Res 433 11/14/1960THE STATE OF TEXAS COUNTY OF WICHITA CITY OF WICHITA FALLS -V Lt� 3 On this the 14th day of November, 1960, the Board of Aldermen of the City of Washita Falls, Texas, convened in Regular Meeting, at the regular meeting place, with the following members present, to -wit: Kenneth Johnson, Mayor, J. R. Ray, Roger E. Thoes, Mrs. H. P. Ledford, Aldermen, Joe B. Meissner, Jr., Dr. Al T. Witcher, E. J. Wininger, Albert L. Fitts, City Clerk, with the following absent: -- , constituting a quorum, at which time the following proceedings were had: Alderman R&VV introduced a resolution and moved that it be adopted. The motion was seconded by Alderman W'. The motion carrying with it the adoption of the resolution prevailed by the following vote: YEAS: Aldermen Ray, Thoes, Ledford, Neissner, Witcher and Wininger and Mayor Johnson. NAYS. None. The resolution as adopted is as follows: I RESOLUTION NO. BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS, CALLING AN ELECTION ON THE QUESTION OF THE ISSUANCE OF $6, oo0, 000.00 WATERWORKS TAX BONDS AND ON THE QUESTION OF THE ISSUANCE OF $6 :500,000.00 WATERWORKS REVENUE BONDS. WHEREAS, the Board of Aldermen of the -City of Wichita Fails, Texas, deems it advisable to issue the bonds of the City for the purposes hereinafter mentioned; BE IT RESOLVED BY THE BOARD OF AIDERMEN OF THE CITY OF WICHITA FALLS, TEXAS: 1. That an election be held in the City of Wichita Falls, Texas, on the 8th day of December, 1960, at which election the following propositions shall be submitted: places pointed PROPOSITION NO. 1 "Shall the Board of Aldermen of the City of Wichita Falls, Texas, be authorized to issue the bonds of said City in the sun of $6,000,000.00, maturing seri- ally in such installments as may be fixed by the Board of Aldermen, the maximum maturity being not more than Forty (40) years from their date, bearing interest at a rate not to exceed Five (5 %) per cent per annum, and to levy a tax sufficient to pay interest as it accrues and principal as it matures on said issue of bonds, for the purpose of improving and extending the waterworks system of the City, as authorized by the Constitution and laws of the State of Texas." PR OFOS IT ION NO. 2 "Shall the Board of Aldermen of the City of Wichita Falls, Texas, be authorized to issue the bonds of said City in the amount of $6,500,000.00, maturing seri- ally in such installments as may be fixed by the Board of Aldermen, the maximum maturity being not more than Forty (40) years from their date, bearing interest at a rate not to exceed Five (5 %) per cent per annum, for the purpose of improving and extending the waterworks system of the City, to be issued in accordance with and secured in the manner provided in Articles 11.11 -1118, both inclusive, of the Re- vised Civil Statutes of Texas, 1925, as amended, each bond to be conditioned that the holder thereof shall never have the right to demand payment of said obligation out of funds raised or to be raised by taxation, secured by a pledge of the net revenues from the operation of the Waterworks System of said City.!' 2. In City Precinct No. 33, composed of Wichita County Election Precinct No. 52, at the Ben Milam School, 2960 Stearns, within said City, with Mrs. Nancy Cox, Presiding Judge. In City Precinct No. 34, composed of Wichita County Election Precinct No. 55, at the Cunningham School, 4107 Phillips, within said City, with Mrs. Eltine Box, Presiding Judge. In City Precinct No. 35, composed of Wichita County Election Precinct No. 56, at the Jefferson School, 4628 Mistletoe, within said City, with Jack Connell, Jr., Presiding Judge. The Presiding Judges above named are hereby authorized to select such assistants as they deem necessary to assist in the holding of said election. 3. The said election shall be held under the pro- visions of Chapter 1, Title 22 of the devised Civil Statutes of Texas, 1925, as amended, including, the provisions of Article 704, as amended by Chapter 382, passed at the First Called Session of the Forty fourth Legis- lature, and only legally qualified electors who own taxable property in the City and who have duly rendered the same for taxation shall be quali- fied to vote. 4. The ballots for said election shall have written or printed thereon the following: PROPOSITION NO. 1 "FOR THE ISSUANCE OF WATER IMPROVEMENT BONDS AND THE LEVY OF A TAX IN PAYMENT THEREOF" "AGAINST THE ISSUANCE OF WATER IMPROVEMENT BOMS AND THE ?BEVY OF A TAX IN PAYMENT TI3EREOF " PROPOSITION NO. 2 "FOR THE ISSUANCE OF WATER IMPROVEMENT BONDS SECURED BY WATERWORKS SYSTEM REVENUES" "AGAINST TEE ISSUANCE OF WATER IMPROVEMENT BONDS SECURED BY WATERWORKS SYSTEM REVENUES" Concerning each proposition, each voter shall mark out with black ink or black pencil one of the above expressions, thus leaving the other as indicating his vote on the proposition. 5. A substantial copy of this resolution signed by the Mayor of said City and attested by the City Clerk shall serve as proper notice of said election. Notice shall be given in accordance with Article 704, Revised Civil Statutes of 1925) as amended by Chapter 382, passed at r the First Called Session of the Forty Fourth Legislature, supra. The Mayor is authorized and directed to have a copy of said notice posted at the City Hall and at each voting place within said City not less than fifteen days prior to the date fixed for holding said election. He shall also cause said notice to be published on the same day in each of two successive weeks in a newspaper of general circulation published within said City, the date of the first publication to be not less than fourteen days prior to the date set for said election. Except as otherwise pro- vided in said Article 704, as amended, the manner of holding said election shall be governed by the laws governing general elections.
