal is used in a traffic sign or signal it shall require , '. obedience by vehicular traffic as follows: (1) Flashing red (stop signal) - When a red lens is illuminated with rapid intermittent flashes, drivers of vehicles shall stop before entering the nearest crosswalk at an intersection or at a limit line when marked, or, if none, then before entering the intersection, and the right to proceed shall be subject to the rules applicable after making a stop at a stop sign. (2) Flashing yellow (caution signal) - When a yellow :lens is illuminated with a rapid intermittent flashes, drivers of vehicles may proceed through the intersection or past such signal only with caution. (b) This section shall not apply at railroad grade cross- ings. Conduct of drivers of vehicles approaching railroad grade crossings shall be governed by the rules set forth in Section 69 of this ordinance,. SECTION 46 (a) Display of unaythorized signs, signals or markings - No person shall place, maintain, or display upon or in view of any highway any un- authorized sign, signal, marking, or device with purports to be or is in imitation of or resembles an official traffic-control device or railroad sign or signal, or which attempts to direct the movement of traffic, or which hides from view or interferes with the effectiveness of any official traffic-control device or any railroad sign or signal. (b) No person shall place or maintain nor shall any public authority permit upon any highway any sign or signal bearing thereon any commer- cial advertising. No person shall place or maintain a sign across or above a street unless permission is granted by the city traffic engineer. (c) This section shall not be deemed to prohibit the erection upon private property adjacent to highways of signs giving useful directional information and of a type that cannot be mistaken for official signs. (d) Every such prohibited sign, signal, or marking is hereby declared, to be a public nuisance and the authority having jurisdiction over the highway is hereby empowered to remove the same or cause it to be removed without notice. SECTION 47 Interference with the official traffic-control devices or railroad signs or signals - No person shall without lawful authority attempt to or in fact alter, deface, injure, knock down, or remove any official traffic- control device or any railroad sign or signal or any inscription, shield or insignia thereon, or any other part thereof. _SECTION 47-1 Abatement of traffic hazards in the form of trees, hedges, shrubbery and the like - The traffic engineer of the City of Wichita Falls will cause the abatement of traffic hazards. in the form of trees, hedges, shrubbery and the like, which interfere with the vision of vehicle drivers; prescribing the method for removing such hazards; prescribing that notice be given to the adjoining property owners; and declaring an emergency. SECTION 48 Authority to establish play streets - The city traffic engineer shall have authority to declare any street or part thereof a play street -13- P and to place appropriate signs or devices in the roadway indicating and • helping to protect the same. Whenever authorized signs are erected indicating any street or part thereof as a play street, no person shall drive a vehicle upon any such street or portions thereof except drivers of vehicles having business or whose residences are within such closed area, and then any said driver shall exercise the highest degree of care in driving upon any such street or portion thereof. SECTION 49 Cit traffic engineer to desi:nate crosswalks and establish safety zones - The city traffic engineer is hereby authorized: (1) To designate and maintain, by appropriate devices, marks or lines upon the surface of the roadway, crosswalks at inter- sections where in his opinion there is particular danger to pedestrians crossing the roadway, and at such other places as he may deem necessary. (2) To establish safety zones of such kind and character and at such places as he ,may deem necessary for the protection of pedestrians. SECTION 49-1 (a) Traffic lanes - The city traffic engineer is hereby authorized to mark traffic lanes upon the roadway of any street or highway where a regular alignment of traffic is necessary. Overhead traffic lane signs .are hereby approved for the proper control of lane assignments. When such lanes are properly signed and marked, it will be a violation of this ordinance for any vehicle traveling straight through or turning left or right contrary to properly signed- and marked lanes. (b) Where such traffic lanes have been marked, it shall be unlawful for the operator of any vehicle to fail or refuse to keep such vehicle within the boundaries of any such lane except when lawfully passing another vehicle or preparatory to making a lawful turning movement. ARTICLE V - SPEED REGULATIONS SECTION 50 -State speed laws applicable - The State traffic laws regulating the speed of vehicles shall- be applicable upon all streets -within this city, except as this ordinance, as authorized by State - law, hereby declares and determines upon the basis of engineering and traffic investigation that certain speed regulations shall be applicable upon specified streets or in certain areas, in which event it shall be prima facie unlawful for any person to drive a -vehicle-at a speed in excess of any speed so declared in this ordinance -when signs are in place giving notice thereof. SECTION 51 Increasing State Speed Limits in certain zones - It is hereby deemed upon the basis of an engineering and traffic investigation that the speed permitted by State -Law upon certain streets -is less -than is necessary for safe operation of vehicle's thereon. It is hereby declared that the prima facie speed limits are altered on those streets set out in Schedule IX in the Appendix of this -ordinance and shall henceforth be as shown in said-Schedule IX when signs are-erected giving notice thereof. SECTION 52 Establishment of Speed Zones - - Whenever the city traffic engineer shall determine upon the basis of an engineering and traffic investigation that the 30 miles per hour speed herein before set forth is greater or less than is reasonable or safe under the conditions found to exist at any intersection or -14- • other place or upon any sort of a street or highway, the said city traffic engineer may. determine and declare a reasonable and safe speed limit and the change shall be effective at all times when appropriate signs giving notice thereof are erected at such intersections or other places or parts of. the highway or street. SECTION 53. Regulation of speed by traffic signals - The city traffic engineer is authorized to regulate the timing of traffic signals so as to permit the movement of traffic in an orderly manner at speeds slightly at variance from the speeds otherwise applicable within the district or at intersections and shall erect appropriate signs giving notice thereof. SECTION 54. When speed restrictions not applicable - The speed limitations set forth in this article are not applicable to authorized emergency vehicles when responding to an emergency call, or when used in the pursuit of an actual or suspected violator of the law, or when responding to but not upon returning from a fire alarm, and the driver thereof sounds audible signal by bell, siren, or exhaust whistle. This provision shall not relieve the driver of an authorized emergency vehicle from the duty to drive with due regard for the safety of all persons using the street or roadway, nor shall it protect the driver thereof from the duty to use ordinary care under the circumstances. ARTICLE VI - TURNING MOVEMENTS SECTION 55. Required position and method of turning at intersections - The driver of a vehicle intending to turn at an intersection shall do as follows: - (a) Right turns - Both the approach for a right turn and a right turn shall be made as close as practicable to the right-hand curb or edge of the roadway. (b) Left turns on two-way roadways - At any intersection where traffic is permitted to move in both directions on each roadway entering the intersection, an approach for a left rurn shall be made in that portion of the right half of the roadway nearest the center line thereof and by passing to the right of such center line where it enters the intersection and after entering the intersection the left turn shall be made so as to leave the intersection to the right of the center line of the roadway being entered. (c) Left turns on other than two-way roads - At any intersection where traffic is restricted to one direction on one or more of the roadways, the driver of a vehicle intending to turn left at any such intersection shall approach the intersection in the extreme