RESOLUTION COMMENTING UPON AN ORDER OF THE
UNITED STATES DISTRICT COURT FOR THE DIS-
TRICT OF COLUMBIA CONCERNING A DEFINITION
FOR NAVIGABLE WATERS AS USED IN THE FEDERAL
WATER POLLUTION CONTROL ACT AMENDMENTS OF
1972 (PUBLIC LAW 92-500) .
WHEREAS , it is imperative that pollution from dredging
and filling operations in waters of the United States be elim-
inated; and,
WHEREAS , the prevention of water pollution intended by
the Federal Water Pollution Control Act Amendments of 1972 can
best be satisfied if the public authorities issuing permits
for dredging and filling operations are knowledgeable of local
conditions; and,
WHEREAS , the State of Texas has regulatory agencies which
are now capably performing such functions, and any additional
permit system by the Federal Government would be duplication
and waste.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN
OF THE CITY OF WICHITA FALLS, TEXAS , THAT:
It is recommended that the applicable Federal laws and/or

regulations be amended to provide that the United States Army
Corps of Engineers have jurisdiction to issue permits for dredg-
ing and filling operations in those waters which are used for
transportation of material in interstate commerce, and that the
State of Texas have jurisdiction to issue permits for dredging
and filling operations in all waters within its boundaries ex-
cept for the waters on which the Corps of Engineers has juris-
diction.
