ORDINANCE ACCEPTING IMPROVEMENTS ON TEN OF THE SIXTY-FIVE
LOCATIONS IN THE CITY OF WICHITA FALLS, TEXAS, AS DESIGNAMv
IN ORDINANCE NO. 2216; DECLARING THE CONTRACT WITH ASPHALT
PAVERS, INC. , FOR THE CONSTRUCTION OF SAID IMPROVEMENTS FULLY
COMPLETED AND PERFORMED; DIRECTING THE ISSUANCE, EXECUTION,
AND DELIVERY OF CERTIFICATES IN EVIDENCE OF SPECIAL ASSESSMENTS
LEVIED AFTER GIVING EFFECT TO SUNDRY CREDITS HEREIN AUTHORIZED
AND ALLOWED AGAINST SOME OF SAID ASSESSMENTS; DIRECTING THE
CITY CLERK TO ENGROSS AND ENROLL THIS ORDINANCE BY COPYING THE
CAPTION OF SAME IN THE MINUTE BOOK OF THE BOARD OF ALDERMEN OF
THE CITY OF WICHITA FALLS, TEXAS, AND BY FILING THE COMPLETE
ORDINANCE IN APPROPRIATE ORDINANCE RECORDS OF SAID CITY; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City of Wichita Falls,Texas has heretofore entered
intO ,a contract with Asphalt Pavers, Inc. , Wichita Falls, Texas, for the
making and construction of certain street improvements on the hereinafter
described portions of streets, avenues, and public places in said City,
to-wit:
Baylor Avenue: From the south property line of Ninth Street
to the north property line of Tenth Street.
Bluff Avenue: From the north property line of Kell Boulevard
to the south side of main track of Fort Worth
&Denver Railroad.
Cleveland Avenue: From the south property line of Juarez Street
to the north property line of Welch Street.
Jalonic Street: From the east property line of Kentucky Street
to the west property line of California Avenue.
Marconi Street: From 150' east of the east property line of
Bailey Avenue to approximately 50' east of
the east property line of Neff Street.
Walnut Street: From the east property line of Mississippi to
the west property line of Virginia Street.
Walnut Street: From the east property line of Virginia Street
to the west property line of Kentucky Street.
Walnut Street: From the east property line of Kentucky Street
to the west line of California Avenue.
Walnut Street: From the west property line of California Ave-
nue to the east property line of Colorado Ave-
nue.
Walnut Street: From the east property line of Colorado Avenue
to the west property line of Texas Avenue.
WHEREAS, by sundry proceedings heretofore passed by the Board of
Aldermen of the City of Wichita Falls, Texas, including Ordinance no. 2223
and 2230 a portion of the cost of said improvements was levied and assessed
against the respective properties abutting on each of the above described
portions of streets, avenues and public places and against the real and true
owners thereof; and,
WHEREAS, the Board of Aldermen of the City of Wichita Falls, Texas,
has upon review, found and determined that, in some instances, in order to
effect substantial justice and equality, it is desirable and necessary to
grant and issue certain credits against some one or more of the assessments
levied by Ordinance No. 2223 and 2230 and
WHEREAS, the street improvements hereinabove mentioned have been
completed upon each of the portions of streets, avenues, and public places
hereinabove described, and have been inspected and found to be in complete
accordance with the contract therefor:
NOW, THEREFORE,
BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA
FALLS, TEXAS, THAT:
I
The improvements on each of the portions of streets, avenues, and
public places hereinabove described be, and they are hereby, accepted; and
the contract with reference thereto be, and it is hereby, found and declared
fully completed and performed.
II
The assessments as levied by Ordinance No. 2223 and 2230 shall be
computed for each property owner and the same together with the Engineer's
Roll on the ten streets of the sixty-five locations herein accepted shall be
delivered to the Tax Assessor-Collector, and he shall prepare statements which
shall be sent to the property owners.
III
The City Clerk is hereby directed to engross and enroll this Ordi-
nance by copying the caption of same in the Minute Book of the Board of Alder-
men of the City of Wichita Falls, Texas, and by filing the complete ordinance
in the appropriate Ordinance Records of said City.
IV
This Ordinance shall take effect and be in full force and effect
from and after the date of its passage. �J
