Ord 2511 6/17/1969 ORDINANCE NO. a1/45// // AN ORDINANCE REGULATING THE STORAGE AND HANDLING OF AGRICULTURAL ANHYDROUS AMMONIA; ADOPTING THE ANI STANDARD NO. M-1 DATED NOVEMBER 19, 1968; PROVIDING FOR PERMITS; PROVIDING FOR ENFORCEMENT BY THE FIRE MARSHALL; PROVIDING FOR A PENALTY. BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS, THAT: SECTION 1. There is hereby adopted for the purpose of prescribing standards governing the storage and handling of Agricultural Anhydrous Ammonia, that certain book known as "Standards for the Storage and Handling of Agricultural Anhydrous Ammonia" , ANI Standard No. M-1, dated November 19, 1968, pre- pared by the Agricultural Nitrogen Institute, successor to the Agricultural Ammonia Institute, of which book a copy has been and is now filed in the Office of the City Clerk, and the same is hereby adopted and incorporated as fully as if set out at length herein, the provisions thereof shall be controlling within the corporate limits of the city. SECTION 2 . No person shall install any tank, con- tainer or equipment for the storing and/or consumption of Agricultural Anhydrous Ammonia, or install any piping for the transfer of Agricultural Anhydrous Ammonia on any premises within the city until such person shall have secured a permit to do so from the city. Prior to the installation of any Agricultural Anhydrous Ammonia installation within the city, plans and specifications for such installation shall be submitted to the Fire Marshall ' s Office; if such plans and specifications meet the standards set out in Section 1 above, the Fire Marshall shall issue a permit for the construction, which shall be in addition to any other permits required by the Ordinances of the City of Wichita Falls. Final approval will follow a physical inspection by the Fire Marshall of the completed installation. SECTION 3. Should any person, firm or corporation fail to comply with the safety standards set out in the ANI Standard M-1 at any time, their permit shall be revoked until such violations have been corrected. Any person, firm or corpora- tion who stores and handles Agricultural Anhydrous Ammonia with- out obtaining a permit shall be punishable by a fine of not less than five dollars ($5.00) or more than two hundred dollars ($200.00) . Each day that a violation continues shall consti- tute a separate offence. • - 2 - SECTION 4. The provisions of this ordinance shall be included and incorporated in the Code of Ordinances of the City of Wichita Falls, Texas, as an addition or amendment thereto, and shall be appropriately renumbered to conform to the uniform numbering system of the code.
