AN ORDINANCE ABANDONING THE CONSTRUCTION OF IMPROVEMENTS ON
PORTIONS OF STREETS AT LOCATIONS OUT OF THE 1967 ASSESSMENT
PAVING PROGRAM, DELETING SAME FROM CONTRACT WITH ASPHALT
PAVERS, INC. , AND CANCELLING THE ASSESSMENT LIENS LEVIED
AGAINST ABUTTING PROPERTIES. •
WHEREAS, by Ordinance No. 2304 and Ordinance No. 2314 dated February 13, 1967
and March 30, 1967, The Board of Aldermen of the City of Wichita Falls, •Texas,
a municipal corporation, determined the necessity of paving and constructing
other improvements on portions of streets, avenues, and public places designated
as the 1967 Assessment Paving Program in Wichita Falls, and a notice of such
action, in accordance with Article 1220A of Revised Civil Statutes of Texas,
was filed with the County Clerk and was recorded in Volume 561, Page 608 and
Volume 563, Page 567, of the Deed of Trust Records of Wichita County; and,

WHEREAS, by Ordinance No. 2327, dated May 8, 1967, the Board of Aldermen of the
City of Wichita Falls, Texas levied assessments against abutting properties and
their owners to pay a part of the cost of such improvements, and ;
WHEREAS, on the portions of streets hereinafter mentioned there is insufficient
participation by homestead owners to enable the improvements to be constructed
on such streets, and;
WHEREAS, Asphalt Pavers, Inc. , who has contracted with the City for the construct
ion of said improvements, has consented to the abandonment of the improvements on
such portions of streets.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA
FALLS, TEXAS, THAT:
I.
The improvements on the following portions of streets shall be abandoned, and
same shall be deleted from the contract with Asphalt Pavers, Inc. , and the
assessment liens heretofore levied against properties abutting such portions of
streets are hereby cancelled, to-wit:
UNIT # 21 Perigo Street From the south property line of
Ireland Street to the south property
line of Widows Lane.
UNIT # 22 Perigo Street From the South Property line of
Widows Lane to the south property line
• of Rowland Road.
UNIT # 32 North Broadway From the south property line of North
First to the south property line of
North Second.
II.
The City Clerk is hereby directed to file a notice of this ordinance with the
County Clerk of Wichita County, Texas for the purpose of releasing the assessment
liens against such properties abutting the portions of Streets set out above.

THE STATE OF TEXAS X NOTICE OF RELEASE OF
COUNTY OF WICHITA X ASSESSMENT
WHEREAS, the Board of Aldermen of the City of Wichita Falls, Texas,
a municipal corporation, has here-to-fore ordered an assessment against
certain property abutting the list of streets listed below, and
WHEREAS, notice of said assessment was dated February 13, 1967, and
March 20, 1967, and recorded in Volume 561, Page 608 and Volume 563, Page
567 of the Deed of Trust records of Wichita County, Texas, to which refer-
ence is here made for all purposes.
WHEREAS, by Ordinance No. c.) <-1) / dated July 10, 1967, the Board
of Aldermen released such assessments against the properties abutting the
following portions of streets, to-wit:
UNIT # 21 Perigo Street: From the south property line of
Ireland Street to the south property
line of Widows Lane.
UNIT # 22 Perigo Street: From the south property line of
Widows Lane to the south property
line of Rowland Road.
UNIT # 32 North Broadway: From the south property line of North
First to the south property line of
North Second.
NOW, THEREFORE, notice is hereby given that such assessment liens levied
against the properties abutting on the above set out portions of streets have
been cancelled.
