Res 795 3/25/1968I RESOLUTION NO. WHEREAS, the City of Wichita Falls and Wichita County Water Improvement District No. 2 have contracted with the U. S. Army Corps of Engineers for the reconstruction of the dam and spillway at Lake Kemp, and under said contract it is necessary to acquire the interests in land as follows : FIRST TRACT: The fee simple title in and to that certain tract of land containing approximately 433 acres , more or less , which has been designated on maps by the Corps of Engineers , and which are now on file in the office of the Director of Water Development. This tract of land is in the vicinity of the present dam and spillway at Lake Kemp in Baylor County, Texas . SECOND TRACT: A flowage easement on all that portion of the lands of Waggoner around the perimeter of Lake Kemp in Baylor County, Texas, excepting the first tract above, said lands lying below elevation 1163 feet m.s . l. and adjoining that land described and acquired by easement, for Lake Kemp, from W. T. Waggoner by contract dated January 16th, 1922 , and recorded in Volume 62 , Page 22 of the Records of the County Clerk of Baylor County, Texas, comprising approximately 7500 acres, more or less . NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS : That it is found to be necessary to obtain the above described interests in land for the reconstruction of the Lake Kemp dam and spillway, and for the operation and maintenance of Lake Kemp as a reservoir for water for municipal, irrigation and flood control purposes ; in the event such interests cannot i be purchased by negotiation, the City Manager is directed to proceed to condemn such interests in land.
