Ord 2221 3/24/1966 ORDINANCE NO. 020U AN ORDINANCE CLOSING AND ABANDONING A ONE (1) BLOCK LONG ALLEY IN BLOCK 193 OF THE ORIGINAL TOWNSITE OF THE CITY OF WICHITA FALLS, TEXAS, AND RESERVING A UTILITY EASE- MENT. WHEREAS, Charles N. Prothro, the L. E. C. Company, the Joe and Lois Perkins Foundation, and Fain & McGaha, property owners, have requested the Board of Aldermen of the City of Wichita Falls to close and abandon all of the alley situated in Block 193 of the Original Townsite of the City of Wichita Falls, Wichita County, - ` Texas, and the Board of Aldermen, after consideration of the petition, and finding that all of the property which will be served by that portion of said alley sought to be closed and abandoned and that the closing of said alley would not affect the rights of the general public in any manner. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS: SECTION 1. That the one (1) block long, twenty-five (25) foot wide alley running northwest and southeast parallel to Lamar and Scott Streets from the southeast property line of Tenth Street to the northwest property line of Eleventh Street, lying between Lots 1 through and including Lot 5, and Lots 6 through and includ- ing Lot 10 of Block 193 of the Original Townsite of the City of Wichita Falls, Texas, be and the same is hereby closed and abandoned. SECTION 2 . This ordinance is passed for the purpose of assisting the property owners who own the property on each side of said alley as above described to secure the better use of their property, and for the purpose of relieving the City of Wichita Falls from any further expense and liability for the maintenance and upkeep of said alley and said alley is hereby closed and abandoned. SECTION 3. This ordinance is passed subject to the right -2- of the City to ingress and egress on said property for the purpose of maintaining the sewer and water lines situated in said alley, and is also subject to the rights of other easement owners in said alley for the purpose of maintaining gas lines, telephone conduits and electric power lines and other utility easements. SECTION 4. No building shall be built over said alley unless and until satisfactory arrangements have been made with the City Engineer with reference to the maintenance and upkeep of the sewer and water lines and with the other easement owners with reference to their easements. SECTION 5. This ordinance is passed upon the condition that in building buildings upon the Block in question that the said Charles N. Prothro, the L. E. C. Company, the Joe and Lois Perkins Foundation, and Fain & McGaha, their heirs and assigns, will provide adequate loading and unloading facilities within the property lines of said Block so that it will not be necessary to use the streets surrounding said Block for such purposes.