left-hand lane lawfully available to traffic moving in the direction of travel of such vehicle and after entering the intersection the left turn shall be made so as to leave the intersection in the left-hand lane lawfully available to traffic moving in such direction upon the roadway being entered. SECTION 56. (a) Authority to place and obedience to turning markers - The city traffic engineer is authorized to place markers, buttons, or signs within or adjacent to intersections indicating the course to be traveled by vehicles turning at such intersections, and such course to be traveled as so indicated my conform to or be other than as prescribed by law or ordinance. -15- . . - . . , . . (b) When authorized markers, buttons, or other indica- tions are placed within an intersection indicating the course to be traveled by vehicles turning thereat, no driver of a vehicle shall disobey the directions of such indications. SECTION 57, Authority to place restricted turn signs - The city traffic engineer is hereby authorized to determine those intersections at which drivers of vehicles shall not make a right, left, or U turn, and shall place proper signs at such intersections. The making of such turns may be prohibited between certain hours of any day and permitted at other hours, in which event the same shall be plainly indicated on the signs or they may be removed when such turns are permitted. SECTION 58. Obedience to np_LIETIEialls - Whenever authorized signs are erected indicating that no right or left, or U turns is permitted, no driver of a vehicle shall disobey the directions of any such sign. SECTION 59. Limitations on turniis_around - The driver of any vehicle shall not turn such vehicle so as to proceed in the opposite direction upon any street in a business district, in the middle of any block, or at a signalized or controlled intersection. ARTICLE VII - ONE-WAY STREETS AND ALLEYS SECTION 60. Autt__larisyirgj. sn4:wa.yndalleys - Whenever any ordinance of this city designates any one-way street or alley the city 1.., traffic engineer shl place and maintain signs giving notice thereof, and no such regulation shall be effective unless such signs are in place. Signs indicating the direction of lawful traffic movement shall be placed at every intersection where movement of traffic in the opposite direction is prohibited. SECTION 61. 212eLllay__ treets and alleys - Upon those streets and parts of streets and in those alleys described in schedule I attached hereto and made a part hereof, vehicular traffic shall move only in the indicated direction when signs indicating the direction of traffic are erected and maintained at every intersection where movement in the opposite direction is prohibited. SECTION 61-1 (a) ALithoritrestrict direction of movement on streets during_certaineriods - The city traffic engineer is hereby authorized to determine and designate streets, parts of streets, or specific lanes thereon upon which vehicular traffic shall proceed in one direction during one period and the opposite direction during another period of the day and shall place and maintain appropriate markings, signs, barriers or other devices to give notice thereof. The city traffic engineer may erect signs temporarily designat- ing lanes to be used by traffic moving in a particular direction, regardless of the center line of the roadway. (b) It shall be unlawful for any person to operate any vehicle in violation of such markings, signs, barriers, or other devices so placed in accordance with this section, ARTICLE VIII - SPECIAL STOPS REQUIT!ED SECTION 62. Through streets desigrlateA - All streets and parts of streets properly dedictated and accepted by the City are hereby designated as through streets- -16- ' SECTION 63. Authority to erect stop signs - Whenever any ordinance of this city designates and describes a through street,the city traffic engineer may place and maintain a traffic control sign on each and every street intersecting such through street or intersecting that portion thereof described and designated as such by any ordinance of this city unless traffic at any such intersection is controlled at all times by traffic control signals provided, however, that at the intersection of two such through streets or at the intersection of a through street and a heavy traffic street not so designated, stop signs shall be erected at the approaches of either of said streets as may be determined by the city traffic engineer upon the basis of an engineering and traffic study. SECTION 64, Intersections where stop required - The city traffic engineer is hereby authorized to determine and designate intersections where particular hazard exists upon other than through streets and to determine whether vehicles shall stop at one or more entrances to any such stop inter- section, and shall erect a stop sign at every such place where a stop is required. SECTION 65. Signs to bear the word "Stop" - Every sign erected pursuant to this article shall bear the word "Stop". Every stop sign shall be located as near as practicable at the nearest line of the crosswalk on the near side of the intersection or, if none, at the nearest line of the roadway. All signs will conform to the Manual of Uniform Traffic Controls Devices,latest edition. SECTION 66. Vehicles to stop at stop signs - When stop signs are erected as herein authorized at or near the entrance to any intersection, every driver of a vehicle shall stop before entering the crosswalk on the near side of the intersection or in the event there is no crosswalk shall stop at a clearly marked stop line, but if none, then at the point nearest the intersecting roadway where the driver has a view of the approaching traffic on the intersecting roadway before entering the intersection except when directed to proceed by a police officer or traffic-control signal. SECTION 67. Emerging from alley, driveway, or building - The driver of a vehicle within a business or residence district emerging from an alley, driveway, or building shall stop such vehicle immediately prior to driving onto a sidewalk, yielding the right of way to any pedestrian as may be necessary to avoid a collision, and upon entering the roadway shall yield the right of way to all vehicles approaching on said roadway. SECTION 68. Stop when traffic obstructed - No driver shall enter an intersection or a marked crosswalk unless there is sufficient space on the other side of the intersection or crosswalk to accomodate the vehicle he is operating without obstructing the passage of other vehicles or pedestrians, notwithstanding any traffic-control signal indication to proceed. SECTION 69. (a) Obedience to signal indicating approach of railroad train - Whenever any person driving a vehicle approaches a railroad grade crossing under any of the circumstances stated in this section, the driver of such vehicle shall stop within 50 feet but not less than 15 feet from the nearest rail or such railroad, and shall not proceed until he can do so safely. The foregoing requirements shall apply when: (1) A clearly visible electric or mechanical signal device gives warning of the immediate approach of a railroad train; -17- • (2) A crossing gate is lowered or when a human flagman gives or continues to give a signal of the approach or passage of a railroad train; • (3) A. railroad train approaching within approxi- mately 1500 feet of the highway crossing emits a signal audible from such distance and such railroad train, by reason of its speed or nearness to such crossing, is an immediate hazard.;. (4) An approaching railroad train is plainly visible and is in hazardous proximity to such crossing. (b) No person shall drive any vehicle through, around, or under any_crosSing gate or barrier at a railroad grade crossing while such gate or barrier is closed or is being opened or closed. SECTION 69-1 (a) Overtaking and passing school bus - The driver of a vehicle upon a U. S. Highway, State Highway, or Farm to Market Road, when such Highways or Roads are within the corporate limits of the City of Wichita Falls, upon meeting or overtaking from either direction any school bus which has stopped on the highway for the purpose of receiving or discharging any school children shall. stop the vehicle inunediately before passing the school bus, but may then proceed past such school bus at a speed which is prudent, not exceeding ten (10) miles per hour, and with due caution for the safety of such children. (b) The driver of a vehicle upon a highway with separate roadways need not stop upon meeting or passing a school bus-which is on a different roadway or when upon a controlled-access highway and the school bus is stopped in a loading zone which is a part of, or adjacent to