RESOLUTION APPROVING AGREEMENT APPORTION-
ING EXTRATERRITORIAL JURISDICTION BETWEEN
WICHITA FALLS AND BURKBURNETT.
WHEREAS, the extraterritorial jurisdiction of the City of
Wichita Falls, Texas and the extraterritorial jurisdiction of
the City of Burkburnett, Texas overlap, and the two cities
desire to apportion such overlapped area by mutual agreement
of the governing bodies of such cities, in accordance with
Section 3.B of Article 970a, Vernon' s Annotated Civil Statutes.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF
THE CITY OF WICHITA FALLS, TEXAS, THAT:
That certain agreement, a copy of which is attached hereto,
whereby the cities of Wichita Falls and Burkburnett apportion
the overlap of their extraterritorial jurisdiction, is hereby
approved, and the City Manager is authorized to execute the same
for the City of Wichita Falls.

AGREEMENT APPORTIONING EXTRATERRITORIAL JURISDICTION
This agreement made and entered into this the 10th day of
January, 1973, by and between the City of Wichita Falls, Texas and the
City of Burkburnett, Texas.
WITNESSETH:
Whereas, the extraterritorial jurisdiction of the City of
Wichita Falls overlaps an area under the extraterritorial jurisdiction of
the City of Burkburnett, and the two cities desire to apportion such over-
lapped area by mutual agreement of the governing bodies of such cities, in
accordance with Section 3-B of Article 970a, Vernon's Annotated Civil
Statutes.
Now, therefore, for and in consideration of the mutual covenants
herein contained, the City of Wichita Falls, Texas and the City of Burkburnett,
Texas acting by and through the undersigned officers, duly authorized by
resolutions of the governing bodies of the respective cities, do hereby agree
as follows:
All of that portion of the overlapped area lying north of the
following described boundary line, and all of the R. Brown Survey, A-519
and the J. Aldridge Survey, A-4, shall be within the extraterritorial
jurisdiction of the City of Burkburnett, to-wit:
Beginning at the intersection of the 3.5 mile extra-
territorial jurisdiction line of the City of Wichita
Falls with the west line of the H. Hastie Survey, A-98;
Thence south along said west line of the H. Hastie
Survey and the east line of the R. Brown Survey, A-519
and the J. Aldridge Survey, A-4 to the southeast
corner of said Aldridge Survey; Thence west along the
south line of the said J. Aldridge Survey, A-4 and
the south line of the J. Rector Survey, A-247 to the
southwest corner of said Rector Survey; Thence north
along the west line of the said J. Rector Survey to
a point, said point being the intersection of the
south line of the J. Robertson Survey, A-252 extended
east and the said west line of the said J. Rector
Survey; Thence west to the southeast corner of the
said J. Robertsoni Survey, A-252; Thence continuing
west along the south line of the said J. Robertson
Survey to the southwest corner of said survey; Thence
north along the west line of the said J. Robertson
Survey to a point in the south line of a 6' strip of
land annexed by the City of Burkburnett, said point being
in the Burkburnett city limits line; Thence west along
the Burkburnett city limits line, being the south line
of the annexed 6' strip, to its intersection with the
east line of the C. T. Ry. Co. Survey, A-50; Thence
south along the east line of said C. T. Ry. Co. Survey
to its southeast corner; Thence west with the south line
of said C. T. Ry. Co. Survey, A-50 to the most westerly
northwest corner of W. A. Grandy Survey, A-357; Thence south
along the most westerly west line of the said Grandy Survey

to the southwest corner of said W. A. Grandy Survey, A-357;
Thence south to the south line of the J. Johnson Survey,
A-500; Thence west with the south line of said J. Johnson
Survey to its southwest corner, said corner being also the
northwest corner of the F. Peterswick Survey, A-244; Thence
south with the west line of the said F. Peterswick Survey to
its intersection with the one mile extraterritorial
jurisdiction line of the City of Burkburnett; Thence west
with the said one mile extraterritorial jurisdiction line
of Burkburnett to its intersection with the 3.5 mile extra-
territorial jurisdiction line of the City of Wichita Falls.
All of that portion of the overlapped area lying south of the
above described boundary line, and a parcel out of the most western north-
west corner of the W. A. Grandy Survey, A-357 lying south of such line, shall
be within the extraterritorial jurisdiction of the City of Wichita Falls.
A plat showing the apportionment of the overlapped area is
attached hereto and marked Exhibit A.
In witness whereof, the respective cities have caused this
agreement to be executed as of the day and year first above set out.
