Ord 2643 3/2/1971 • **** (Approved by Aviation Advisory Board, Feb. 24, 1971 ) ORDINANCE NO. 2 AN ORDINANCE ESTABLISHING REGULATIONS GOVERNING THE MUNICIPAL AIRPORT OF THE CITY OF WICHITA FALLS, TEXAS, PROVIDING A PENALTY AND DECLARING AN EMERGENCY BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS THAT: SECTION I. There is hereby adopted by the Board of Aldermen for the purpose of prescribing regulations governing the Municipal Airport of the City of Wichita Falls, Texas, that certain code known as the Code of Ordinances of the City of Wichita Falls, Texas, and the whole thereof, save and except such portions as are hereinafter deleted, modified or amended by this Ordinance, of which Code not less than three copies have been and are now filed in the Office of the City Clerk and the same are hereby adopted and incorporated fully as if set out at length herein. Unless otherwise provided by the statutes and regulations of the United States or of the State of Texas or in rules and regulations prescribed by the Commander of Sheppard Air Force Base, the provisions hereof shall be controlling within the boundary of the Municipal Airport. (Wherever the word building is used in the Code of Ordinances of the City of Wichita Falls it shall be deemed to include the Terminal Building, hangars, shops, and other buildings located at the Municipal Airport.) SECTION II. The following additions and amendments are hereby made in the Code of Ordinances of the City of Wichita Falls, Texas adopted in Section I next above. 1. Definitions: For the purpose of this article the following terms or words shall have the meaning herein ascribed to them unless the context clearly requires otherwise. (a) Airport: That property leased by the Secretary of the Air Force to the City of Wichita Falls by Lease No. DA 41-443-eng-5551 dated the 20th day of July, 1959 and encompassing some 50.73 acres, more or less and outlined in Exhibit A. (b) Airport Manager: Official representative of City, appointed by the City Manager, and responsible for supervision of all airport activities. (c) Airport Employees: The bonafide employees of all organi- zations, activities, governmental agencies, located on, and connected with the operation, maintenance and servicing of the Airport. (d) Passenger: Any person, other than a crew member, who enters the Airport in possession of an airline ticket with the intention of board- ing an aircraft within a reasonable time for another destination or who arrives on a commercial aircraft from another airport. (e) Visitors: Any member of the *general public not identified as a passenger, or an employee of Fixed Base or Aviation Operators. (f) Vehicle: Every vehicle which is self-propelled, other than an aircraft. (g) Aircraft: Any contrivance used for or designed for navigation of or flight in air. (Operate, with respect to aircraft, means use, cause to use, or authorized to use aircraft for the purpose of aerial navigation including the piloting, taxiing or towing with or without the right of legal control as owner, lessee or otherwise. ) (h) Baggage: Such articles, effects and other personal property of an airline passenger as are necessary or appropriate for wear, use, comfort or convenience in connection with his trip. It includes both checked and unclaimed baggage. (i ) Fixed Base Operator: Any person or organization engaged in direct support of aviation operations (i .e. , fuel sales, maintenance, hangar rental , etc. ) by virtue of a contract with the City. (j) Aviation Operator: Any person or organization engaged at the Airport in a business not within the scope of a Fixed Base Operator, as defined above, who is authorized to conduct such business by virtue of a contract with the City. (k) Aircraft Operator: means the pilot of an aircraft and, for the purpose of this Ordinance, includes student pilots, pilots-in-command and crew members assigned to perform duty in an aircraft. -2- (1 ) Ramp Vehicles: Any motor vehicles used for the transporting or handling of baggage, freight and aviation fuel , oils or lubricants and assigned by Fixed Base or Aviation Operators to such functions. (m) Sheppard: The Commander, Sheppard Air Force Base, or his designated representative. (n) Public Area: Those areas including the various concessions, rest rooms, terminal lobby and ticketing sections, concourses used for public thoroughfares, gathering, waiting and viewing, street, roads and sidewalks and all other areas normally used by the general public. 