Res 333 8/11/1958. 5 -_33 THE STATE OF TEXAS COUNTY OF WICHITA CITY OF WICHITA FALLS On this the 11th day of August, 1958, the Board of Aldermen of the City of Wichita Falls, Texas, convened in Regular Meeting, at the regular meeting place, with the following members present, to -wit: K. C. Spell, Mayor, Bill G. Hale, Dr. J. D. Hall, Milam J. Vaughan, Aldermen, Joe B. Meissner, Jr., Bill,Thacker, Stayton M. Bonner, I : Geo. T. Henderson, City Clerk, with the following absent: None , constituting a quorum, at which time the following proceedings were had: Alderman 1w1cissner introduced a resolution and moved that it be adopted. The motion was seconded by Alderman Vatz�k�a� The motion carrying with it the adoption of the resolution prevailed by the following vote: YEAS: Aldermen Hale, Mall, Vaughan, Meissner, Thacker and Bonner and Mayor Spell. NAYS: None. The resolution as adopted is as follows: RESOLUTION NO. -$ 3 3 BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS, CALLING AN ELECTION ON THE PROPOSITIONS OF AUTHORIZING TEE EX- ECUTION OF A WATER SUPPLY CONTRACT WITH WICHITA COUNTY WATER CONTROL AND IMPROVE- MENT DISTRICT Nil. 1 AND THE ISSUANCE OF $2,7002000.00 OF WATERWORKS IMPROVEMENT BONDS AND THE LEVY OF A TAX IN PAYMENT OF SUCH BONDS; PROVIDING FOR NOTICE OF SUCH ELECTION; PRESCRIBING VOTING PLACES, ELECTION OFFICIALS AND DEFINING QUALIFI- CATIONS OF WZCTORS ELIGIBLE TO VOTE-IN SAID ELECTION AND RESOLVING OTHER MATTERS RELATING TO THE SUBJECT. • 3 WHEREAS., the Board of Aldermen has determined that the present and future welfare of the City and its inhabitants requires that immediate provision be made to furnish an additional source of water supply which may be obtained by contract with Wichita County Water Control and Improvement District No. 1 and further that additional filtration facili- ties need to be provided to assure safe, potable and adequate pure water for the City; and WHEREAS, it is deemed advisable and necessary that an election be called within said City for the purpose of submitting the propositions hereinafter set forth to the voters for their action there- upon; BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS: 1. That an election be held in the City of Wichita Falls, Texas, on the 6th day of September, 1958, at which election the following propositions shall be submitted: PROPOSITION NO. 1 "Shall the Board of Aldermen of the City of Wichita Falls, Texas, be authorized to enter into a con- tract with Wichita County Water Control and Improvement District No. 1 for the purpose of supplying water to said City, as authorized by Chapter 342, Acts of the Fifty First Legislature of Texas, and other applicable laws?" PROPOSITION NO. 2 "Shall the Board of Aldermen of the City of Wichita Falls, Texas, be authorized to issue the bonds of said City in the sum of $2,700,000.001 maturing serially in such installments as may be fixed by the Board of Aldermen, the maximum maturity being not more than Thirty (30) years from their date, bearing interest at a rate not to exceed Four and one -half (4-2%) per cent per annum, and to levy a tax sufficient to pay interest as it accrues and principal as it matures on said issue of bonds, for the purpose of constructing water filtration facilities and improving the waterworks system of the City, as authorized by the Constitution and laws of the State of Texas." 2. The said election shall be held under the provisions of Chapter 1 Title 22 of the Revised Civil Statutes of Texas, 1925, as amended, including the provisions of Article 704, as amended by Chapter 382, passed at the First Called Session of the Forty Fourth Legislature, and only legally qualified electors who own taxable property in the City and who have duly rendered the saute for taxation shall be qualified to vote. 4. The ballots for said election shall have written or printed thereon the following; PROPOSITION NO. 1. "FOR THE WATER CONTRACT" "AGAINST THE WATER CONTRACT" PROPOSITION NO. 2 "FOR THE ISSUANCE OF WATERWORKS IMPROVEN]ENT BONDS " "AGAINST THE ISSUANCE OF WATERWORKS IMPROVE- MENT BONDS" Each voter shall mark out with black ink or black pencil one of the above expressions, thus leaving the other as indicating his vote on the proposition. 5. A substantial copy of this resolution signed by the Mayor of said City and attested by the City Clerk shall serve as proper notice of said election. Notice shall be given in accordance with Article 704, Revised Civil Statutes of 1925, as amended by Chapter 382, passed at the First Called Session of the Forty Fourth Legislature, supra. The Mayor is authorized and directed to have a copy of said notice posted at the City Hall and at each voting place within said City not less than fifteen days prior to the date fixed for holding said election. He shall also cause said notice to be published on the same day in each of two successive weeks in a, newspaper of general circulation published within said City, the date of the first publication to be not less than fourteen days prior to the date set for said election.
