ORDINANCE CLOSING AND ABANDONING A 98.84 FOOT PORTION
OF NORTH TENTH STREET AND RESERVING A UTILITY EASEMENT.
WHEREAS, the Board of Aldermen of the City of Wichita Falls,
Texas, deems it advisable and in the public interest to close a
portion of North Tenth Street hereinafter described.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF
THE CITY OF WICHITA FALLS, TEXAS, THAT:
SECTION 1: That the 98.84 foot long by 50 foot wide portion
of North Tenth Street, lying between Vermont Avenue and Red River
Valley Expressway and being located in the C. A. Tidwell Subdiv-
ision, of the City of Wichita Falls, be and the same is hereby
closed and abandoned.
SECTION 2: The City of Wichita Falls, Texas, hereby reserves
an easement in said land for the purpose of laying and maintaining
all kind and character of utility lines, including water, gas,
electric, telephone, telegraph, and power lines, and sanitary and
storm sewers.
SECTION 3: This ordinance is passed subject to the right of
the City to ingress and egress on said property for the purpose
of maintaining the water lines situated in said portion of North
Tenth Street, and is also subject to the rights of other easement
owners in said portion of North Tenth Street for the purpose of
maintaining gas lines, telephone conduits and electric power lines
and other utility easements.
SECTION 4: No building shall be built over said portion of
North Tenth Street being closed and abandoned unless and until
satisfactory arrangements have been made with the City Engineer
with reference to the maintenance and upkeep of the water lines
and other City Utility easements and with the other easement

owners with reference to their easement.
SECTION 5 : No fence shall be erected around the said portion
of North Tenth Street being abandoned until an access route between
Vermont Avenue and Red River Valley Expressway has been constructed
to the satisfaction of the City of Wichita Falls Traffic Engineer.
