Ord 2181 9/13/1965 r ORDINANCE NO. ORDINANCE ACCEPTING IMPROVEMENTS ON PIERCE STREET FROM U.S. HIGHWAY NO, 82 AND 277 (FIFTH STREET) TO AND INCLUDING TENTH ST'.ET AND KEMP BOULEVARD INTERSECTION IN THE CITY OF WICHITA FALLS, TEXAS; DECLARING THE CONTRACT WITH J, F. FOSTER AND SONS CONSTRUCTION COMPANY FOR THE CONSTRUCTION OF SAID -IMPROVE- MENTS FULLY COMPLETED AND PERFORMED; DIRECTING, THE ISSUANC ', EXECUTION, AND !DELIVERY OF CERTIFICATES IN EVIDENCE OF SPECIAL ASSESSMENTS LEVIED AFTER GIVING EFFECT TO SUNDRY CREDITS HERE- IN AUTHORIZED AND ALLOWED AGAINST SONS OF SAID ASSESSMENTS; DIRECTING. THE CITY CLERK TO ENGROSS AND ENROLL THIS ORDINANCE BY COPYING THE CAPTION OF SAME IN THE MINUTE BOOK OF THE BOARD OF ALDERMEN OF CITY OF WICHITA FAILS, TEXAS, AND BY FILINC 'TEE COMPLETE O")INANCE IN APPROPRIATE ORDINANCE RECORDS OF SAID CITY; AND PROVIDING AN EFFECTIVE DATE, WHEREAS, the City of Wichita Falls, Texas, has heretofore entered into a contract with J. F. Foster and Sons Construction Company for the making and construction of certain street improvements on the hereinafter described portions of streets, avenues, and public places in said City, to�aita THE WIDENING AND PAVING OF PIERCE STREET FROM U.S. HIGHWAY 82 AND 277 QF'IFTH STREET) TO AND INCLUDING iNG TENTH STREET AND KEIViP BOULEVARD INTERSECTION. WHE"',;AS, by sundry proceedings heretofore passed by the Board of Aldermen of the City of Wichita Falls, Texas, including Ordinance No, 2125, a portion of the cost of said improvements was levied and assessed against the respective properties abutting on each of the above described portions of streets, avenues, and public places and against the real and true owners there- of and, WHEREAS, the Board of Aldermen of the City of Wichita Falls, Texas, has upon review, found and determined that, in some instances, in order to effect substantial justice and equality, it is desirable and necessary to grant and issue certain credits against some one or more of the assessments levied by Ordinance No. 2125, and WHEREAS, the street improvements hereinabove mentioned have been completed upon each of the portions of streets, avenues, and public places hereinabove described, and have been inspected and found to be in complete accordance with the contract therefor; NOW, THEREFORE, BE IT ORDAINED BY THE tOARD OF ALDE RMEN OF THE CITY OF WICHITA FALLS, TEXAS, THAT: I The improvements on each of the portions of streets, avenues, and public places hereinabove described be, and they are hereby, accepted; and the contract with reference thereto be, and it is hereby, found and declared fully completed and performed. II The assessments as levied by Ordinance No, 2125 shall be computed for each property owner and the same together with the Engineer's Roll on that portion of Pierce Street herein accepted shall be delivered to the Tax • I Assessor-Collector, and he shall prepare statements which shall be sent to the property owners. III The City Clerk is hereby directed to engross and enroll this Ordi- nance by copying the caption of same in the Minute Book of the Board of Alder- men of the City of Wichita Falls, Texas, and by filing the complete ordinance in the appropriate Ordinance Records of said City.
