AN ORDINANCE ALLOWING THE REQUEST OF SOUTHWESTERN
BELL TELEPHONE COMPANY TO EXTEND FOR FIVE YEARS THE
PERIOD OF THE AGREEMENT CONTAINED IN ORDINANCE NO.
2138
WHEREAS, on December 14, 1964 the Board of Aldermen
adopted Ordinance No. 2138, authorizing Southwestern Bell Telephone
Company to continue to erect and maintain its poles, wires and other
facilities along and across our public streets and alleys under
certain regulations and restrictions for a period beginning November
19, 1964 and ending September 30, 1971, provided that at the end of
the initial period, such term may be renewed for two successive
periods of five years each; conditioned, however, that during the
last four months of each period not less than ninety days prior
written notice shall be given by the telephone company to the City
of the telephone company' s desire that the term be renewed, and the
City shall have the right to either allow the renewal or refuse to
allow it; and,
WHEREAS, the Telephone Company has given the City written
notice of its desire that the term be renewed for a period five
years after September 30, 1971, and the City desires to allow the
renewal.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN
OF THE CITY OF WICHITA FALLS, TEXAS , THAT:
The request of Southwestern Bell Telephone Company that
the agreement contained in Ordinance No. 2138 be renewed for a period
of five years after September 30, 1971 is hereby allowed, and such
agreement shall be renewed for such period.
As the continuation of uninterrupted telephone service is
necessary for the safety and health of the citizens of the city, this
ordinance is declared to be an emergency measure and shall become
effective upon its passage.