2. Airport Operational Areas: The following areas shall be available for use for the following purposes and such areas may be used by members of the public, aircraft operators, officers and employees of aircraft operators, passengers and others for such purposes and for such purposes only. Such areas are depicted on Exhibit A. (a) Commercial Ramp Area: This area is reserved for parking, load- ing, and refueling of scheduled and non-scheduled airline, charter and large (over 25,000 pounds maximum gross landing weight) aircraft; the parking, loading and refueling of transient aircraft on the extreme east side of said area; and for ingress and egress between runways/taxiways and other ramp areas. (b) Public Ramp Area: This area may be used for the parking and storing of aircraft; the loading and unloading cargo, mail and supplies to or from aircraft; for servicing aircraft with fuel and lubricants; for en- planing and deplaning of passengers ; for the performance of operations commonly known as "ramp service" and for minor inspections incidental to such service. Private vehicles shall be permitted access to this area to facilitate loading and unloading of cargo and the enplaning of passengers but shall be moved as expeditiously as possible to the appropriate parking area. 3. Restricted Areas: All taxiways and ramp areas of the Airport are restricted and no person shall enter upon such areas except: Persons assigned to duty therein, aircraft operators and their guests. Authorized representatives of the Federal Aviation Administration. -3- Passengers, under appropriate supervision, entering the ramp areas for the purpose of enplaning and deplaning, and visitors under appropriate supervision. Business representatives in the conduct of their affairs with Fixed Base and Aviation Operators. Emergency Personnel (Fire/Police/Safety) in the conduct of their duties. Visitors _attending receptions and political gatherings approved by the Airport Manager. VEHICLES 4. General Vehicle Operation: (a) All persons operating vehicles within the Airport shall be subject to Municipal , State and Federal Laws and these Airport Regulations for the control of all vehicles. (b) Pedestrians and aircraft in motion shall at all times have right of way over vehicular traffic. (c) All vehicles shall pass to the rear of taxiing aircraft and, clearance permitting, shall pass no nearer than twenty (20) feet horizontal distance from any wing or tail section of a parked aircraft. (d) Vehicles shall not exceed fifteen (15) miles per hour when operating on ramps and taxiways of the Airport. 5. Parking: (a) All persons using the Airport shall park private and commercial vehicles within the Public Parking Area (Area 5) unless authorized to park within the following restricted areas (depicted on Exhibit A). Area #1 Taxicabs/Limousines: Two open spaces are provided directly in front of the Terminal Building. Aera #2 Passenger Loading Area: This area is reserved for on/off loading of baggage, passengers and visitors. Vehicles shall not be allowed to stand unattended in this area or be allowed to wait or stand or park within or adjacent to such areas when not actively on/off loading. Area #3 Rental Car Ready Spaces: Two "ready" spaces immedi- ately in front of the Terminal Building are allocated to each Rental Car Agency operating at the Airport. Such spaces shall be posted "RESERVED" by respective agencies with standard identification signs. -4- Area #4 Rental Car Storage Area: This area is restricted to parking of Rental Cars. Spaces within this area shall be allocated to the Rental Car Agencies under contract with the City for operation at the Airport. Such spaces shall be posted "RESERVED" by the respective agencies with standard identification signs. Area #6 Employee Parking Area: All employees of organizations and agencies having tenancy at the Airport shall park private vehicles in the Employee Parking Area. Only those vehicles registered with the Airport Manager and possessing authorized parking decals shall be permitted in the Employee Parking Area. Registration for employee parking shall be renewed on or before October 1 each year. Employees will be required to pay a Two Dollar Fee as deposit on a pass-key, which deposit will be refunded on termination of employment and return of the pass-key. Area #7 Freight/Delivery Area: This area is reserved for the delivery and receipt of air freight and for service vehicles such as utility company trucks, delivery trucks, etc. Vehicles will not be permitted to park in this area unless actively en- gaged in such activities. Service vehicles using this area shall not block access to the freight/loading dock. Area #8 Government Vehicle Area: This area is reserved for the parking of U. S. Government Vehicles assigned to activities based at the Airport. Area #9 Refueling Vehicle Area: This area is reserved for the parking of refueling vehicles operated by the Fixed Base Operators. Area # 10 Ramp Vehicle Area: This area is reserved for the parking of all Ramp Vehicles with