AN ORDINANCE AUTHORIZING THE TRAFFIC ENGINEERING
DEPARTMENT TO ESTABLISH OFF-STREET PARKING FACIL-
ITIES AND CURB CUTS ON ALL NEW CONSTRUCTION;
ESTABLISHING A COMMITTEE OF APPEALS FOR DECISIONS
OF THE TRAFFIC ENGINEERING DEPARTMENT AND PROVIDING
FOR EN`EO':CE.MENT OF ALL DECISIONS,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN
OF THE CITY OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. Any person, firm, partnership or corporation
desiring a building permit on any property within the corporate
limits of the City of Wichita Falls, Texas, for construction of
any building other than a single-family residence shall submit
to the Building Inspector a plot plan designating the number of
off-street parking spaces to be provided.
SECTION' 2 . The plot plan shall be submitted to the Traffic
Engineering Department by the Building Inspector and the Traffic
Engineering Department shall approve or disapprove the off-street
parking facilities designated on the plot plan. and shall establish
curb cuts to serve the property.
SECTION 3, If the applicant is dissatisfied with the decision
of the Traffic Engineering Department, he may appeal such decision
to a committee composed of three members of the Traffic Commission
and three members of the Planning Board, to be appointed by the
Chairmen of the Traffic Commission and the Planning Board.
SECTION 4. This committee shall be known as the Off-Street
Parking Committee of Appeals and shall meet upon request of an
applicant, hear all evidence submitted by the applicant and the
Traffic Engineering Department, and shall make a decision as to
whether or not the decision of the Traffic Engineering Department
was reasonable and proper. If the committee finds that such decision
was not reasonable and proper, the committee shall establish reason-
able and proper off-street parking and curb cut requirements, and
such decision shall be final.
SECTION 5. If the applicant shall refuse to obey the final
decision of the Traffic Engineering Department or the Committee the
Building Inspector shall refuse to issue said applicant a building
permit.
SECTION 6. This ordinance shall take effect from and after
thirty (30) days after passage thereof.
