Ord 2203 11/22/1965• 7 - ORDINANCE NO, ORDINANCE ACCEPTING IMPROVEMENTS ON A PORTION OF ARCHER STREET IN THE CITY OF WICHITA FAIIS, TEXAS; DECLARING THE CONTRACT WITH R. O. GREEN CONSTRUCTION COMPANY FOR THE CONSTRUCTION OF SAID IMPROVEMENTS FULLY COMPLETED AND PERFORMED; DIRECTING THE ISSUANCE, EXECUTION, AND DELIVERY OF CERTIFICATES IN EVIDENCE OF SPECIAL ASSESS MENTS LEVIED AFTER GIVING EFFECT TO SUNDRY CREDITS HERE- IN AUTHORIZED AND ALLOWED AGAINST SOME OF SAID ASSESS- MENTS; DIRECTING THE CITY CLERK. TO ENGROSS AND ENROLL THIS ORDINANCE IY COPYING THE CAPTION OF SAME IN THE MINUTE BOOK OF THE BOARD OF ALDERMEN OF CITY OF WICHITA FALLS, TEXAS, AND BY FILING THE COMPLETE ORDINANCE IN APPROPRIATE ORDINANCE RECORDS OF SAID CITY; AND PROVID- ING AN EFFECTIVE DATE. WHEREAS, the City of Wichita Falls, Texas, has heretofore entered into a contract with R. O. Green Construction Company for. the making and construction of certain street improvements on the hereinafter described portions of streets, avenues, and public places in said City, to-wit - THE WIDENING AND PAVING OF ARCHER STREET FROM THE EAST PROPERTY LINE OF KEMP BOULEVARD TO A POINT APPROXIMATELY 400 FEET WEST OF TAFT BOULEVARD, SAID POINT tEING THE END OF EXISTING PAVEMENT CONNECTING TO TAFT 'ItCULEVARD WHEREAS, by sundry proceedings heretofore passed by the Board of Aldermen of the City of Wichita Falls, Texas, including Ordinance No. 2197, a portion of the cost of said improvements was levied and assessed against the respective properties abutting on each of the above, described portions of streets, avenues and public places and against the real and true owners thereof; and, WHEREAS, the Board of Aldermen of the City of Wichita Falls, Texas, has upon review, found and determined that, in some instances, in order to effect substantial justice and equality, it is desirable and necessary to grant and issue certain credits against some one or more of the assessments levied by Ordinance No. 2197, and WHEREAS, the street improvements hereinabove mentioned have been completed upon each of the portions of streets, avenues, and public places hereinabove described, and have been inspected and found to be in complete accordance with the contract therefor: NOW, THEREFORE, lE IT ORDAINED BY THE tOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS, THAT: I The improvements on each of the portions of streets, avenues, and public places hereinabove described- be, and they are hereby, accepted; and the contract with reference thereto be, and. it is hereby, found and declared fully completed and performed. II The assessments as levied by Ordinance No. 2197 shall be computed for each property owner and the same together with the Engineer's Roll on that portion of Archer Street herein accepted shall be delivered to the Tax Assessor-Collector, and he shall prepare statements which shall be sent to the property owners. III The City Clerk is hereby directed to engross and enroll this Ordi- nance by copying the caption of same in the Minute Book of the Board of Alder- men of the City of Wichita Falls, Texas, and by filing the complete ordinance in the appropriate Ordinance Records of said City. IV This Ordinance shall take jffect and be in full force and effect from and after the date of its passage.
