Ord 2585 4/21/1970 ORDINANCE NO. a.ICO - ORDINANCE AMENDING SECTION 7-15 OF THE CODE OF ORDINANCES BY REQUIRING A BOND OR DEPOSIT PRIOR TO THE ISSUANCE OF A DEMOLITION OR MOVING PER- MIT; AMENDING THE AMOUNT OF THE FEE FOR A MOVING PERMIT; DECLARING AN EMERGENCY. BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS, THAT: SECTION 1. Section 7-15 of the Code of Ordinances is hereby amended by adding Subsection (2 .1) which shall read as fol- lows: " (2 . 1) Amend Section 106 by adding Subsection 106.7, which shall read as follows : ' 106.7 - Demolition Permit; Bond for Cleanup Required. (a) Prior to the issuance of a permit for the demolition of any building or structure, the person applying for such permit shall execute a surety bond or deposit cash or cashier ' s check in the amount of $50.00 to guarantee that he will clean up the site after the demolition has been completed. He shall be given a period of thirty (30) days after the build- ing is demolished within which to clean up the prop- erty in accordance with the specifications herein- after set out. When the Building Official certifies that such site has been so cleaned up, such deposit will be refunded. (b) In the event the holder of the permit fails to clean up the site within said thirty day period, the Building Official shall be authorized to cause the property to be cleaned up, and to use the deposit to pay for such cleanup. If any permit holder so forfeits a deposit, he will thereafter be required to make a deposit in the sum of $100.00 in order to obtain a permit. (c) The following specifications for proper cleanup shall be complied with. The cleanup opera- tion shall be conducted in a workmanlike manner, and the site shall be cleared of all debris, such as lumber scraps, pieces of trees and bushes, and pieces of loose concrete displaced from original position, that was connected to or in any way re- lated to the building which was demolished. The removal of concrete flooring and concrete founda- tion will not be required. '" SECTION 2 . Section 7-15 of the Code of Ordinances is hereby amended by adding Subsection (14.1) which shall read as follows: " (14. 1) Amend Section 2204 by adding Subsection 2204.7, which shall read as follows : - 2 - ' 2204.7 - Cleanup Requirements ; Bond Required. (a) Prior to the issuance of a moving permit, the person applying for such permit shall execute a surety bond or deposit cash or cashier ' s check in the amount of $50 .00 to guarantee that he will clean up the site after the building has been moved. He shall be given a period of thirty (30) days after the building is moved within which to clean up the property in accordance with the speci- fications hereinafter set out. When the Building Official certifies that such site has been so cleaned up, such deposit will be refunded. (b) In the event the holder of the permit fails to clean up the site within said thirty day period, the Building Official shall be authorized to cause the property to be cleaned up, and to use the deposit to pay for such cleanup. Section 7-15, Subsection (3) (B) (II) of the Code of Ordinances is hereby amended so that it shall read as follows: " (II) Permit fee for the moving of any building or structure over ten feet (10 ' ) wide or over twelve feet (12 ' ) long shall be $35.00 for each building or fraction thereof; this fee shall include the cost of police escort and traffic engineering. However, for any move requiring longer than three hours of actual moving, there shall be an addition- al $35.00 fee for each additional two hours or frac- tion thereof of actual moving." SECTION 4. The fact that a number of buildings are now in the process of being moved or demolished, and there is no ade- quate provision for cleanup of the site, which creates a health and safety hazard, this Ordinance is declared to be an emergency measure, and it shall become effective upon its passage.
