AN ORDINANCE ABANDONING THE CONSTRUCTION OF IMPROVEMENTS ON
PORTIONS OF STREETS AT LOCATIONS OUT OF THE 1968 ASSESSMENT
PAVING PROGRAM, DELETING SAME FROM CONTRACT WITH ZACK BURKETT
CONSTRUCTION COMPANY, GRAHAM, TEXAS; GIFFORD-HILL & COMPANY,
INC., WICHITA FALLS, TEXAS, AND CANCELLING THE ASSESSMENT
LIENS LEVIED AGAINST ABUTTING PROPERTIES.
WHEREAS, by Ordinance 2408, dated April 8, 1968, and Ordinance 2458,
• dated October 14, 1968, the Board of Aldermen of the City of Wichita Falls,
Texas, a municipal corporation, determined the necessity of paving and con-
structing other improvements on portions of streets designated as a portion
of the 1968 Assessment Paving Program in Wichita Falls, and a notice of such
action, in accordance with Article 1.220A of Revised Civil Statutes of Texas,
was filed with the County Clerk and was recorded in Volume 589, Page 718 and
Volume 593, Page 643 of the Deed of Trust Records of Wichita County, and;
WHEREAS, by Ordinance 2436, dated August 20, 1968, and Ordinance 2472,
dated January 21, 1969, the Board of Aldermen of the City of Wichita Falls,
Texas, levied assessments against abutting properties and their owners to
pay a part of the cost of such improvements, and;
WHEREAS, on the portions of streets hereinafter mentioned, certain
streets have been closed or there is insufficient participation by homestead
owners for the improvements to be constructed on such streets, and;
WHEREAS, Zack Burkett Construction Company and Gifford-Hill Company,
Inc. , who have contracted with the City for the construction of said improve-
ments, have consented to the abandonment of the improvements on such portions
of streets.
_NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
I.
The improvements on the following portions of streets shall be aban-
doned, and same shall be deleted from the contract with Zack Burkett
•
Construction Company, Graham, Texas, and Gifford-Hill Company, Inc. , Wichita
Falls, Texas, and the assessment liens heretofore levied against properties
abutting such portions of streets are hereby cancelled, to-wit:
ALABAMA AVENUE: From the west property line of the
alley west of Colquitt Road to the
west property line of Colquitt Road.

HUDSON AVENUE: From the west property line of the
alley west of Colquitt Road to the
west property line of Colquitt Road.
LAFAYETTE AVENUE: From the west property line of the
alley west of Colquitt Road to the
west property line of Colquitt Road.
LEXINGTON AVENUE: From the west property line of the
alley west of Colquitt Road to the
west property line of Colquitt Road.
REVERE AVENUE: From the west property line of the
alley west of Colquitt Road to the
west property line of Colquitt Road.
TWENTY-SECOND STREET: Abutting Lot 17, Block 2, Ed Wilson
Addition; Lot 18, Block 2, Ed Wilson -
Addition; Lot 19, Block 2, Ed Wilson
Addition; Lot 10 & W. 35' of Lot 9,
Block 3, Ed Wilson Addition; W. 35'
of Lot 8 & E. 15' of Lot 9, Block 3,
Ed Wilson Addition.

The City Clerk is hereby directed to file a notice of this ordi-
nance with the County Clerk of Wichita County Texas, for the purpose of
releasing the assessment liens against such properties abutting the por-
tions of streets set out above.

NOTICE OF RELEASE OF ASSESSMENT

WHEREAS, the Board of Aldermen of the City of Wichita Falls, Texas,
a municipal corporation, has heretofore ordered an assessment against certain
property abutting the list of streets listed below, and,
WHEREAS, notices of said assessment were dated April 8, 1968, and
October 14, 1968, and recorded in Volume 589, Page 718 and Volume 593,
Page 643 of the Deed of Trust Records of Wichita County, Texas, to which
reference is here made for all purposes.
WHEREAS, by Ordinance No. v — dated April 7, 1969, the

Board of Aldermen released such assessments against the properties abutting
the following portions of streets, to-wit:
ALABAMA AVENUE: From the west property line of the
alley west of Colquitt Road to the
west property line of Colquitt Road.
HUDSON AVENUE: From the west property line of the
alley west of Colquitt Road to the
west property line of Colquitt Road.
LAFAYETTE AVENUE: From the west property line of the
alley west of Colquitt Road to the
west property line of Colquitt Road.
LEXINGTON AVENUE: From the west property line of the

REVERE AVENUE: From the west property line of the

NOW, THEREFORE, notice is hereby given that such assessment liens
levied against the properties abutting on the above set out portions of
streets have been cancelled.
