ORDINANCE NO. ��
AN ORDINANCE AMENDING SECTIONS 27-26, 27-27, 27-28
AND 27-29 OF THE CODE OF ORDINANCES OF THE CITY OF
WICHITA FALLS, REQUIRING THE BUILDING OF SIDEWALKS
ON CERTAIN LOT OR LOTS ABUTTING ON A CITY STREET,
REQUIRING A PERMIT TO CONSTRUCT SUCH SIDEWALKS,
PROVIDING FOR EXCEPTIONS TO THE CONSTRUCTION OF
SIDEWALKS, AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. Section 27-26 of the Code of Ordinances
of the City of Wichita Falls be and it is hereby amended so
that such Section shall read as follows:
"Section 27-26. Construction of sidewalks required; speci-
fications.
Any person constructing a building or buildings for
any purpose on a lot or lots abutting on a city street shall
construct a sidewalk in accordance with the specifications
adopted by the City and on file in the office of the Director
of Public Works. For the purpose of this Section, the ex-
pression ' constructing a building ' shall include the remodel-
ing of a building when the cost of such remodeling is equal
to at least fifty percent (50%) of the value of such building
before such remodeling as determined by the Building Inspector. "
SECTION 2. Section 27-27 of the Code of Ordinances
of the City of Wichita Falls be and it is hereby amended so
that such Section shall read as follows:
"Section 27-27 . Exceptions to section.
Any person may receive an exception to Section 27-26
only if there is an impossibility of construction caused by
drainage, street grades or other physical barriers which make
such sidewalk construction impracticable. This determination
will be made by the City Engineer in writing to the Building
Inspector. "
SECTION 3. Section 27-28 of the Code of Ordinances
of the City of Wichita Falls be and it is hereby amended so
that such Section shall read as follows:
"Section 27-28. Appeals.
Any person dissatisfied with the determination made
by the City Engineer shall have the right to appeal to the
Board of Aldermen. "
SECTION 4. Section 27-29 of the Code of Ordinances
of the City of Wichita Falls be and it is hereby amended so
that such Section shall read as follows:
"Section 27-29. Compliance with article required in order to
obtain a building permit.
The Building Inspector shall not issue a building per-
mit for the construction of any building, or the remodeling of

any building as described in Section 27-26, on any lot or lots
abutting on a city street unless there shall also be presented
an application for the construction of a sidewalk in conjunction
with such building or an exception to the building of the side-
walk as set out in Section 27-27 . The Building Inspector shall
not issue a certificate of occupancy for any building on any
lot or lots abutting on a city street until a sidewalk in con-
junction with said building meeting the approval of the Director
of Public Works shall have been completed or an exception granted
to the building of the sidewalk. "
SECTION 5. The fact that the requirement of the con-
struction of sidewalks is necessary for the safety of children
and other people within the City of Wichita Falls creates an
emergency, and this ordinance is declared an emergency measure
on the ground of urgent public need for the preservation of the
peace, health and safety of property of the City, and such ordi-
nance shall become effective upon its passage.