the exception of Refueling Vehicles. Area #11 Hangar #3 Area: This area is reserved for owners/ operators of aircraft stored in Hangar #3. Area #12 Hangar #2 Area: This area is reserved for owners/ operators of aircraft stored in Hangars #1 and #2. Area #13 Perimeter Area: This area is reserved for students assigned to training institutions operating at the Airport under a parking agreement approved by the City, however, the Airport Manager may extend the use of Area #12 to such students -5- for a period not to exceed 90 days to permit negotiation of such a parking agreement. (b) Parking within Areas #11, #12 and #13 shall be regulated by decals issued by the Airport Manager and no vehicle shall be parked in such areas without such decal displayed. (c) Owners of aircraft hangared in individual T-Hangars may park their vehicles within such hangars. 6. Removal of Vehicles : No person shall park a vehicle on the Airport except at such places as authorized above, nor park a vehicle in any space marked for parking in such manner as to occupy part of another parking space, nor park, stand or wait any vehicle in any reserved or restricted area so marked. The City shall have the authority to direct movement of said vehicle from the place where it is unlawfully parked or stored to any other designated place; if the operator refuses to comply with such direction, the City may have said vehicle towed to such designated place at the operator's expense, without liability of the City for damage which may result in the course of such moving. 7. Repair of Vehicles: No person shall clean or make any repairs to vehicles anywhere within the Airport other than in a shop or other area designated for such purpose, except minor repairs necessary to remove such vehicle from the Airport. SAFETY 8. Combustible Refuse and Waste: (a) No persons will dump or dispose of any refuse, oil waste or "soil" waste, fuels, dopes, paint solvents or acids in any storm sewer, drainage ditches or natural drains, within or adjacent to the Airport boundary, nor in any hangar, nor on any ramp area of the Airport, provided that such draining of fuel as required in the conduct of preflight inspect- ions shall be permitted. (b) Lessees and tenants of hangars , shops and other maintenance areas shall provide metal receptacles with self-closing covers for storage of oily wastes, rags, and other rubbish. (c) All such receptacles shall be stored away from sources of heat and the contents shall be removed from the premises by such lessees and tenants. -6- (d) No person shall keep uncovered trash containers in any outside area. 9. Fire Extinguishers: All tenants or Lessees shall supply and maintain such adequate and readily accessible fire extinguishers as are approved by Fire Underwriters for the particular hazard involved. All fire extinguishers shall be maintained in first class operable condition. 10. Fire Hazards : (a) No person shall use inflammable volatile liquids having a flash point of less than 1000 F. in the cleaning of aircraft, aircraft engines, parts , appliances or for any other purpose unless such operations are conducted in the open air away from structures and equipment. (b) No person shall keep or store any inflammable liquids, gasses, oil , oil wastes , flares, paints or other similar material in the hangars or in any buildings within the Airport boundary, provided that such materials may be kept in rooms or receptacles approved by the City. (c) Tenants and Lessees shall provide suitable metal receptacles with covers for the storage of wastes, rags and other rubbish. (d) No person shall smoke or carry lighted cigars , cigarettes, pipes, matches or any naked flame in or upon any fuel storage area, public landing area, commercial ramp area, public ramp area, or in any other place where smoking is specifically prohibited by signs, or upon any open space not in motion, or within ' hin fifty (50) feet o fan fuel carrier which is no , wit any Y ( ) fifty (50) feet of any aircraft. (e) No person shall start any open fires of any type, including flare pots, torches on any part of the Airport except as authorized by City. 11 . Miscellaneous : (a) Fire extinguisher equipment at the Airport shall not be tampered with at any time or used for any purpose other than fire fighting or fire prevention. All such equipment shall be inspected in conformity with the National Board of Fire Underwriters' regulations. Tags showing the date of the last such inspection shall be left attached to each unit. -7- (b) Heater valves, sprinkler valves and devices, blower motors or any other Airport machinery or equipment shall not be tampered with at any time. No person other than an authorized airport employee of the City shall turn heaters in public areas on or off, or