I1 BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS , TEXAS , THAT: The provisions of Minute Order No. 66222 passed by the Texas Highway Commission on May 1 , 1972, a copy of which is attached hereto, and is made a part thereof, providing for assistance in improving the signal- ization and channelization of the pavement and its support of Midwestern Parkway and Taft Boulevard and the Intersection of Farm to Market Road 369, Farm to Market 2380 and Kemp Boulevard are acceptable to the City of Wichita Falls. It is hereby ordered that the City of Wichita Falls cooperate with the Texas Highway Department and fulfill its obligations so stipulated in said Minute Order as being the responsibilities of the City. BE IT FURTHER RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS , TEXAS, THAT: The City of Wichita Falls , Texas , desires the State Highway Department to include the city's portion of the work in the State's con- struction contract, and the City Manager of the City of Wichita Falls is hereby authorized to enter into a fixed sum agreement with the State High- way Department for such work and its cost as may be mutually agreed upon. Furnish all required light of way clear of obstructions and free of cost to the S:-ate with acquisition procedures to be in accordance with applicable Federal and State laws governing the acquisition policies :"or acquiring real property. 2. Prepare construction plans and specifications for the proposed improvements. 3. Provide for the adjus::r:.ent of utilities, the construction of curb and gutter, stor:l sewers, driveways, sidewalks, etc. , all as may be required anc. agree to make such installations in accordance with eoverring pnlietPR and regu latf of the nighway Department. Boulevard, extending from Farm to Market Road 359, N.erth to Midwestern Per?way, n distance of approximately 0.9 mile, and Midwestern Par!-i..y, extending from Fee.p Boulevard, East to end of Metropolitan Highway 7 at Herrin, Avenue, a dL.staace of a,,pro:dnately 2.4 miles, be and are hereby designated as METI.OPOLITA i iGliMS and the State Highway Engineer is directed to enter into agreement lath the City of Wichita Falls covering the details of the proposed i'provem:_nts, to proceed with the engineering develoimeet of the project and after the City has fulfilled its responsibilities, proceed with construction as authorized herein in the most feasible and economical manner, financing the cost in the Federal TOPICS Program. It is understood that the City may discharge its construction obligations as out- lined herein in any manner as they may elect. In the event the City desires the State to include their portion of the work in the State's construction contract, the State Highway Engineer is hereby authorized to enter into agreement with the City for such work and its cost as may be agreed upon. This Order shall become operative upon acceptance by the City of Wichita Falls and if not accepted within 90 days of the date hereof, the action herein contained shall be automatically cancelled.
