H']RnAS, The Corps of Engineers, U. S. AREY has made
a preliminary study of Drainage project for protection of the
City of 4ichita Falls against floods caused by Plun Creek and
tributary, and has found that there is a possibility of Federal
participation in the construction of such a Drainage project
under authority of Public Law 685, 8b,.th Congress, 2d Session;
and
ViH ,i3EAS, before proceeding with the preparation of
plans for the proposed Drainage project, the Corps of Engineers
has requested assurances from the City of Wi.chita Falls with re-
spect to its .willingness and ability to meet the requirements
of local cooperation set forth in the Flood Control act of 1936
consistina of the rights- of -vay, accomplishing, utility and road
relocations, holding the .,Government free froriy damages, and main-
taining and operating the project after construction; and
I;HEREAS, the City of v,'ichita Falls is a legally quali-
fied body capable, under the provisions of Statutes of the State
of Texas, of Meeting the requirements of local cooperation; and
caHEREAS, the Citizenship t ,,rithin the limits of the area
which would be protected by the proposed works earnestly eesire
that the Corps of Engineers, U. S. Array, proceed with the pre-
paration of the necessary plans and project report on the pro-
posed works ; and
UTHEI?EAS, the assurances stated hereinafter do not
commit the Federal Government to construction of the proposed
project; and
NOiq THEREFORE, BE IT RESOLVED BY THE BOARD OF - ALDERkMN
OF THE CITY OF ?;ICHITA FALLS, THAT the Corps of Engineers be ad-
vised that the City of Wichita Falls -,,,rill take appropriate action
to provide full cooperation and participation at such time as the
Corps of Engineers approves construction of a Drainage system for
the protection of the City of V�ichita Falls; and
That it is understood that full cooperation and parti-
cipation would require the sponsor to agree to:

a. Provide without cost to the United States
all lands, easements, and rights -of -way
necessary for project construction.
b. Hold and save the United States free from
damages due to the construction wo -nks.
c. Xaintain and operate the project after com-
pletion in accordance with regulations pre-
scribed by the Secretary of the Array.
d. Assume full responsibility for all project
costs in excess of the Federal cost lirai -
tation of X400,000 if found necessary to
provide a complete project.
e. Bake cash contribution for project costs
assigned to project features other than flood
control.
f. Contribute toward construction costs if sub-
stantial land enhancement or similar type
benefits will accrue to the proposed project,
and THAT, the City of ':ichita Falls is legally
responsible and willing to meet the aforestated
requirements of local cooperation, and would
at the appropriate time, take the required
steps to finance its portion of the project
costs.
BE IT FURTHER RESOLVED THAT a copy of this resolution
be forwarded to the District Engineer, Tulsa District, Corps of
Engineers, U. S. Army, Tulsa, Oklahoma
