Res 1592 10/22/1974RESOLUTION NO. btl BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS, THAT: The provisions of Minute Order No. 69334 passed by the Texas Highway Commission on October 1 , 1974, a copy of which is attached hereto, and is made a part thereof, providing for assistance in the reconstruction and modernization of the existing roadway on Midwestern Parkway from McNeil Avenue to Maplewood Avenue, and modernization of the traffic signals at the intersection of Midwestern Parkway and Kemp Boulevard are acceptable to the City of Wichita Falls. It is hereby ordered that the City of Wichita Falls cooperate with the Texas Highway Department and fulfill its obligation so stipulated in said Minute Order as being the responsibilities of the City. BE IT FURTHER RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS, THAT: The City of Wichita Falls desires the State Highway Department to include the City's portion of the work in the State's construction contract, and the City Manager of the City of Wichita Falls is hereby authorized to enter into a fixed sum agreement with the State Highway Department for such work and its cost as may be mutually agreed upon. MINUTE ORDER WICHITA untY Page, 1,of 2 Pages I O M.rict No. WHEREAS, in WICHITA COUNTY, the City of Wichita Falls has requested assistance in Reconstruction of Grading, Structures and Surfacing and Signalization on Midwestern Parkway from McNeil Avenue to Maplewood Avenue, a distance of approximately 1.1 miles; and WHEREAS, Midwestern Parkway is included in the Urban System; and WHEREAS, it in the desire of the Texas Highway Department to assist the City of Wichita Falls in such work; NOW, THEREFORE, the State Highway Bi,, ineer is directed to tender the following proposal to the City of Wichita Falls: Provided the City will: 1. Furnish all required right of way clear of obstructions with acquisition procedures to be in accordance with applicable Federal and State laws g imr-nfng the acquisition policies for acquiring real property. 2. Pruvs.de for the adjustment of utilities, the construction of continuous curb and gutter, storm sewers, driveways and sidewalks, all as may be reviired and all in accordance with governing policies and regulations of the Highway Department. 3. Adopt and enforce such ordinances and reui.ationa as may be necessary for propff-z op Subject to the availability of Federal-aid Urban System funds and the eligibility of the proposed work for financing with said funds, the- Texas Highway Department will: 1. Prepare construction plans and specifications. 2. Provide Relocation Assistance as may be required and determined to be eligible under the Relocation Assistance Program at an estimated cost of 100. 3. Provide for Reconstruction of Grading, Structures and Surfacing and Signaliza- ti.on at an estimated coat rsf $627300 as Azthorized in the Texas Highway Department 1974 Urban System Program. Upon acceptance of the provisions of this Order by the appropriate officials of the City of Wichita Falls, the State highway Engineer is directed to proceed with the Relocation Assistance Program, to enter into agreement with the City covering the details of the proposed improvements, to proceed with the engineering development of ' the project and after the City has fulfilled its responsibilities, to proceed with construction as authorized herein in the most feasible and economical manner. it is understood that the City may discharge its construction obligations as outlined herein in" any manner as they may elect. In the event the City desires the State to include Its portion of the work in the State's construction contract, the State Highway Engineer is hereby authorized to enter into agreement with the City for such work and its cost as may be agreed upon. This Order shall become operative upon acceptance by the City of Wichita Falls and if not accepted within 90 days of the date hereof, the action herein contained shall be automatically cancelled.
