Ord 2657 7/6/1971 ORDINANCE NO. ' ' f'7 7- 7/ ORDINANCE ACCEPTING IMPROVEMENTS OF MIDWESTERN PARK- WAY (ARCHER-HAMILTON-HAMPSTEAD) FROM ARMORY ROAD TO THE EAST PROPERTY LINE OF U. S. HIGHWAY 281 EXPRESS- WAY IN THE CITY OF WICHITA FALLS, TEXAS AS DESIGNATED IN ORDINANCE NO. 2508. DECLARING THE CONTRACT WITH STUCKEY CONSTRUCTION COMPANY, WICHITA FALLS, TEXAS, AND HEBER BRANTLEY, VERNON, TEXAS, FOR THE CONSTRUCTION OF SAID IMPROVEMENTS FULLY COMPLETED AND PERFORMED; DIRECTING THE ISSUANCE, EXECUTION AND DELIVERY OF CER- TIFICATES IN EVIDENCE OF SPECIAL ASSESSMENTS LEVIED AFTER GIVING EFFECT TO SUNDRY CREDITS HEREIN AUTHOR- IZED AND ALLOWED AGAINST SOME- OF SAID ASSESSMENTS; DIRECTING THE CITY CLERK TO ENGROSS AND ENROLL THIS ORDINANCE BY COPYING THE CAPTION OF SAME IN THE MIN- UTE BOOK OF THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS , AND BY FILING THE COMPLETE ORDINANCE IN APPROPRIATE ORDINANCE RECORDS OF SAID CITY; AND PROVID- ING AN EFFECTIVE DATE. WHEREAS, the City of Wichita Falls, Texas has heretofore entered into contract with Stuckey Construction Company, Wichita Falls, Texas, and Heber Brantley, Vernon, Texas, for the making and constructing of certain street improvements on the hereinafter described portions of streets, avenues and public places in the City, to-wit: MIDWESTERN PARKWAY: From the east property (Archer-Hamilton-Hampstead) line of Armory Road to PHASE II the east property line of U.S. Highway No. 281 Expressway. WHEREAS, by sundry proceedings heretofore passed by the Board of Aldermen of the City of Wichita Falls, Texas, including Ordinance No. 2542 a portion of the cost of said improvements was levied and assessed against the respective properties abutting on each of the above assessed portions of streets, avenues and public places and against the real and true owners thereof; and, WHEREAS, the Board of Aldermen of the City of Wichita Falls, Texas has upon review, found and determined that, in some instances, in order to effect substantial justice and equality, it is desireable and necessary to grant and issue certain credits against some one or more of the assessments levied by Ordinance No. 2542; and, WHEREAS, the street improvements hereinabove mentioned have been completed upon each of the portions of streets, avenues and public places hereinabove described, and have been inspected and found to be in complete accordance with the contract therefor; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS , TEXAS, THAT: I. The improvements on each of the portions of streets, avenues and public places hereinabove described be, and they are hereby, accepted; and the contract with reference thereto be, and is hereby, found and declared fully completed and performed. II. The assessments as levied by Ordinance 2542 shall be computed for each property owner and the same together with the Engineer's Roll of Mid- western Parkway (Archer-Hamilton-Hampstead) Project herein accepted shall be delivered to the Tax Assessor-Collector, and he shall prepare statements which shall be sent to the property owners. III. The City Clerk is hereby directed to engross and enroll this Ordinance by copying the caption of same in the Minute Book of the Board of Aldermen of the City of Wichita Falls, Texas, and by filing the complete ordinance in the appropriate Ordinance Records of said City.
