ORDINANCE ACCEPTING IMPROVEMENTS ON JOHNSON ROAD FROM
FAIRWAY BOULEVARD TO RAIDER DRIVE, NINTH STREET FROM
BEVERLY DRIVE TO HAYES STREET, IN THE CITY OF WICHITA
FALLS, TEXAS, AS DESIGNATED IN ORDINANCE NO. 2460;
DECLARING THE CONTRACT WITH TIMMINS AND ANDERSON CON-
TRACTORS, FOR THE CONSTRUCTION OF SAID IMPROVEMENTS
FULLY COMPLETED AND PERFORMED; DIRECTING THE ISSUANCE,
EXECUTION, AND DELIVERY OF CERTIFICATES IN EVIDENCE
OF SPECIAL ASSESSMENTS LEVIED AFTER GIVING EF ECT TO
SUNDRY CREDITS HEREIN AUTHORIZED AND ALLOWED AGAINST
SOME OF SAID ASSESSMENTS; DIRECTING THE CITY CLERK TO
ENGROSS AND ENROLL THIS ORDINANCE BY COPYING THE CAPTION
OF SAME IN THE MINUTE BOOK OF THE BOARD OF ALDERMEN OF
THE CITY OF WICHITA FALLS, TEXAS, AND BY FILING THE COM-
PLETE ORDINANCE IN APPROPRIATE ORDINANCE RECORDS OF SAID
CITY; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City of Wichita Falls, Texas, has heretofore entered
into a contract with Timmins and Anderson Contractors, Wichita Falls, Texas,
for the making and constructing of certain street improvements on the here-
inafter described portions of streets, avenues, and public places in said
City, to-wit:
JOHNSON ROAD: From the west property line
of Fairway Boulevard to the
west property line of Raider
Drive.
NINTH STREET: From the east property line of
Beverly Drive to the west property
line of Hayes Street.
WHEREAS, by sundry proceedings heretofore passed by the Board of
Aldermen of the City of Wichita Falls, Texas, including Ordinance No. 2479
a portion of the cost of said improvements was levied and assessed against
the respective properties abutting on each of. the above assessed portions of
streets, avenues and public places and against the real and true owners there-
of; and,
WHEREAS, the Board of Aldermen of the City of Wichita Falls, Texas,
has upon review, found and determined that, in some instances, in order to
effect substantial justice and equality, it is desirable and necessary to grant
and issue certain credits against some one or more of the assessments levied by
Ordinance No. 2479 and,
WHEREAS, the street improvements hereinabove mentioned have been com-
pleted upon each of the portions of streets, avenues, and public places herein-
above described, and have been inspected and found to be in complete accordance
with the contract therefor:
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
I.
The improvements on each of the portions of streets, avenues, and
public places hereinabove described be, and they are hereby, accepted; and the
- contract with reference thereto be, and is hereby, found and declared fully
completed and performed.

II.
The assessments as levied by Ordinance No. 2479 shall be computed
for each property owner and the same together with the Engineer's roll on
Johnson Road and Ninth Street herein accepted shall delivered to the Tax
Assessor-Collector, and he shall prepare statements which shall be sent to
the property owners.
III.
The City Clerk is hereby directed to engross and enroll this Ord-
inance by copying the caption of same in the Minute Book of the Board of Alder-
men of the City of Wichita Falls, Texas, and filing the complete Ordinance in
the appropriate Ordinance Records of said City.
IV.
This Ordinance shall take effect and be in full force and effect
from and after the date of its passage.