operate any other airport equipment, except in leased areas. (c) No boxes, crates, rubbish, paper or litter of any kind shall be permitted to be stored in or about the hangars. (d) All Lessees on the Airport shall keep the floors of the hangars or other buildings , terminal aprons, pits and areas adjacent thereto leased or used by them respectively, free and clear of oil , grease and other trash or rubbish. (e) Any person including the operators of aircraft, causing over- flowing or spilling of excess oil or grease on any apron areas shall clean such areas. (f) No person shall operate a vehicle or gasoline engine without exhausts protected by screens or baffles to prevent the escape of sparks. Aircraft are exempt from this requirement. (g) Gasoline, oil and solvent drums or receptacles shall not be stored on aircraft parking areas or in hangars or ramp areas adjacent thereto. Such drums or receptacles will be enclosed and covered in housings approved by the City. (h) No person shall use volatile flammable substances for clean- ing the Terminal Building, hangars or other buildings of the Airport. 12. Accident Reports: (a) Any person involved in any accident on the Airport, personal or vehicle, shall report the same to the Airport Manager as soon as possible giving all pertinent information. (b) Any person involved in a vehicle accident on the Airport shall additionally report the same to the Wichita Falls Police Department. 13. Bomb Threats: (a) On the receipt of a bomb threat relative to a particular air- craft, it shall be the duty of the pilot, and/or the company owning or operating such aircraft to notify the Police Department and the Airport Manager and to remove all passengers from such aircraft. -8- (b) The Airport Manager shall be empowered to: (i) order evacuation of the Terminal Building, to prohibit entrance thereto, and to permit its subsequent occupancy. (ii) direct the taxiing or towing of aircraft on which bomb is alleged to be contained, to a remote "holding" area of the Airport or, with permission of Sheppard, to a more remote "holding" area on Sheppard Air Force Base where such aircraft is to be evacuated and/or searched. (iii) designate protected areas for the inspection, by airline employees and police authorities, of passengers, baggage, and luggage of affected aircraft. 14. Model Aircraft: The flying of model aircraft on or from the Airport is prohibited. 15. Hunting: Hunting or the discharge of firearms on or from the Airport is prohibited. 16. Animals: No person shall enter the Terminal Building or ramp areas of the Airport with a dog or other animal unless such animals are to be trans- ported by air and are restrained by leash or properly confined. This provision shall not apply to "seeing eye" dogs. AIRCRAFT RULES 17. General : (a) The Airport Manager may prohibit aircraft operation on the Airport for periods up to 24 hours under emergency conditions when such operation is likely to endanger persons or property. (b) No aircraft shall be operated or parked on the surface of the public or commercial ramp or on taxiways of the Airport in a careless or negligent manner or in disregard of the rights and safety of others, or without due caution and circumspection, or at a speed or in a manner which is likely to cause hazard to persons or property. (c) Aircraft engines will be warmed up only on the ramp or taxiways and in accordance with the following procedures: . (1) At no time will engines be left running or be tested without an aircraft operator at the controls. -9- • (ii) At no time shall engines be operated when such operation would be likely to cause unreasonable hazard to persons or property. (iii ) Starting engines shall be prohibited until all safety procedures have been met. (d) No person shall park an aircraft or leave the same standing on the commercial ramp, public ramp, taxiway or on areas adjacent thereto or other operational area of the Airport except at such places as authorized herein. When such aircraft interfere with normal operation of the Airport or under emergency conditions, the City shall have the authority to direct movement of said aircraft from the place where it is parked or stored to any other designated place; if the operator refuses to comply with such direction, the City may have said aircraft towed to such designated place at the operator's expense, and without liability of the City or of the person or firm who tows the aircraft at City's request for damage which may result in the course of such moving. (e) When parked unattended every aircraft shall be chocked with wheel blocks or tied down. 18. Itinerant Operations: The aircraft operator of all scheduled or non-scheduled air carrier aircraft shall , on request, provide the Airport Manager's Office with his name and the address and telephone number of the local place he may be reached in the event he leaves his aircraft unattended at the Airport for any period of time. Carriers maintaining offices at Airport are exempt from this requirement. 