Ord 2608 9/1/1970 ORDINANCE NO. e42: 4; 0 G `� ORDINANCE- ACCEPTING IMPROVEMENTS ON TWO (2) UNITS OF THE 1970 RECONSTRUCTION PAVING PROGRAM IN THE CITY OF WICHITA FALLS, TEXAS, AS DESIGNATED IN ORDINANCE NO. 2562; DECLARING THE CONTRACT WITH R.O. GREEN CON- STRUCTION COMPANY, WITHITA FALLS, TEXAS, FOR THE CON- STRUCTION OF SAID IMPROVEMENTS FULLY COMPLETED AND PER- FORMED; DIRECTING THE ISSUANCE, EXECUTION AND DELIVERY OF CERTIFICATES IN EVIDENCE OF SPECIAL ASSESSMENTS LEVIED AFTER GIVING EFFECT TO SUNDRY CREDITS HEREIN AUTHORIZED AND ALLOWED AGAINST SOME OF SAID ASSESSMENTS ; DIRECTING THE CITY CLERK TO ENGROSS AND ENROLL THIS ORDINANCE BY COPYING THE CAPTION OF SAME IN THE MINUTE BOOK OF THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS, AND BY FILING THE COMPLETE ORDINANCE IN APPROPRIATE ORDINANCE RECORDS OF SAID CITY: AND PROVIDING AN EFFEC - TIVE DATE. WHEREAS, the City of Wichita Falls, Texas has heretofore entered into contract with R. 0. Green Construction Company, Wichita Falls, Texas, for the making and constructing of certain street improvements on the hereinafter described portions of streets, avenues and public places in the City, to-wit: BEVERLY DRIVE: From the north property line of Ninth Street to the South property line of Highway U.S. 277. LAKE PARK DRIVE: From .the north property line of Singleton Avenue to the north property line of Southwest Parkway. WHEREAS, by sundry proceedings heretofore passed by the Board of Aldermen of the City of Wichita Falls, Texas, including Ordinance No. 2577 a portion of the cost of said improvements was levied and assessed against the respective properties abutting on each of the above assessed portions of streets, avenues and public places and against the real and true owners thereof; and, WHEREAS, the Board of Aldermen of the City of Wichita Falls, Texas, has upon review, found and determined that, in some instances in order to effect substantial justice and equality, it is desireable and necessary to grant and issue certain credits against some one or more of the assessments levied by Ordinance No. 2577 and, WHEREAS, the street improvements hereinabove mentioned have been completed upon each of the portions of streets, avenues and publice places hereinabove described, and have been inspected and found to be in complete accor- dance with the contract therefor; • NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMENT OF THE CITY OF WICHITA FALLS, TEXAS, THAT: I. The improvements on each of the portions of streets, avenues and public places hereinabove described be, and they are hereby, accepted ; and the contract with reference thereto be, and is hereby, found and declared fully completed and performed. 1.1. The assessments as levied by Ordinance No. 2577 shall be computed for each property owner_and the same together with the Engineer's Roll of Two (2) streets of the six locations herein accepted shall be delivered to the Tax- Assessor-Collector, and he shall prepare statements which shall be sent to the property owners. III. The City Clerk is hereby directed to engross and enroll this Ord- inance by copying the caption of same in the Minute Book of the Board of Alder- ment of the City of Wichita Falls, Texas, and by filing the complete ordinance in the appropriate Ordinance Records of said City. IV. This Ordinance shall take effect and be in full force and effect from and after the date of its passage.