such highway and where pedestrians are not permitted to cross the roadway. ARTICLE IX - MISCELLANEOUS DRIVING RULES SECTION 70. Following fire apparatus prohibited - The driver of any vehicle other than one on official business shall not follow any fire apparatus traveling in response to:a fire alarm closer than 500 feet or drive into or park such vehicle within the block where a fire apparatus has stopped in answer to a fire alarm. SECTION 71. Crossing a fire hose - No vehicle shall be driven over any unprotected hose of a fire departent when laid down on any street, private driveway, or railroad track, to be used at any fire or alarm of fire. SECTION 72, Drivin. throu:h funeral or other mrocession - No driver of a vehicle shall drive tween the vehicles comprising a' funeral or other authorized procession while they are in motion and when such vehicles are conspicuously designated as required in this ordinance. This provision shall not apply at intersections where traffic is controlled by traffic-control signals or police officers. SECTION 73. Drivers in a procession - Each driver in a funeral or other procession shall driveas near to, the right-hand edge of the roadway as practical, and shall follow the vehicle ahead as close as is practical and safe, l8- SECTION 74. Funeral processions to be identified - A funeral composed of a procession of vehicles shall be identified as such by the dis- play of a pennant or by such other method as may be determined and designated by the traffic division. SECTION 75. When permits required for parades and processions - No procession, or parade excepting the forces of the United States Army or Navy, the military forces of this State,. and ..the forces of the police and fire department, shall occupy, march, or proceed along any street except in accordance with a permit issued by the traffic engineer and such other regulations as are set forth herein which may apply. SECTION 76. When permits required for house moving - Upon the issuance of said moving permit, the house mover shall cause notice to be given to the Traffic Engineer Department, telephone or light companies, Chief of Fire Department, or other's whose property may be effected by such removal. The house mover shall set forth in all notices the route that will be taken, time started, and approximate time of completion. SECTION 76-1 Vehicles shall not be driven on a sidewalk - The driver of such vehicle shall not drive within any sidewalk area except at a permanent or temporary driveway. SECTION 77. Limitations on backing - The driver of a vehicle shall not back the same unless such movement can be made with a reasonable safety and without interfering with other traffic, and in no instance for more than thirty (30) feet. SECTION 78. (a) Riding on motorcycles - A person operating a motor- cycle shall ride only upon the permanent and regular seat attached thereto, and such operator shall not carry any other person nor shall any other person ride on a motorcycle unless such motorcycle is designed to carry more than one person, in which event a passenger may ride upon the permanent and regular seat if designed for two persons, or upon another seat firmly attached to the rear or side of the operator. (b) No person shall ride any motorcycle or operate the same with his feet on the bars or one handed, or with one hand only, or with both feet on one side of his machine, or while standing on the saddle or seat of such machine or any part thereof. SECTION 79. Clingin to vehicles - No person riding upon any bicycle, coaster, roller skates, sled, or toy vehicle shall attach the same or himself to any vehicle.upon a roadway. SECTION 80. Controlled access - No person shall drive a vehicle onto or from any controlled-access roadway except at sueh entrancesand exits as are established by public authority. SECTION 81. Boarding or alighting from vehicles - No person shall board or alight from any vehicle while such vehicle is in motion. W' SECTION 81-1 Negligent Collision - No person driving or operating or in charge of any motor vehicle, shall, by negligence cause or suffer or permit the same to come in collision with any stationary vehicle of any nature what- ever or with any street sign, street post, water plug, mail box, or any other stationary obstacle or object whatever, in the alley, avenue, highway or other -19- public place whatever, in the City of Wichita Falls. Violation of this section shall be known as the offense of "negligent collision". For the purpose of this section, "stationary" is defined as unmoving, whether stopped, or placed temporarily or permanently. (b) Negligence for the purposes of this section shall not be ordinary negligence. Negligence for the purposes of this section is defined as the following cenduet: (I) Failure to keep proper lookout when such failure is so grossly flagrant as to cause, and be the sole cause of, a collision that results in injury to person or property. (2) Failure to make timely application of brakes when such failure is so grossly flagrant as to cause, and be the sole cause of, a collision that results in injury to person or property. (3) Failure to control direction of movement of the vehicle when such failure is so grossly flagrant as to cause, and be the sole cause of, a collision that results in injury to person or property. (c) "Sole cause" shall mean "only cause" except that proof of another or other negligent act or acts by a person charged with violation of this section, which act c r acts was or were contributing cause or causes of the collision, shall not be a defense and shall not be proof that the act complained of was not the sole cause. ARTICLE .X m RAILROAD SECTION 82. Railroad trains not to block streets - It shall: be un- lawful for the directing officer or the operator of any railroad train or trains to direct the operation of or to operate the same in such manner as to prevent the use ,sf any street for purposes of travel for a period of time longer than .5 minutes, except that this provision shall not apply to trains or cars in motion other than those engaged in switching. SECTION 83. SECTION 85. Driving. on railroad tracks prohibited, e- No person shall drive,any motor vehicle upon any railroad track or right of way within the corporate limits of the City of Wichita Falls, except at a lawfully designated crossing thereof. ARTICLE XI - PE'DESTRIA.N'°8 RIGHTS AND DUTIES SECTION 86. Pedestrian J s sr�b 'ect_ Cry.t rafontrol. signals - Pedestrians shall be subject to traffic-control signals as heretofore declared -20e in sections 44 and 45 of this ordinance, but at all other places pedestrians shall be granted those rights and be subject to the restrictions stated in this article. SECTION 87. (a) Pedestrian's right of way in crosswalks - When traffic-control signals are not in place or not in operation the driver of a vehicle shall yield the right-of-way, slowing down or stopping if need be to so yield, to a pedestrian crossing the roadway within a crosswalk when the pedestrian is upon the half of the roadway upon which the vehicle is traveling, or when the pedestrian is approaching so closely from the opposite half of the roadway as to be in danger. (b) No pedestrian shall suddenly leave a curb or other place of safety and walk or run into the path of a vehicle which is so close that it is impossible for the driver to yield. (c) Paragraph (a) shall not apply under conditions stated in paragraph (b) of this section. (d) Whenever any vehicle is stopped at a marked cross- walk or at any unmarked crosswalk at an intersection to permit a pedestrian to cross the roadway, the driver of any other vehicle approaching from the rear shall not overtake and pass such stopped vehicle. SECTION 88. Pedestrians to use right half of crosswalk - Pedestrians shall move, whenever practicable, upon the right half of crosswalks. SECTION 89. Crossing at right angles - No pedestrian shall cross a roadway at any place other than by a route at right angles to the curb or by the shortest route to the opposite curb except in a crosswalk. SECTION 90. (a) When pedestrians shall yield - Every pedestrian crossing a roadway at any point other than within a marked crosswalk or within an unmarked crosswalk at an intersection shall yield the right of way to all vehicles upon the roadway. (b) Any pedestrian crossing .a..roadWaj.:;:at a ,point r.where a._pedestrian tunnel or overhead pedestrian crossing has been provided shall yield the right of way to all vehicles upon the roadway. (c) The foregoing rules in this section have no appli- cation under the conditions stated in section 91 when pedestrians are prohibited from crossing at certain designated places. SECTION 91. Prohibited Crossings: Between adjacent