WHEREAS, the property located at 1652 W:Rson Street, fur-.,r
ther described as Lot 8, Block 1 to the Brook °Avenue Addition to
the City of Wichita Falls, Texas, is presently encroaching appro-
ximately one foot and two inches (1' --2 ") on the Street right -of-
way line of Marshall street for a distance of twenty -two feet
(221); and
WHEREAS, Marshall Street is a dedicated street within the
City of Wichita Falls, Wichita County, Texas; and
-WHEREAS� present plans of the City of Wichita Falls do not
include the widening of the said Marshall Street; and
WHEREAS, the small encroachment does not at the present time
create any hazards or problems for the City of Wichita Falls; and
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF
THE CITY OF WICHITA FALLS, TEXAS, THAT the City does hereby waive
the encroachment described.

Nays: None.
