Res 1374 1/16/1973RESOLUTION NO. /i BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS, THAT: The provisions of Minute Order No. 66992 passed by the Texas Highway Commission on December 11 , 1972, a copy of which is attached hereto, and is made a part thereof, providing for assistance in the widening and resurfacing of the pavement on Midwestern Parkway (Call Field Road) from Fairway Boulevard eastward to McNiel Avenue are acceptable to the City of Wichita Falls. It is hereby ordered that the City of Wichita Falls cooperate with the Texas Highway Department and fulfill its obligation so stipulated in said Minute Order as being the responsibility of the City. BE IT FURTHER RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS, THAT: The City of Wichita Falls desires the State Highway Department to include the City's portion of the work in the State's construction contract, and the City Manager of the City of Wichita Falls is hereby authorized to enter into a fixed sum agreement with the State Highway Department for such work and its cost as may be mutually agreed upon. C MAYOR ATTEST: City Clerk Perm I t, a>r DeNtt sat 1561.6-11111-2m In Quint MINUTE ORDER WICHITA__-__County Page of—2—Pages District No.__ 3 WHEREAS, in WICHITA COUNTY on Midwestern Parkway, the City of Wichita Falls has requested assistance in Widening Pavement and Resurfacing from Fairway Boulevard East to McNeil Avenue, a distance of approximately 0.8 mile; and WHEREAS, Midwestern Parkway is included in the Federal-Aid Metropolitan System and the requested improvements have been tentatively accepted for participation in the Federal Metropolitan Program; and WHEREAS, it is the desire of the Texas Highway Department to assist the City of Wichita Falls in such work; NOW, THEREFORE, the State Highway Engineer is directed to tender the following proposal to the City of Wichita Falls for the development of such a project: Provided the City will: 1. Prepare construction plans and specifications for the proposed improvements. 2. Provide for the adjustment of utilities, the construction of storm sewers, driveways and sidewalks, all as may be required, and agree to make such installations in accordance with governing policies and regulations of the Highway Department. Maintain all of the work constructed as a part of the project and agree to regulate traffic, prohibit all parking and pre- vent encroachment on the right . i czay. 4. Adopt and enforce such ordinances and regulations as may be necessary for proper operation of the project. The Texas Highway Department will provide for Widening Pavement and Resurfacing at an estimated cost of $77,000, subject to the eligibility of the proposed work for financing with Federal Metropolitan Funds. Upon acceptance of the provisions of this Order by the appropriate officials of the City of Wichita Falls, IT IS ORDERED that Midwestern Parkway extendingfromMetropolitanHighway27 (Fairway Boulevard) East to Metropolitan Highway24 (Kemp Boulevard), a distance of approximately 1.5 miles, be and is hereby designated as a METROPOLITAN HIGHWAY and the State Highway Engineer is directed to enter into agreement with the City covering the details of the proposed im- provements, to proceed with the engineering development of the project and after the City has fulfilled its responsibilities, proceed with construction as authorized herein in the most feasible and economical manner, financing the cost in the Federal Metropolitan Program. It is understood that the City may discharge its construction obligations as out- lined herein in any manner as they may elect. In the event the City desires the State to include their portion of the work in the State's construction contract, the State Highway Engineer is hereby authorized to enter into agreement with the City for such work and its cost as may be agreed upon. This Order shall become operative upon acceptance by the City of Wichita Falls and if not accepted within 90 days of the date hereof, the action herein con- tained shall be automatically cancelled.