intersections at which traffic-control signals are in operation, pedestrians shall not cross at any place except in a crosswalk. (b) No pedestrian shall cross a roadway other than in a crosswalk in any business district. (c) No pedestrian shall cross a roadway other than in a crosswalk upon any of the following named through streets: Kell Boulevard, Scott Avenue, East Scott Street, 5th Street Highway, Jacksboro Highway and access roads. -21- • ••, • SECTION 92. Obedinnce of pedestrians to railroad signals - No pedestrian shall pass through, around, over, or under any crossing gate or barrier at a railroad grade crossing while such gate or barrier is closed or is being closed or opened, or while any other signal prohibiting crossing, • or in the event a brakeman is used, while such brakeman has indicated that there shall be no crossing. SECTION 93. (a) Pedestrians-wall - Where sidewalks are provided it shall be unlawful for any pedestrian to walk along and Upon adjacent roadway. (b) Where)sidewalks 'are not provided any pedestrian walking along and upon a highway shall walk only on the left side of the roadway or its shoulder facing traffic which may approach from the opposite direction. SECTION 93-1 (a) Pedestrian solicitin: rides or business - No person shall stand in a roadway for the purpose of soliciting a ride, employment-, or business from the occupant of any vehicle. (b) No person shall stand on or in the proximity to a street or highway for the purpose of soliciting the watching or guarding of any vehicle while parked or about to be parked on a street or highway. SECTION 94. Drivers to exercise due care - Notwithstanding the fore- going provisions of this article every driver of a vehicle shall exercise due care to avoid colliding with any pedestrian upon any roadway and shall give warning by sounding the horn when necessary and shall exercise proper pre- caution upon Observing any child or any confused or incapacitated person upon . a roadway. ARTICLE XII - REGULATIONS FOR BICYCLES SECTION 95. (a) Effect of regulations - It is a misdemeanor for any person to do any act forbidden or fail to perform any act required in this article. (b) The parent of any child and the guardian of any ward shall not authorize or knowingly permit any such Child or ward to violate any of the provisions of this article. ':, (c) These regulations applicable to bicycles shall apply whenever a bicycle is operated upon any street up upon any public path set aside for the exclusive use of bicycles, subject to those exceptions stated herein. SECTION 96. Traffic laws to apply to, persons ' iding bicycles - Every person riding a bicycle upon a roadway shall be granted -all of the tights and shall be subject to all of the duties applicable to the driver of a vehicle by the laws of this State declaring rules of the road applicable to vehicles or by the traffic ordinances of this city applicable to the driver of a vehicle, except as to special regulations in this article and except as to those provisions of laws and ordinances'which by their nature can have no application. SECTION 97. (a) Prohibiting the use of Kell Boulevard from Holliday Road to Kemp Boulevard in Wichita Falls, Texas by pedestrians and/or cyclists, That the use of Kell Boulevard from Holliday Road to Kemp Boulevard, in -22- S . Wichita Falls, Texas, by pedestrians is hereby prohibited. (a) That the use of Kell Boulevard from Holliday Road to Kemp Boulevard in Wichita Falls, Texas, by any person, or persons, on a • bicycle, or any other vehicle propelled by the rider is hereby prohibited. SECTION 98. Obedience to traffic-control devices - Any person operating a bicycle shall obey the instructions of official traffic-control signals, signs, and other control devices applicable to vehicles, unless otherwise directed by a police officer. SECTION 99 . (a) Riding on bicycles - A person propelling a bicycle shall not ride other than astride a permanent and regular seat attached thereto. (b) No bicycle shall be used to carry more persons at one time than the number for which it is designed or equipped. SECTION 100 (a) Riding on roadways and bicycle paths - Every person operating a bicycle upon a roadway shall ride as near to the right hand side of the roadway as practicable, exercising due care when passing a standing vehicle or one proceeding in the same direction, (b) Persons riding bicycles upon a roadway shall not ride more than two abreast except on paths or parts of roadways set aside for the exclusive use of bicycles. • (c) Whenever a usable path for bicycles has been provided adjacent to a roadway, bicycle riders shall use such path and shall not use the roadway. SECTION 101 Speed - No person shall operate a bicycle at a speed greater than is reasonable and prudent under the conditions then existing. SECTION 102 Emerging from alley or driveway - The operator of a bicycle emerging from an alley, driveway or building, shall upon approaching a sidewalk or the sidewalk area extending across any alleyway, yield the right- of-way to all pedestrians approaching on said sidewalk or sidewalk area, and upon entering the roadway shall yield the right of way to all vehicles approaching on said roadway. SECTION 103 Clinging to vehicles - No person riding upon any bicycle shall attach the same or himself to any vehicle upon a roadway. SECTION 104 Carrying articles - No person operating a bicycle shall carry any package, bundle, or article which prevents the rider from keeping at least one hand upon the handle bars. SECTION 105 Parking - No person shall park a bicycle upon a street other than upon the roadway against the curb or upon the sidewalk in a rack to support the bicycle or against a building or at the curb, in such manner as to afford the least obstruction to pedestrian traffic. SECTION 106 Ridin: on sidewalks - No person shall ride a bicycle upon a sidewalk within a business district. SECTION 107 (a) Lamps and otntailizEtaLsaLia - Every bicycle when in use at night time shall be equipped with a lamp on the front -23- • • A 5 which shall emit a white light that is visible fora distance of at least 500 feet to the front and with .a red reflect,..r on the rear of a type which shall be visible from all distances. from '50 feet to 300 feet to the rear when directly. in front of lawful upper beams of headlamps on•a motor vehicle. A lamp emitting a red light visible from a .distanc.e of 500 feet to the rear may be used in addition to the red reflector. (b) ; Every, bicycle shall. be'equipped with a. brake which will enable the operator to make the braked wheel skid on dry, level, clean pavement. SECTION 108 Penalties Every person convicted of a violation of any provision of this article shall be punished by a fine of not more than One Hundred ($100) Dollars. ARTICLE 'KIII ;- ANGLE PARKING SECTION 109 Standing or parking close to curb - No person shall stand or park a vehicle in a roadway other than parallel with the edge of the roadway headed in the direction of lawful traffic movement and with the wheels of the vehicle within eighteen (18) inches of the curb or edge of the roadway except as otherwise provided in this article. SECTION 110 (a) Signs or markings indicating angle parking - The city traffic engineer shall determine upon what streets angle parking shall be permitted and shall mark or sign such streets but such angle parking shall not be indicated upon any Federal-aid or State highway within this city unless the State 'Highway. Commission has determined by resolution or order entered into its minutes that the 'roadway is of sufficient width to permit angle parking without interfering with the free, movement of traffic. (b) Angle parking shall not be indicated or permitted at any place where •passing traffic would thereby be caused or required to drive upon the left side of the street. SECTION 111 Obedience to anglewpa'.rking signs or markings Upon those streets which have been signed or marked by the city traffic engineer for angle parking, no person shall park or stand a vehicle other than at the angle to the curb or edge of the 'roadway indicated by such signs or markings. SECTION 112 (a) Permit for loading or u�nloding _at an angle to the curb m The city.'traffic engineer is authorized to issue special permits for unloading merchandise or materials subject to the terms and conditions of such permit. Such permits may be issued either to the owner or lessee of real property or to the owner of the vehicle and shall grant to such person the privilege as therein stated and authorized herein. (b) It shall be unlawful for any permittee or other' person to violate any of the special terms or conditions of any such permit. SECTION '113 (a) Lights on parked vehicles - Whenever a