AN ORDINANCE GRANTING AUTHORITY TO THE BETHANIA
HOSPITAL TO LAY A SEWER LINE WITHIN THE ELEVENTH
STREET RIGHT OF WAY.
WHEREAS, the Bethania Hospital is presently being
enlarged, and they have requested authority to lay a sanitary
sewer line encroaching on the right of way of Eleventh Street.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDER-
MEN OF THE CITY OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. The Bethania Hospital is hereby granted the
right and authority to construct, maintain and operate a 6" cast
iron sanitary sewer line beneath the sidewalk in front of said
hospital within the right of way of Eleventh Street.
SECTION 2 . It shall be the duty of said Bethania
Hospital at all times to maintain said sewer at its own expense.
If at any time in the future some public use of such right of
way makes it necessary that the said line be relocated or removed,
such relocation or removal shall be done at sole cost and expense
of Bethania Hospital.
SECTION 3. Whenever any work is being done on the con-
struction or maintenance of said line, the Bethania Hospital shall
take all the necessary and proper precaution to protect the public
from damage, and said Bethania Hospital shall save the City of
Wichita Falls harmless from all damages, or claims for damage,
resulting from the construction, maintenance and operation of said
sewer line.
SECTION 4. The right and authority hereby granted is
for a period of twenty-five years from the date of this ordinance.

SECTION 5. The fact that the hospital expansion is
now being constructed, the laying of this sewer line constitutes
an emergency, and this ordinance is passed as an emergency measure
and shall take effect immediately after its passage.