19. Local Operations: The basing of personal and company owned aircraft at the Airport shall be subject to lease agreement with Fixed Base Operators and registra- tion with the Airport Manager. 20. Disassembled Aircraft: Except in hangars, no disassembled aircraft shall be permitted at the Airport. 21 . Disabled Aircraft: When an aircraft is damaged or otherwise disabled on the landing field or Airport, the pilot, its owner,, or the agent of the owner shall -10- .promptly have the aircraft removed to a hangar for the necessary repairs. This provision shall not apply to aircraft which, by virtue of size, cannot be accommodated within Airport service hangars. 22. Repairs: No aircraft repairs shall be performed on any ramp or taxiway, nor on any areas adjacent thereto nor in any hangar at ,the Airport except under contract with the City; provided, however, that this provision shall not prohibit simple or minor preservation operations and "preventive maintenance" as defined in Federal Aviation Regulations within such areas nor prohibit such preventive maintenance or other authorized repairs by an owner/operator to his own aircraft within his assigned T=hangar. 23. Responsibility for Emergency Repair: Scheduled Commercial Airlines serving the Airport will provide such necessary service and maintain such minimum parts and equipment as specified by Sheppard to effect expeditious repair and removal of their aircraft suffer- ing minor damage during operation on runways/taxiways. 24. Responsibility of Aircraft Crash Removal : The owner or operator of an aircraft under an emergency or in- volved in a crash or otherwise disabled shall be responsible for the removal of such aircraft. Aircraft which have crashed on runways and taxi- ways , or on Airport, shall be removed from such areas as soon as possible. All costs incurred for such removal shall be borne by the owner or operator of the aircraft involved. Runways or taxiways upon which a crash has occurred may be reopened only after the removal of the aircraft and all debris resulting therefrom by the owner or operator to the satisfaction of Sheppard. Should said owner or operator fail , refuse or be unable to remove such aircraft and debris within such time as Sheppard shall determine to be reasonable or if Sheppard in his sole discretion shall determine that an emergency exists or that because of operational or training requirements the runway or taxiway included must be cleared as expeditiously as possible, Sheppard may immediately, and without liability to himself, the United States or any of its other officers, agents or employees cause said aircraft and debris to be removed and stored off the active airfield and the cost of such removal and storage shall be paid by the owner or operator of the aircraft involved. -11- COMMUNICATIONS 25. Radio Equipment: (a) Vehicles proceeding beyond the Commercial Ramp Area, onto taxiways/runways or areas adjacent thereto shall be equipped with two- way radio and be in continuous communication with Sheppard Air Force Base Control Tower. (b) Vehicles without two-way communciation and requiring access to taxiways/runways may be authorized access to such areas by specific prior approval of Sheppard Air Force Base Operations which will coordinate with the Sheppard Air Force Base Control Tower which, in such cases , will grant clearance to proceed by signal light. Upon receiving such clear- ance to proceed, drivers will insure by personal observation that no air- craft is approaching his position before proceeding onto any taxiway or runway. 26. Terminal Public Address System: No person shall use the public address system without authorization of the City nor for purposes other than standard airline flight and ground transportation announcements and terminal paging. CONDUCT OF PUBLIC 27. Sanitation: (a) No person shall dispose of garbage, papers, refuse, or other material within the Airport boundaries except in receptacles and facilities to be provided for that specific purpose. . (b) No person shall use a comfort station or rest room other than in a clean and sanitary manner. (c) No person shall expectorate or spit on the floors , walls, fixtures or other surface of any Airport buildings. 28. Abandonment of Personal Pr p erty: No person shall willfully abandon any personal property on the Airport. 