Res 414 4/25/1960- � ,„ RESOLUTION NO. 414 1HEREAS, Millard J. Underwood has constructed a building on the triangle at 10th and Beverly; and WHEREAS, a portion of said building, to wit, a planter box thirty -six (36 ") inches high is presently en- croaching on the street easement of Beverly Drive by appro- ximately three feet and four inches (3'-L"); and WHEREAS, the City of Wichita Falls has no plans to utilize the said easement. NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS, THAT, Millard J. Underwood, is and he is hereby granted permission to -use three feet and four inches of the Beverly DRive right- of-way easement until such time as the City of Wichita Falls uses said portion of this easement for sidewalk purposes. Ieley COMMENT: Referring to the request of Mr. Underwood for permission to encroach on the sidewalk space with a planter box, there is verb' little Iftelihood that a sidewalk will ever be constructed at this particular location. The planter. box will not interfere with the proposed paving width sand until such time in the future that this space might by needed for public usei I see no objection to allowing the planter box as- rested.. I am , sure Mr. Underwood laid out the building in good faith thinking that he was clearing the sidewalk space. Our survey differs from that of Mr. Lee is and it is too late to shift the building without completely wrecking the structure.