vehicle is lawfully parked at night time upon any street within a business or residence district 'no lights :need be displayed upon such parked., vehicle. -24- , . (b) Whenever a vehicle is parked upon a street or highway outside of a business or residence district during the hours between one-half hour after sunset and one-half hour before sunrise, such vehicle shall be equipped with one or more lamps which shall exhibit a white light - on the roadway side visible from a distance of 500 feet to the front of the vehicle and a red light visible from a distance of 500 feet to the rear. (c) Any lighted headlamps upon a parked vehicle shall be depressed or dimmed. ARTICLE XIV - STOPPING, STANDING, OR PARKING PROHIBITED IN SPECIFIED PLACES SECTION 114 (a) Stopping, stand required - No person shall stop, stand, or park a vehicle, except when necessary to avoid conflict with other traffic or in compliance with law or the directions of a police officer or traffic-control device, in any of the following places; (1) On a sidewalk (2) In front of a public or private driveway (3) Within an intersection (4) Within 15 feet of a fire hydrant (5) On a crosswalk (6) Within 20 feet of a crosswalk at an intersection. (7) Within 30 feet upon the approach to any flashing beacon, stop sign, or traffic-control signal located at the side of a roadway. (8) Within 50 feet of the nearest rail of a railroad crossing, (9) Within 20 feet of a driveway entrance to any fire station and on the side of a street opposite the entrance to any fire station within 75 feet of said entrance when properly sign posted. (10) Alongside or opposite any street excavation or obstruction when stopping, standing, or parking would obstruct traffic. (11) On the roadway side of any vehicle stopped or parked at the edge or curb of a street. (12) Upon any bridge or other elevated structure upon a highway or within a highway tunnel (13) At any place between a sidewalk and the curb or edge of the roadway. (14) In any fire lane designated in compliance with Section 119-1 (15) On the roadway side of any vehicle stopped or parked at the edge or curb of a roadway or street. (16) Within an intersection. (17) On a crosswalk'. (b) No person shall move a vehicle not lawfully under his control into any such prohibited area or away from a curb such distance -25- ■ as is unlawful. (c) When signs are erected giving notice thereof, no person shall park a vehicle at any time upon any of the streets designated in schedule II attached to and made a part of this ordinance. (d) When signs are erected in each block giving notice thereof, no person shall park a vehicle between the hours specified in scheduleIII of any day except Sundays and public holidays within the district or, upon any of the streets described in said schedule III attached to and made a part of this ordinance. SECTION 115 Parking not to obstruct traffic - No person shall park any vehicle upon a street, or alley in such a manner or under such conditions as to leave available less than 10 feet of the width of the roadway for free movement of vehicular traffic. SECTION 116 Parking in alleys - No person shall park a vehicle within an alley in such a manner or under such conditions as to leave available less than 10 feet of the width of the roadway for the free movement of vehicular traffic, and no person shall stop, stand, or park a vehicle within an alley in such position as to block the driveway entrance to any abutting property. SECTION 116-1 Parking in alleys prohibited - All vehicles are prohibited from parking in any alley within the city except for the purpose of loading and/or unloading merchandise. SECTION 117 Parking for certain purposes prohibited - No person shall park a vehicle upon any roadway for the principal purpose of: (1) Displaying such vehicle for sale (2) Washing, greasing or repairing such vehicle except repairs necessitated by an emergency. SECTION 118 (a) Parking adjacent to schools - The city traffic engineer is hereby authorized to erect signs indicating no parking upon either or both sides of any street adjacent to any school property when such parking would, in his opinion, interfere with traffic or create a hazardous situation. (b) When official signs are erected indicating no parking upon either side of a street adjacent to any school property as authorized herein, no person shall park a vehicle in any such designated place. SECTION 119. Parking - The city traffic engineer is hereby authorized to erect signs indicating no parking upon any street when the width of the roadway does not exceed 20 feet, or upon one side of the street as indicated by such signs when the width of the roadway does not exceed, 30 feet. SECTION 119-1 Designation of fire lanes - The city traffic engineer is hereby authorized to erect signs indicating no parking on either or both sides of any street when a need has been determined by the city traffic commission in conjunction with the fire chief and the city traffic engineer that such street be designated a fire lane. All fire lanes that have hereto- fore been designated and signs erected indicating no parking in accordance with that designation are hereby approved. (Note: See Sections 114 (a) (14) -26- and 149 (a) (5).). ARTICLE XV - LOADING ZONES SECTION 120 Definitions - As used herein the following definitions are given: (a) A loading zone is defined as a space in front of a business location to be used for the purpose of loading and unloading merchandise by the owner of the business adjacent thereto, and may be used • by any carrier for the purpose of loading or unloading merchandise to be delivered or shipped froth such location. (b) An alley entrance is defined as a building that abutts on or has an entrance to a public alley, that provides access to a street or other throughfare for vehicles used in handling and loading and unloading merchandise. (c) Space as used herein is defined as an area of twenty-one (21) feet parallel to the curb or in the event that the space is in an area where angle parking is permitted, the same shall be eleven (11) feet parallel to the curb. SECTION 121 City traffic engineer to designate curb loading zones- The city traffic engineer is hereby authorized to determine the location of passenger and freight curb loading zones and shall place and maintain appropriate signs indicating the same and stating the hours during which the provisions of this section are applicable. SECTION 122 Restriction as to use - No vehicles other than those used in loading and unloading of merchandise and in the transportation thereof shall be parked in any leading zone. s SECTION 123 (a) Allocation of loading zones - Loading zones shall be allocated by the city traffic. engineer. (b) The city traffic engineer shall arrange for the marking of all loading zones provided for under this article. SECTION 124 Standing in passenger curb loading tones - No person shall stop, stand, or park, a vehicle for any purpose or period of time other than for the expeditious loading or unloading of passengers in any place as a passenger curb loading zone during hours when the regulations applicable to such curb loading zones are effective, and then only for a period not to exceed three minutes. SECTION 125 Standin: in frei.ht curb loadin: zone - No person shall stop, stand, or park a vehicle for any purpose or length of time other than for the expeditious unloading and delivery or pick-up and loading of materials in any place marked as a freight curb loading zone during hours when the provisions applicable to such zones are in effect. In no case shall the stop for loading and unloading of materials exceed thirty minutes. SECTION 126 The cit traffic en:ineer to desi:nate *ublic carrier stops and stands, - The city traffic engineer is hereby authorized and required to establish bus stops, bus stands, taxicab stands, and stands for other passenger common-carrier motor vehicles on such public streets in such places -27- and in such number as he shall determine to be of the greatest benefit and convenience to the public, and every bus stop, bus stand, taxicab stand, or other stands shall be designated by appropriate signs. SECTION 127 (a) Sto. .inL . standin: and •arkin: of buses and taxicabs regulated - The operator of a bus shall not stand or park such vehicles upon any street at any place other than at a bus stand so designated as provided herein. (b) The operator of a bus shall not stop such vehicle upon any street at any place, for the purpose of loading or unloading passengers or their baggage other than at a bus stop, bus stand, or passenger loading zone so designated as provided herein, except in case of an emergency. (c) The operator of a bus shall enter a bus stop, bug stand, or