RESOLUTION ACCEPTING TEXAS HIGHWAY COMMISSION MINUTE ORDER NO.
55120, CONCERNING THE CHANNELIZATION OF THE INTERSECTION OF
FAIRWAY BOULEVARD AND U. S. HIGHWAYS 82 AND 277.
BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS,
TEXAS, that the provisions of Minute Order No. 55120 passed by the Texas
Highway Commission on September 30, 1964, concerning the channelization
of the intersection of Fairway Boulevard and U. S. Highways 82 and 277 ,
are acceptable to the City of Wichita Falls, and it is hereby ordered
that the City of Wichita Falls cooperate with the State Highway Department
and proceed with the obligations so stipulated in the above minute order
as being responsibilities of the City.

requested aasistcnce in the widening of pavement including incidental items thereto
frog 0.3 mile West of Beverly Drive to 0.3 mile West of Fairway Boulevard,a
distance of approximately 2.2 miles; and 10c.
Gin analysis of the requested work indicates that such widening will materially
add to traffic safety on this facility;NOW,
T 2:'the State Bighvay Engineer is directed to tender the following pro-posal
to the City of Wichita :ails:Provided
the City will:1.
Secure all necessary right of way according to policies of the Texas Highway.
Highway.Department and provide for the immediate construction of contin-uous
curb and gutter, storm sewers, etc., all as may be necessary for a complete
project with the exception of pavement widening.2.
Assume responsibility for the construction of driveways and sidewalks should
they be deemed. necessary now or in the future and agree to make such
installations in accordance with governing, policies and regulations of
the Department.3.
Elaintain that portion of the work which is its responsibility in accordance with
present maintenance agree, nt and agree to regulate traffic, provide for
parallel parking and prevent encroachment on the right of way, all in accordance
with governing policies and regulations of the Department.The
Teams Zighway Depart antwill:1.
Participate in the cost of right of way in accordance with current laws and
policies, at an estimated cost of $12,000.

2. Provide for widening pavement and its support within these limits at an
estimated cost of $130,000.
3. Maintain that portion of the work which is its responsibility in accordance
with present maintenance agreement.
It is understood that the responsibility of the Texas Highway Department is con-
fined to the pavement and its support, and all other features necessary now or
in the future to provide an adequate travel facility shall be the responsibility
of the City of Wichita Falls.
Upon acceptance of the provisions of this Order by the appropriate officials of
the City of Wichita Falls, the State Highway Engineer is directed to proceed with
the development of plans for construction and after the City has fulfilled its
responsibilities proceed with construction in the most feasible and economical
manner, financing the cost in the 1965 State Highway Safety and Betterment Program.
It is understood that the City may discharge its construction obligations as out-
lined herein in any canner as.they nay elect. In the event the City desires the
State to include their portion of the work in the State's construction contract,
the State Highway Engineer is hereby authorized to enter into agreement with the
City for such work and its oast as may be agreed upon.
This Order sbAll become operative upon acceptance by the City of Wichita Falls and
if not accepted within 90 days of the date hereof shill be automatically canceled.
