Res 1516 3/9/1974RESOLUTION NO. 1516 RESOLUTION REQUESTING THAT UNITED STATES CON- DEMN FLOWAGE EASEMENT FOR LAKE KEMP ON LAND OWNED BY WILMER GLEGHORN IN BAYLOR COUNTY, TEXAS. WHEREAS, on October 31st, 1972 the Board of Aldermen adopted Resolution No. 1360, determining the necessity of acquiring a flowage easement from elevation 1, 153 feet above mean sea level to elevation 1,163 feet above mean sea level on those certain tracts of land out of the B. R. Milam Survey, Abstract No. 275 and the B. R. Milam Survey, Abstract No. 276, in Baylor County, Texas, being the same land conveyed by Finis J. Hulse and wife to Wilmer Gleghorn by deed recorded in Volume 118, Page 29, Baylor County Deed Records. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS , TEXAS, THAT: The United States of America, acting through the Army Corps of Engineers is hereby requested to condemn such flow- age easement on the above described property of Wilmer Gleg- horn; the City of Wichita Falls and the Wichita County Water Improvement District No. 2 shall together pay all compensa- tion and damages recovered by the said Wilmer Gleghorn in said condemnation suit, together with all of the costs of such suit; the City of Wichita Falls shall be responsible for 66.11% of such compensation, damages and costs, and it is understood that Wichita County Water Improvement District No. 2 will be responsible for 33. 89% of same.
