Ord 2444 9/3/1968 T. /I - ORDINANCE NO. /1 ORDINANCE CLOSING HEARING AND FINDI G CERTAIN BUILDINGS AND/OR STRUC- TURES TO BE DANGEROUS; COMMANDING PROPERTY OWNERS TO REPAIR, VACATE, OR DEMOLISH SAID BUILDING AND/OR STRUCTURE WITHIN THIRTY (30) DAYS OF THE DATE OF THIS ORDINANCE AND DECLARING AN EMERGENCY. WHEREAS, the Building Inspector of the City of Wichita Falls, acting under the provisions of Ordinance No. 2388 enacted by the Board of Aldermen of the City of Wichita Falls on February 12, 1968, notified in writing by certified mail the following list of property owners of the property shown, that the building or buildings on the premises had been classified as a dangerous building and that certain correc- tions were needed to_be made or the building demolished. Charles 509 Wood Sadie Dixon 812 Wood Richard Powell 1009 Wood Swanson Bennett 1023 Wood WHEREAS, such property owners above have not complied with the directive of the Building Inspector within the sixty days allotted in Ordinance No. 2388; and, WHEREAS, the Board of Aldermen passed and approved Resolution No. 837 on August 20, 1968, which resolution set the date of September 3, 1968 at 2:30 P.M. as the date of a Public Hearing for the property owners listed above to appear before the Board of Aldermen to show cause why the building or structure reported to be a dangerous build- ing should not be repaired, vacated, or demolished in accordance with the Statement of Particulars set forth in the Building Inspector' s notice; and, • and said hearing was continued until all desiring to be heard were given full and fair opportunity to be heard and the Board of Aldermen of the City of Wichita Falls having fully considered all proper matters, is of the opinion that the said Hearing should be closed. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS, THAT: Said hearing be, and the same is hereby, closed, and the said protests and objections, and any and all other protest objections whether enumerated or not, be and the same are hereby, overruled. From the evidence presented in the aforementioned Public Hearing by the property owners appearing and the Building Inspector of the City of Wichita Falls, the building and/or structure at the • location listed above with the corresponding property owner is found to be a dangerous building as defined in Ordinance No. 2388 and the property owners listed or any other person having an interest in said building as shown by the tax records of the City of Wichita Falls are • hereby commanded to repair, vacate, or demolish the building and/or structure in accordance with the Statement of Particulars set forth in the Building Inspector' s notice. The property owner listed or any other person having an interest in said building as shown by the tax records of the City of Wichita Falls is further commanded to repair, vacate, or demolish in accordance with the Statement of Particulars set forth in the Building Inspector' s notice within thirty (30) days from the date of this ordinance. The fact that the repair, vacation, and/or demolition of dangerous buildings is being delayed pending the taking effect of this ordinance creates an emergency for the immediate preservation of the public business place, property, health, safety and general welfare of the public which requires that this ordinance shall become effective from and after the date of its passage and is accordingly • so ordained. • WHEREAS, the above listed property owners have been notified by certified mail by the Building Inspector of the time and date of said Public Hearing and said Public Hearing was had and held at the time and place fixed therefor, to-wit, on the 3rd day of September 1968, at 2:30 P.M., in the Council Chambers of the City of Wichita Falls, Texas, and at such Public Hearing, the following protests and objections were made, to-wit: e-27,G protested that protested that _ protested that _ protested that protested that protested that protested that protested that protested that protested that protested that rc, protested that protested that protested that 3 _ The provisions of this ordinance shall be included and incorporated in the Code of Ordinances of the City of Wichita Falls as an addition or amendment thereto, and shall be appropriately re- numbered to conform to the uniform numbering system of the Code.