29. Lost Articles: All lost articles shall be turned in to the Airport Manager's Office by the finder. Such articles not claimed within 60 days will be turned over to the Police department and will be disposed of in accordance with that agency's standard procedure. -12- 30. Restrictive Practices: (a) Interfering or Tampering with Aircraft: No person shall interfere or tamper with any aircraft or put in motion the engine of such aircraft, or use any aircraft, aircraft parts, instruments or tools, without permission of the owner. (b) Weapons, Explosives, and Inflammable Materials : No persons except Peace Officers, duly authorized Post Office employees or members of the Armed Forces of the United States on official duty or other persons authorized by law shall carry any weapons, explosives, or imflammable material on the Public Area of the Airport except cased sporting guns carried for trans-shipment. 31. Preservation of Property: (a) No person shall destroy, injure, deface or disturb in any way buildings, signs , equipment, marked facilities or other structures , trees flowers, lawns or other property on the Airport. (b) No person shall alter, make additions to, or erect any building or sign or make any excavations within the Airport without permission of the City. 32. Interfering With City Employees: It shall be unlawful for any person to hinder, molest, or interfere with any employee of the City in the discharge of official duties at the Airport 33. Applicability: Except to the extent prohibited by law, this Ordinance shall be applicable and binding on all persons, firms and corporations having existing contracts or leases with the City. 34. Savings Clause: It is hereby declared to be the intention of the Board of Aldermen of the City of Wichita Falls that the sections, subsections, paragraphs, sentences, clauses, or phrases of this Ordinance are severable and if any of the sections, subsections, paragraphs, sentences, clauses or phrases of this Ordinance are declared or adjudged invalid or unconstitutional , such constitutionality or invalidity shall not affect any of the remain- ing sections, subsections, paragraphs, sentences, clauses or phrases of this Ordinance. -13- 35. Enforcement: (a) General : Where the penal laws of the State of Texas and/ or of the United States of America prescribe any punishment for the viola- tion of any provision of this Ordinance, the State and/or Federal penal provisions shall apply to the prohibited act or conduct herein. (b) Aircraft: It is the intention of the City that the pro- visions of this Ordinance pertaining to the operation, storage, repair, and parking of aircraft herein are to be enforceable as follows : (i ) Where the Airport Manager or any representative of the City, Fixed Base or Aviation Operator observes or suspects any act or situation involving aircraft which is or is deemed to be violative of the regulations of this Ordinance pertaining to aircraft operation, storage, parking, repair, or other such use, the person observing the violation or suspected violation shall notify the aircraft owner, pilot, operator, possessor, user or bailee of the provision of this Ordinance deemed applicable and/ or of the suspected violation requesting voluntary com- pliance with the applicable provisions thereof. (ii ) It is provided however, that after such notice as required in the paragraph next above, any person or persons willfully violating any provision of this Ordinance govern- ing unlawful aircraft under this Ordinance shall be guilty of a misdemeanor and upon conviction shall be fined not more than TWO HUNDRED DOLLARS ($200.00). (c) Vehicles: The enforcement of the provisions of this Ordinance governing the operation and parking of vehicles on the Airport shall be that now prescribed by the laws of the State of Texas and the traffic and parking provisions of the City Code of the City of Wichita Falls , and where no enforcement provision be so provided for a violation of any vehicular operation or parking provision required in this Ordinance, the provisions of the next paragraph snail be applicable. -14- 36. Penalty (Except as to Aircraft) : Any person or persons unlawfully violating any provision of this Ordinance shall be guilty of a misdemeanor and upon conviction shall be fined not more than TWO HUNDRED DOLLARS ($200.00). 37. Declaring an Emergency: The fact that there are not now rules and regulations governing the Airport and that effective rules and regulations are needed for the preservation of public health, safety and welfare of the City of Wichita Falls, its citizens and Municipal Airport, creates an emergency that requires this Ordinance to become effective immediately. 38. Codification: The provisions of this Ordinance shall be included and incorporated in the Code of Ordinances of the City of Wichita Falls, Texas, as an addition thereto, and shall be appropriately renumbered to conform to the uniform numbering system of the Code.
