ORDINANCE ACCEPTING IMPROVEMENTS ON A PORTION OF ROSEWOOD
STREET IN THE CITY OF WICHITA FALLS, TEXAS; DECLARING THE
CONTRACT WITH J. F. FOSTER AND SONS FOR THE CONSTRUCTION
OF SAID IMPROVEMENTS FULLY COMPLETED AND PERFORMED; DIRECT-
ING THE ISSUANCE, EXECUTION, AND DELIVERY OF CERTIFICATES
IN EVIDENCE OF SPECIAL ASSESSMENTS LEVIED AFTER GIVING
EFFECT TO SUNDRY CREDITS HEREIN AUTHORIZED AND ALLOWED AGAINST
SOME OF SAID ASSESSMENTS; DIRECTING THE CITY CLERK TO ENGROSS
AND ENROLL THIS ORDINANCE BY COPYING THE CAPTION OF SAME
IN THE MINUTE BOOK OF THE BOARD OF ALDERMEN OF CITY OF WICHITA
FALLS, TEXAS, AND BY FILING THE COMPLETE ORDINANCE IN APPRO-
PRIATE ORDINANCE RECORDS OF SAID CITY; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the City of Wichita Falls, Texas, has heretofore entered
into a contract with J. F. Foster and Sons for the making and construction
of certain street improvements on the hereinafter described portions of streets,
avenues, and public places in said City, to-wit:
THE PAVING OF ROSEWOOD STREET FROM DUNCAN STREET TO LOOP 165 AND
ROSEWOOD GRADE CROSSING FROM LOOP 165 to TEXAS STREET.
WHEREAS, by sundry proceedings heretofore passed by the Board of
Aldermen of the City of Wichita Falls, Texas, including Ordinance No. 2196,
a portion of the cost of said improvements was levied and assessed against
the respective properties abutting on each of the above described portions of
streets, avenues, and public places and against the real and true owners there-
of; and,
WHEREAS, the Board of Aldermen of the City of Wichita Falls, Texas,
has upon review, found and determined that, in some instances, in order to
effect substantial justice and equality, it is desirable and necessary to grant
and issue certain credits against some one or more of the assessments leved by
Ordinance No. 2196, and
WHEREAS, the street improvements hereinabove mentioned have been
completed upon each of the portions of streets, avenues, and public places
hereinabove described, and have been inspected and found to be in complete
accordance with the contract therefor:
NOW, THEREFORE,
BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS,
TEXAS, THAT:
I
The improvements on each of the portions of streets, avenues, and
public places hereinabove described be, and they are hereby, accepted; and
the contract with reference thereto be, and it is hereby, found and declared
fully completed and performed.
II
The assessments as levied by Ordinance No. 2196 shall be computed
for each property owner and the same together with the Engineer's Roll on
that portion of Rosewood Street herein accepted shall be delivered to the Tax
Assessor-Collector, and he shall prepare statemEtnts which shall be sent to
the property owners.
III
The City Clerk is hereby directed to engross and enroll this Ordi-
nance by copying the caption of same in the Minute Book of the Board of Alder-
men of the City of Wichita Falls, Texas, and by filing the complete ordinance
in the appropriate Ordinance Records of said City.
IV
This Ordinance shall take effect and be in full force and effect
from and after the date of its passage.
