AN ORDINANCE ABANDONING THE CONSTRUCTION OF IMPROVEMENTS ON PORTIONS
OF STREETS AT LOCATIONS OUT OF THE 1970 ASSESSMENT PAVING PROGRAM,
DELETING SAME FROM CONTRACT WITH R. 0. GREEN CONSTRUCTION COMPANY,
WICHITA FALLS, TEXAS; AND CANCELLING THE ASSESSMENT LIENS LEVIED
AGAINST ABUTTING PROPERTIES.
WHEREAS, by Ordinance 2584, dated April 21, 1970, the Board of Alder-
men of the City of Wichita Falls, Texas, a municipal corporation, determined
the necessity of paving and constructing other improvements on portions of
streets designated as a portion of the 1970 Assessment Paving Program in
Wichita Falls, and a notice of such action, in accordance with Article 1220A
of Revised Civil Statutes of Texas, was filed with the County Clerk and was
recorded in Volume 605, Page 773 of the Deed of Trust Records of Wichita
County, and;
WHEREAS, by Resolution 1074, dated May 5, 1970, the Board of Aldermen
of the City of Wichita Falls, Texas, adopted the plans and specifications
and authorized for the advertisement for bids, and;
WHEREAS, there is insufficient funds for the financing of the entire
Program as proposed by the bids, and;
WHEREAS, R. 0. Green Construction Company, who have contracted with the
City for the construction of said improvements, have consented to the aban-
donment of the Improvements on such portions of streets.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF
WICHITA FALLS, TEXAS, THAT:

The improvements on the following portions of streets shall be abandon-
ed, and same shall be deleted from the contract with R. 0. Green Construction
Company, Wichita Falls, Texas, and the assessment liens heretofore levied
against properties abutting such portions of streets are hereby cancelled,
to-wit:
ARIZONA AVENUE: From the east property line
of Arthur Street to the west
property line of Kemp Blvd;
BROAD STREET: From the north property line
of Fourth Street to the east
property line of Brook Street;
BURNETT STREET: From Moore Blvd. (East Service
Road of Expressway South) to
the south property line of
Twentieth Street;
CALIFORNIA ST. : From the south property line
of East Scott Street to the
north property line of Kell
Blvd. ;

The City Clerk is hereby directed to file a notice of this ordinance
with the County Clerk of Wichita County, Texas, for the purpose of releas-
- ing the assessment liens against such properties abutting the portions of
streets set out above.

NOTICE OF RELEASE OF ASSESSMENT
THE STATE OF TEXAS )(
COUNTY OF WICHITA X
WHEREAS, the Board of Aldermen of the City of Wichita Falls, Texas,
a municipal corporation, has heretofore ordered an assessment against
certain property abutting the list of streets listed below, and,
WHEREAS, notices of said assessment were dated April 21, 1970, and
recorded in Volume 605, Page 773 of the Deed of Trust Records of Wichita
County, Texas, to which reference is here made for all purposes.
WHEREAS, by Ordinance No. , .5 91 , dated June 2, 1970, the
Board of Aldermen released such assessments against the properties abut-
ting the following portions of streets, to-wit:
ARIZONA AVENUE: From the east property line
of Arthur Street to the west
property line of Kemp Blvd. ;
BROAD STREET: From the north property line
of Fourth Street to the east
property line of Brook Street;
BURNETT STREET: From Moore Blvd. (East Service
Road of Expressway South) to
the south property line of
Twentieth Street;
CALIFORNIA ST. : From the south property line
of East Scott Street to the
north property line of Kell
Blvd. ;
NOW, THEREFORE, notice is hereby given that such assessment liens
levied against the properties abutting on the above set out portions of
streets have been cancelled.