passenger loading zone on a public street in such a manner that the bus when stopped to load or unload passengers or baggage shall be in a position with the right front wheel of such vehicle not further than 18 inches from the curb and the bus approximately parallel to the curb so as not to unduly impede the movement of other vehicular traffic. (d) The operator of a taxicab shall not stand or park such vehicle upon any street at any other place other than in a taxicab stand so designated as provided herein. This provision shall not prevent the operator of a taxicab from temporarily stopping in accordance with other stopping or parking regulations at any place for the purpose of and while actually engaged in the expeditious loading or unloading of passengers. SECTION 128 Restricted use of bus and taxicab stands No person shall atop, stand, or park a vehicle other than a bus in a bus stop, or other than a taxicab in a taxicab stand when any such,stop or stand has been officially designated and appropriately signed, except that the driver of a passenger vehicle may temporarily stop therein for the purpose of and while actually engaged in loading and unloading passengers when such stopping does not interfere with any bus or taxicab waiting to enter or about to enter such zone, ARTICLE XVI - REGULATING THE KINDS AND CLASSES OF TRAFFIC ON CERTAIN HIGHWAYS SECTION 129 Load restrictions upon vehicles using certain streets- When signs are erected giving notice thereof, no person shall operate any vehicle with a gross weight in excess of the amounts specified in schedule IV at any time upon any of the streets or parts of streets described in said schedule IV, attached to and made a part of this ordinance. SECTION 130 Commercial vehicles prohibited from using certain s treets - When signs are erected giving notice thereof, no person shall operate any commercial vehicle exceeding 17,000 pounds gross weight at any time upon any o the streets or parts of streets described in schedule V attached to and made a part of this ordinance except that such vehicles may be operated thereon for the purpose of entering such street at the inter- section nearest the destination of the vehicle and proceeding thereon no further than the nearest intersection thereafter. SECTION 131 (a) The city traffic engineer is hereby authorized to determine and designate those heavily traveled streets upon which shall be -28- prohibited the use of the roadway by motor-driven cycles, bicycles, horse drawn vehicles or other non-notorized traffic and shall erect appropriate signs giving notice thereof. (b) When signs are so erected giving notice thereof, no person shall disobey the restrictions stated on such signs. ARTICLE XVII - TRAFFIC VIOLATIONS BUREAU SECTION 132 (a) Traffic violations bureau created - The chief of police shall establish a traffic violations bureau to assist the court with the clerical work of traffic cases. The bureau shall be in charge of such person or persons and shall be open at such hours as the chief of police may designate. (b) The judge who hears traffic cases shall designate the specified offenses under the traffic ordinances of this city and the State traffic laws in respect to which payments of fines may be accepted by the traffic violations bureau in satisfaction thereof, and shall specify by suitable schedules the amount of such fines for first, second, and subsequent offenses, provided such fines are within the limits declared by law or ordinance, and shall further specify what number of such offenses shall require appearance before the corporation court. SECTION 133. (a) When person charged may elect to appear at bureau or before corporation court - Any person charged with an offense for which payment of a fine may be made to the traffic violations bureau shall have the option of paying such fine within the time specified in the notice of arrest at the traffic violations bureau upon entering a plea of guilty and upon waiving appearance in court; or may have the option of depositing required lawful bail and upon a plea of not guilty shall be entitled to a trial as authorized by law, (b) The payment of a fine to the bureau shall be deemed an acknowledgement of conviction of the alleged offense, and the bureau, upon accepting the prescribed fine, shall issue a receipt to the violator acknowledging payment thereof. SECTION 134 Duties of traffic violations bureau - The following duties are hereby imposed upon the traffic violations bureau in reference to traffic offenses: (l) It shall accept designated fines, issue receipts, and represent in court such violators as are permitted and desire to plead guilty, waive court appearance, and give power of attorney. (2) It shall receive and issue receipts for cash bail from the persons who must or wish to be heard in court, enter the time of their appearance on the court docket, and notify the arresting officer and witnesses, if any, to be present. (3) It shall keep an easily accessible record,of all violations of which each person has been guilty during the preceding 12 months, whether such guilt was established in court or in the traffic violations bureau. SECTION 135 Traffic violations bureau to keep records - The traffic violations bureau shall keep records and submit summarized monthly reports to -29- •♦ as i The City Clerk of all notices issued and arrests made for violations of the traffic laws and ordinances in this city and of all the fines collected by the traffic violations bureau or the court, and of the final disposition or present status of every case of violation of the provisions of said laws and ordinances. Such records shall be so maintained as to show all types of violations and the totals of each. Said records shall be public records. SECTION 136. Additional duties of traffic violations bureau - The traffic violations bureau shall follow such procedure as may be prescribed by the traffic ordinances of this city or as may be required by any laws of this state. ARTICLE XVIII - ,PENALTIES AND PROCEDURE ON ARREST SECTION 137 Penalties - Unless another penalty is expressly provided by law, every person convicted of a violation of any provision of this ordinance shall be punished by a fine of not more that Two Hundred ($200) Dollars. SECTION.138 (a) Forms and records of traffic citations and arrests - The city clerk shall provide books to include traffic citation forms for notifying alleged violators to appear and answer to charges of violating traffic laws and ordinances in the corporation court of this city. Said books shall include serially numbered sets of citations in quadruplicate in the form prescribed and approved jointly by the judge of the corporation court and the chief of police. (b) The city clerk shall issue such books to the chief of police or his duly authorized agent and shall maintain a record of every book so issued and shall require a written receipt for every such book. (c) The chief of police shall be responsible for the issuance of such books to individual members of the police department. The chief of police shall require a written receipt for every book so issued and shall maintain a record of every such book and each set of citations contained therein. SECTION 139 (a) Procedure of police officers - Except when, authorized or directed under State law to iuuuediately take a person before a judge for the violation of any traffic laws, a police officer who halts a person for such violation other than for the purpose of giving him a warning or warning notice and does not take such person into custody under arrest, shall take the name, address, and operator's license number of said person, the registered number of the motor vehicle involved, and such other pertinent information as may be necessary, and shall issue to him in writing on a form provided by the city clerk a traffic citation containing a notice to answer to the charge against him in the corporation court of this city at a time at least five days after such alleged violations to be specified in said citation. The officer, upon receiving a written promise of the alleged violator to answer as specified in the citation, shall release such person from custody. SECTION'140 False name and/or address - It shall hereafter be unlawful for any person, upon being arrested by a police officer of the City of Wichita Falls for a violation of this chapter, to give such arresting officer, as his name, any other than his true and correct name. It shall hereafter be unlawful for any person, upon being arrested by a police officer of the City of Wichita Falls for a violation of this chapter, to give such arresting officer, as his address, any other than his true and correct address. -30- • SECTION 141 (a) Disposition and records of traffic citations, warrants, and complaints - Every police officer upon issuing a traffic citation to an alleged violator of any provision of the motor vehicle laws of this State or of any traffic ordinance of this city shall deposit the original and a duplicate copy of the original to be delivered to the corporation court of this city and said duplicate copy to the central records section of the police department. The second duplicate copy of the citation book and shall be delivered by such superior officer to the city clerk together with such bo.k when all traffic citations therein have been used. (b) Upon the filing of such original citation in the corporation court of this city as aforesaid or by other official action by a judge of said court, including forfeiture of bail or by payment of a fine to the traffic violations bureau of said court. (c) The chief of police shall require the return to him of each traffic citation and all copies thereof, exdept that copy required to be retained in the book as provided herein, which has been spoiled or upon which any entry has been made and has not been issued to an alleged violator. (d) The chief of police shall also maintain or cause to be maintained in connection with every traffic citation issued by a member of the police department a record of the disposition of the charge by the corporation court of this city or its traffic violations bureau. (e) The chief of police shall also maintain or cause to be maintained a record of all warrants issued by the corporation court of this city or by any other court on said traffic violation charges and which are delivered to the police department for service, and of the final dis- position of all such warrants. (f) It shall be unlawful and official misconduct for any member of the police department or other officer or public employee to dispose of, alter, or deface a traffic citation on any copy thereof, or the record of the issuance or disposition of any traffic citation, complaint, or warrant, in a manner other than as required in this article. SECTION 142 Illegal cancellation of traffic citations - It shall be unlawful for any person to cancel or solicit the cancellation of any traffic citation in any manner other than as provided by this article. SECTION 142-1 (a) Audit of records and reports - Every record of traffic citations, complaints thereon, and warrants issued therefor required in this article shall be audited at least annually by the city auditing firm who shall submit a report of such audit together with a summary thereof to the mayor and city council. Such reports shall be public records. (b) For the purpose of this article, the city clerk or his duly authorized representative shall have access at all times to all necessary records, files, and papers of the corporation court of this city, its traffic violations bureau, and the police department. SECTION 142-2 When .a copy of citation shall be deemed a lawful complaint - In the event the form of citation provided under section,143 includes information and is sworn to as required under the general laws of -31- • z • this State in respect to a complaint charging commission of the offense alleged in said citation to have been committed, then such citation when filed with a court having jurisdiction shall be deemed to be a lawful complaint for the purpose of prosecution under this ordinance. SECTION 143 Failure to obey citation - It shall be unlawful for any person to violate his written promise to appear given to an officer upon the issuance of a traffic citation regardless of the disposition of the charge for which such citation was originally issued. SECTION 144 Citation on illegally parked vehicle - Whenever any motor vehicle without driver is found parked or stopped in violation of any of the restrictions imposed by ordinance of this city or by state law, the officer finding such vehicle shall take its registration number and may take. any other information displayed on the vehicle which may identify its user, and shall conspicuously affix to such vehicle a traffic citation, of a form` provided by the city clerk, for the driver to answer to the charge against him within ten (10) days during the hours and at a place specified in the citation. SECTION 145 Failure to comply with traffic citation attached to parked vehicle - If a violator of the restrictions on stopping, standing, or parking in response to a traffic citation affixed to such motor vehicle within. a period of ten (10) days the clerk of the corporation court shall send the owner of the motor vehicle to which the traffic citation was affixed a letter informing him of the violation and warning him that, in the event such letter is disregarded for a period of ten (10) days a warrant of arrest will be issued. SECTION 146 (a) Presumption in reference to illegal parking - In any prosecution charging a violation of any law or regulation governing the standing or parking of a. vehicle proof that the particular vehicle described in the complaint was parked in violation of any such law or regulation, to- gether with proof that the defendent named in the complaint was at the time of such parking the registered owner of such vehicle, shall constitute in evidence a prima facie presumption that the registered owner of such vehicle was the person who parked or placed such vehicle at the point where, and for the time during which, such violation occurred. (b) The foregoing stated presumption shall apply only when the procedure as prescribed in sections 144 and 145 has been followed. SECTION 147 When warrant to be issued - In the event any person fails to comply with a traffic citation given to such person or attached to a vehicle or fails to make appearance pursuant to a summons directing an appearance in the corporation court, or if any person fails or refuses to deposit bail as required and within the time permitted by ordinance, the. clerk of the corporation court shall secure and issue a warrant for his arrest. SECTION 147-1 (a) Record of traffic cases - report of convictions to States Department of Motor Vehicles - Every magistrate or judge of a court shall keep or cause to be kept a record of every traffic complaint, traffic citation, or other legal form of traffic charge deposited with or presented to said court or its traffic violations bureau, and shall keep a record of every official action by said court or its traffic violations bureau in reference thereto, including but not limited to a record of every conviction, forfeiture of bail, judgement of acquittal, and the amount of fine or forfriture resulting from every said traffic complaint or citation deposited with or presented to said, court or traffic violations bureau. -32- (b) Within 10 days after the conviction or forfeiture of bail of a person upon a charge of violating any provision of this ordinance or other law regulating the operation of vehicles on highways every said magistrate of the court or clerk of the court of record in which such con- - victions was had or bail was forfeited shall prepare and immediately forward to said State department of motor vehicles an abstract of the record of said court covering the casein which said person was so convicted or forfeited bail, which abstract must be certified by the person so required to prepare the same to be true and correct. Report need not be made of any conviction involving the illegal parking or standing of a vehicle. (c) Said abstract must be made upon a form furnished by said State Department of motor vehicles and shall include the name and address of the part charged, the number, if any, of his operator's or chauffeur's license, the registration number of the vehicle involved, the nature of the offense, the date of hearing, the plea, the judgement, or whether bail forfeited and the amount of fine or forfeiture as the case may be. (d) Every court of record shall also forward ,a like report to said State Department of motor vehicles upon the conviction of any person of manslaughter or other felony in the commission of which a vehicle was used. (e) The failure, refusal, or neglect of any such judicial officer to comply with any of the requirements of this section shall constitute misconduct in office and shall be ground for removal therefrom. SECTION 148 :Disposition of traffic fines and forfeitures - All fines or forfeitures collected upon conviction or upon the forfeiture of bail of any person charged with a violation of any of the provisions of this ordinance shall be paid into the city treasury and deposited in the general fund. SECTION 149 (a) Authority to impound vehicles - Members of the police department are hereby authorized to remove a vehicle from'a street or