Res 1744 12/2/1975V RESOLUTION NO. /AW RESOLUTION APPROVING CONTRACT WITH THE TEXAS MUNICIPAL LEAGUE PROVIDING FOR A SOCIAL SERVICES DEMONSTRATION PROJECT. BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS , TEXAS , THAT: That certain contract, a copy of which is attached hereto, between the City of Wichita Falls and the Texas Municipal League, providing for the improvement of the social service delivery system in Wichita Falls by the establishment of a Community Council, is hereby approved, and the City Manager is authorized to execute the same for the City of Wichita Falls. PASSED AND APPROVED this the 18th day of November, 1975. i A Y O R 7 RO EM ATTEST: DEPUTY c TY CLERK CONTRACT THIS CONTRACT, by and between Texas Municipal League, having its principal place of business Austin, Texas, hereinafter called "League," and City of Wichita Falls State of Texas, hereinafter called "The City." WITNESSETH: WHEREAS League desires to have the City perform certain services and deliver to League certain items set forth in the Detailed Work Program, hereinafter referred 1 to as Exhibit "A" and The City desires to undertake the performance of said services and delivery of such items. NOW THEREFORE the parties hereby covenant and agree as follows: Article I - Scope of Work The facilities City shall( furnish except as otherwise the necessary specifiedpersonnelherein and, materials otherwiseservicesdo all, equipment, thin gs necessary for or incident to the performance of the work set forth in Exhibit A, attached hereto and made a part hereof. Article II - Period of Performance The services to be performed by The City shall commence on December 1, 1975 and shall be completed by November 30, 1976 Article III - Consideration and Payment A. The estimated total project costs for the performance of this contract is 24, 090 The City agrees to bear without reimbursement by the i League 17%, percent of the total project cost for performance under. Such cost sharing shall be effected as set forth in Paragraph B below. B. Invoices shall be rqihmitted quarterly to the League in. an original and one (1) copy and shall show the total project cost incurred for the period for which the voucher or invoice is submitted, the cumulative total of costs incurred through the billing period, and the percentage of costs to be reimbursed by the League. However, the League is not obligated to reimburse the City A in excess of W3 percent of total project cost. The League shall not be obligated to reimburse the City for the League's share of the costs in excess of $19, 900 nor is the City obligated by this contract to expend his own funds in excess of $4, l00 Article IV - Reports The City agrees to provide the League reports specified under this contract to meet management and financial reporting requirements of the Department of Health, Edt a Welfare. Article V - Federal ucaion Reports nd Act In the event that it is a contractual requirement to collect information from tenen or more public respondent, the Federal Reports Act (44 U.S.C. 3509) shall apply to this contract and The City shall obtain through League the required Office of Management and Budget Clearance before making public contracts for the col- alection of data or expending any funds. The authority to proceed with the col- lection of data from public respondents and expend funds shall be in writing signed by an authorized representative of League. Article VI - Background Material The City shall, if required by the League, deliver to the League such background material as the League may require, provided such material were developed opeor I 3- acquired in the performance of the contract. This material may include, but is not limited to, origina.l papers, notes and drafts, printed material, pamphlets, and drawings provided that a copy of such material may be retained by The City. With respect to the foregoing listed provisions, all notices and forms to be sent to or by The City Official or the Government and c:'l approvals to be made by The City Official or the Government are to be made to or by League; and all rights, except rights to patents, enuring to the benefit of the Government shall also enure to the benefit of League.
