Res 2511 4/22/1980RESOLUTION NO. RESOLUTION APPROVING FIRST AMENDMENT TO WATER PURCHASE CONTRACT WITH RED RIVER AUTHORITY OF 41 TEXAS FOR WATER SYSTEM AT LAKE ARROWHEAD. BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS, THAT: That certain First Amendment to a Water Purchase Contract dated May 1, 1979, a copy of which is attached hereto, between the City of Wichita Falls and Red River Authority of Texas, for a water supply and distribution system serving water users within Lake Arrowhead area, is hereby approved, and the City Manager is authorized to execute the same for the City of Wichita Falls. PASSED AND APPROVED THIS THE 22nd day of April, 1980. ATTEST: City Clerk M A Y O R FIRST AMENDMENT TO WATER PURCHASE CONTRACT This First Amendment to Water Purchase Contract is made and entered into this day of , 1980, by and between the City of Wichita Falls, Texas, hereinafter called "City", and the Red River Authority of Texas hereinafter referred to as "Authority". WITNESSETH WHEREAS, by Resolution 2320, adopted on April 3, 1979, the Board of Aldermen of the City of Wichita Falls approved a certain Water Purchase Con- tract with Red River Authority of Texas; and, WHEREAS, the parties hereto do hereby desire to further amend such contract. NOW, THEREFORE, for and in consideration of the mutual covenants herein contained, the parties hereto do hereby agree as follows: 1. Section 8.0 of said contract shall read as follows: "Lake Arrowhead is a primary water source facility for the City. Improvements at Lake Arrowhead are not now served by a waste water collection and treatment system. Septic tanks are required by City lease agreement in accordance with State Health Department and City standards. The City will periodically conduct a septic tank inspection program. Upon notification by the City, the Authority will discontinue water service to any customer who does not maintain their septic tank and system in accordance with State Health Department and City standards." Except insofar as such water purchase contract is amended, the same shall remain in full force and effect.
