ORDINANCE ACKNOWLEDGING RESTRICTIONS UNDER THE SOUTHERN STANDARD
BUILDING CODE AS ADOPTED BY THE CITY OF WICHITA FALLS IN REGARD TO
THE MOVING OF BUILDINGS; SETTING FORTH CERTAIN GUIDELINES FOR THE
INTERPRETATION OF PARAGRAPH 2204.3 OF THE SOUTHERN STANDARD BUILDING
CODE IN REGARD TO MOVING OF HOUSES ACQUIRED WITH THE ACQUISITION OF
RIGHT-OF-WAY FOR PROJECTS UNDER THE 1967 CAPITAL IMPROVEMENTS PROGRAM;
AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City of Wichita Falls, Texas, has begun the
preparation of plans and specifications for projects under the 1967
Capital Improvements Program and has heretofore entered into a con-
tractual agreement with the Texas Highway Department for the acquisi-
tion of right--of-way for the construction of the U.S. Highway 82-277
Expressway, better known as the Kell Freeway, and the North Beverly
Street Relocation, and,
WHEREAS, in the acquisition of the right-of-way for these
projects,' it will be necessary to purchase several single family
residential dwellings, which dwellings will be sold through public
bidding, and,
WHEREAS, the Board of Aldermen of the City of Wichita Falls,
Texas, is aware of Paragraph 2204.3 in the Southerni Standard Building

Code in regard to the moving of buildings.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF
THE CITY OF WICHITA FALLS, TEXAS, THAT:
Paragraph 2204.3 of the Southern Standard Building Code is
hereby acknowledged as being restrictive to the moving of buildings
within the City of Wichita Falls in prohibiting the moving of any
building which will cause serious injury to persons or property.
Paragraph 2204.3 of the Southern Standard Building Code shall
• be interpreted by the Building Official to prohibit the moving of
buildings acquired in the acquisition of right-of-way for projects under
the 1967 Capital Improvements Program to any lot or parcel in a devel-
oped area in which the existing dwellings are better in construction or
larger in size than the dwelling proposed to be moved or to any lot
which is occupied by an existing single family residence. This paragraph
of the Southern Standard Building Code shall also be interpreted by
the Building Official to be restrictive in so much as the City of
Wichita Falls declares its intent to honor the restrictive covenants
of all subdivisions within the City of Wichita Falls.
This ordinance shall take effect and be in full force and •

effect from and after the date of its passage.
