Res 593 3/8/1965RESOLUTION NO. _5-93 BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS: That the attached form of Agreement employing the law firm of Humphrey, Gibson & Darden of Wichita Falls, Texas, to perform legal services in connection with the acquisition of land necessary for the construction of the City of Wichita Falls Reservoir at the Halsell Site in Clay County, Texas, be, and the same is hereby, approved and the City Manager is direc- ted and authorized to execute same for and on behalf of the City of Wichita Falls. PASSED AND APPROVED this day of March, 1965. if / OMayor ATTEST: c7V,771-0 City Clerk e • C 0 I1TRACT THE STATE OF TEXAS CO= OF WICHITA THIS COI:T:ACT, Enered into the day of ::arch, 1935, by and between THE CITY 017 WICHITA FALLS, a Nunicipal Corer- ation, created by and oprating pursuant to a Home Rule Charter, hereinafter called "The City", and the firm of HD=EY, Cl2SO:1 DARDEN, a law partnership, composed of Lee Humphrey, Frank Gibson and Lynn Darden, hereinafter called "The Fire; WIT !: ESSETH The City hereby retains and employs The Firm to handle the :- atter of acquisition of the acreage necessary for the construction of The City of Wichita Falls Reservoir at the alsell site in Clay County, Texas, and The Firm accepts such employment and agrees to faithfully and expeditiously perforz., upon and subject to the following terms and conditions, to-wit: I It being understood that the original negotiations for land acquisition are being carried out by others under the s.;por- vLsion of The City, The Firm is to stand ready to provide such assistance as may be requested by The City in assisting with such negotiations, examining abstracts and attending to all of the details in closing land purchases. II In such instances as negotiations between City represen- tatives and landholders at the site shall fail, The Firm will institute condemnation p-oceedni ; and posecute s :::e fully completely to Final Judent, through all stel-,s of C;ormisioners ' Hear-Inc; and award, trial in the County Court, and Lepal. III For its services in this regard, The firm shall be paid the sunl of Twenty Five and no/100 Dollars (ç25.00) per hour for each hour devoted to the acquisition of the site lands, by con- demnation or otherwise, and the sum of Fifty Cents ( .500 per page for abstract examination and the rendition of Opinions as to title.
