' AN ORDINANCE AMENDING SECTION 27-27 OF THE CODE OF
ORDINANCES OF THE CITY OF WICHITA FALLS, PROVIDING
FOR CERTAIN EXCEPTIONS TO SIDEWALK REQUIREMENT IN
INDUSTRIAL DISTRICTS, AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF
WICHITA FALLS, TEXAS, THAT:
SECTION 1. Section 27-27 of the Code of Ordinances of
the City of Wichita Falls be and it is hereby amended so that
such Section shall read as follows :
"Section 27-27 . Exception to Section.
Any person may receive an exception to Section 27-26 only
if there is an impossibility of construction caused by drainage,
street grades or other physical barriers, or if the property is
located within an approved industrial district. The determina-
tion of impossibility of construction caused by drainage, street
grades or other physical barriers will be made by the City Engi-
neer in writing to the Building Inspector.
Exceptions to this ordinance because of location within an
industrial area shall only apply to interior streets . An in-
terior street is defined as a street that lies wholly within

the industrial district and does not abut subdivided or unsub-
divided property outside of the industrial district. An interior
street shall only provide for circulation within the industrial
district and does not provide for access from adjacent areas.

An industrial district must be greater than one hundred and forty
(140) acres and must be approved by the City of Wichita Falls •
Planning Board. Activities within the industrial district must
be restricted by deed restrictions to activities that fall within
Code Classification 2 and 3 (manufacturing) , Code 51 (wholesale
trade) , and Code 52 (retail trade-building materials, hardware,
and farm equipment) as defined in the Standard Land Use Coding

Department of Commerce, Washington, D. C. "
SECTION 2 . The fact that construction is presently being
carried out in industrial districts , which is required to have

sidewalks under the present ordinance, creates an emergency,
and this ordinance is declared. an emergency measure on the
ground of urgent 'public need for the preservation of the peace,
• health and safety of property of the City, and such ordinance
shall become effective upon its passage.