highway to the nearest garage or other place of safety, or to a garage desig- nated or maintained by the police department, or otherwise maintained by this city under the circumstances hereinafter enumerated. (1) When any vehicle is left unattended upon any bridge, viaduct, or causeway, or in any tube or tunnel where such vehicle constitutes an obstruction to traffic. ` (2) When a vehicle upon a highway is so disabled as to constitute an obstruction to traffic and the person or persons in charge of the vehicle are by reason of physical injury incapacitated to such an extent as to be unable to provide for its custody or removal. (3) When any vehicle is left unattended upnn a street and is so parked illegally as to constitute a definite hazard or obstruction to the normal movement of traffic. (4) All vehicles left in one place in a street or alley for 36 hours. (5) When any vehicle is left unattanded in a properly designated fire lane or fire zone which is marked by signs designat- ing same as a fire lane or fire zone. -33- (b) Whenever an officer removes a vehicle from a street as authorized in this section and the officer knows or is able to ascertain from the registration records in the vehicle the name and address of the owner thereof, such officer shall immediately give or cause to be given notice in writing to such owner of the fact of such removal and the reasons therefor and of the place to which such vehicle has been removed. In the event any such vehicle is stored in a public garage, a copy of such notice shall be given to the proprietor of such garage. (c) Whenever an officer removes a vehicle from a street under this section and does not know and is not able to ascertain the name of the owner, or for any other reason is unable to give the notice to the owner as hereinbefore provided, and in the event the vehicle is not returned to the owner within a period of three (3) days, then and in that event the officer shall imme- diately send or cause to be sent written report of such removal by mail to the Department of the State whose duty it is to register motor vehicles, and shall file a copy of such notice with the proprietor of any public garage in which the vehicle may be stored. Such notice shall include a complete description of the vehicle, the date, time, and place from which removed, the reasons for such re- moval, the name of the garage or place where the vehicle is stored. ARTICLE XIX - EFFECT OF AND SHORT TITLE OF ORDINANCE SECTION 150 Effect of ordinance - If any part or parts of this ordinance are for any reason held to be invalid, such decision shall not effect` the validity of the remaining portions of this ordinance. SECTION 151 Repeal - All ordinances or parts of ordinances in conflict with or inconsistant with the provisions of this ordinance are hereby repealed, except that this repeal shall not affect or prevent the prosecution or punish- ment of any person for any act done or committed in violation of any ordinance hereby repealed prior to the taking effect of this ordinance. SECTION 152 Publication of Ordinance The city clerk shall certify to the passage of this ordinance and cause the same to be published in the Wichita Falls Records News one time. SECTION 153 Short title - This ordinance may be known and citied as the Traffic Ordinance, SECTION 154 Effective date - This ordinance shall take effect from and after thirty (30) days after passage thereof. Parking meter zones - (a) Parking meter zones are hereby established within the district or upon those streets or parts of streets described in Schedule VI attached to and made a part of this ordinance in which zones the parking of vehicles upon streets shall be regulated by parking meters between the hours specified in said Schedule VI of any day except Sundays and public holidays. (b) The city traffic engineer is hereby authorized, subkect to the approval of the city council by amendment of said Schedule IX, to establish parking meter zones at other locations upnn those streets or parts of streets where it is determined upon the basis of an engineering and traffic investigation that the installation of parking meters shall be necessary to aid in the regulation., control, and inspection of the parking of vehicles. SECTION 161. Installation of parking meters - (a) The city traffic engineer shall install parking meters in the parking meter zones established as provided in this ordinance upon the curb immediately adjacent to each designated parking space. Said meters shall be capable of being<operated, either automatically or mechanically, upon the deposit therein of a five or ten cent coin of United States currency, for the full period of time for which parking is lawfully permitted in any such parking meter zone. (b) Each parking meter shall be so designated, constructed, installed, and set that upon the expiration of the time period registered by the deposit of one or more coins, as provided herein, it will indicate by an appropriate signal that the lawful parking meter period has expired, and during said period of time and prior to the expiration thereof, will indicate the interval of time which remains of such period. (c) Each parking meter shall bear thereon a legend indicating the days and hours when the requirement to deposit coins therein shall apply, the value of the coins to be deposited, and the limited period of time for which parking is lawfully permitted in the parking meter zone in which such meter is located. SECTION 162. Parking meter spaces - (a) The city traffic engineer shall designate the parking space adjacent to each parking meter for which such meter is to be used by appropriate markings upon the curb and/or pavement of the street. Parking meter spaces so designated shall be of appropriate length and width so as to be accessible from the traffic lanes of such street. (b) No person shall park a vehicle in any such designated parking meter space during the restricted and regulated time applicable to the parking meter zone in which such meter is located so that any part of such vehicle occupies more than one space or protrudes beyond the markings designating such space, except that a vehicle which is of a size too large to be parked within a single designated parking -40- meter zone shall be permitted to occupy two adjoining parking meter spaces when coins shall have been deposited in the parking meter for each space so occupied as is required in this ordinance for the parking of other vehicles in such space. SECTION 163. Deposit of coins and time limits - (a) No person shall park a vehicle in any parking space upon a street along side of and next to which a parking meter has been installed during the restricted and regulated time applicable to the parking meter zone in which such meter is located unless a coin or coins of United States currency of the appropriate denomination as provided in this ordinance shall have been deposited therein, or shall have been previously deposited therein for an unexpired interval of time, and said meter has been placed in operation. (b) No person shall permit a vehicle within his control to be parked in .any such parking meter space during the restricted and regulated time applicable to the parking meter zone in which such meter is located while the parking meter for such space indicates by signal that the lawful parking time in such space has expired. This. provision shall not apply to the act of parking or the necessary time which is required to deposit immediately thereafter a coin or coins in such meter. (c) No person shall park a vehicle in any such parking meter space for a consecutive period of time longer than that limited . period of time for which parking is lawfully permitted in the parking. meter zone in which such meter is located, irrespective of the number or amounts of the coins deposited in such meter. (d) The provisions of this section shall not relieve any person from duty to observe other and more restrictive provisions of this ordinance and the State Vehicle Code prohibiting or limiting the stopping, standing, or parking of vehicles in specified places or at specified times. SECTION 164. Use of slugs prohibited. No person shall deposit or attempt to deposit in any parking meter any slug, button, or any other device or substance as substitutes for coins of United States currency. SECTION 165. Tampering with meter. No person shall deface, injure, tamper with, open, or willfully break, destroy, or impair the usefulness of any parking meter. SECTION 166. Application of proceeds. The coins deposited in parking meters shall be collected by the duly authorized agents of the city and shall be deposited by him in the City Depository. Schedule VI SECTION 167. Parking meter zones.
